Home My WebLink About2014-OR-58ORDINANCE NO. 2014-01-2- ORDINANCE GRANTING PETITION TO VACATE A PUBLIC RIGHT-OF-WAY IN THE CITY OF JEFFEI2SONVILLE WHEREAS, on November 17, 2014, John Vissing for the Serenity House, Fled his Petition to Vacate a Public Right -Of -Way in the City of Jeffersonville, which public right-of-way is described as all of Bowling Avenue located in the city limits of Jeffersonville, IN, as shown in Deed Drawer 7, Instrument number 4,476 of the Clark County, Indiana records being situated in Jeffersonville, Clark County, Indiana, with the Jeffersonville Common Council (the "Council"), which petition reads as follows: PETITION TO VACATE A PUBLIC RIGHT-OF-WAY IN THE CITY OF JEFFERSONVILLE; and WIIEREAS, notice of a public hearing on the City's Petition to Vacate the Public Right-Of=Way was published in the Evezzizzg News on November 7, 2014 and WHEREAS, notice of a public hearing on the City's Petition to Vacate was mailed by certified mail to each owner of land that abuts the property; and WHEREAS, on November 17, 2014 at 7:00 pm the Council helda public hearing on the Petition of John Vissing for the Serenity house and made the following findings: 1. The best use of the property would be to vacate it, as it is not needed or used for ingress or egress for any purpose. 2_ "fhe vacation of the property as described herein would not injure the public Health, safety, welfare or morals of the community_ 3_ It would be in the best interest of the City Council to grant the Petition to Vacate the property as requested by John Vissing for the Serenity House_ NOW, THEREFORE, IT IS HEREBY 012IuAINED, pursuant to the provisions of LC_ 36-7-3-12, that the public right -of- way described as all of Bowling Avenue located within the city limits of Jeffersonville, as shown in Decd Drawer 7, Instrument number 4,476 of the Clark County, Indiana records being situated in Jeffersonville, Clark County, Indiana, is hereby vacated and the owners are hereby required to record it copy of this Ordinance in the office of the Clark. County Recorder and deliver a copy of this Ordinance to the Clark County Auditor_ This Ordinance shall be in full force and effect from and after its passage and approval.
