Whereas, Robert Lynn Company, Inc_ filed a petition before the Jeffersonville Plan Commission to change the zoning map designation of the real property located on 6.401 acres of land in Stacy Spring Subdivision and fully described in the attached Exhibit A from R3_ Old City Residential to C2= Medium to Large Scale General Commercial; and, Whereas, on July 29, 2014 the Jeffersonville Plan Commission has certified its favorable recommendation of the enactment of this proposed zoning map designation change by ordinance of this Common Council; and, Whereas, this matter is now before the Common Council at its regular meeting after certification of the proposed change of zoning map designation pursuant to the provisions of I.C. 36-7-4-608(0(1); and, Whereas, this Common Council has timely posted notice of its intent to consider the proposed change of zoning map designation at the regular meeting scheduled for August 4, 2014; and, Whereas, all interested persons having been given an opportunity to appear before this Common Council and be heard regarding this matter as required by lave. Now, THEREFORE, BE IT ORDAINED by the Common Council of the City of Jeffersonville, Indiana, that the zoning designation of the real property located on 6.401 acres of land in Stacy Spring Subdivision and fully described in the attached Exhibit A is hereby changed from R3- Old City Residential to C2= Medium to Large Scale General Commercial. IT IS FURTHER ORDAINED that the zoning map of the City of Jeffersonville shall be amended to include such change. This ordinance shall be in full force and effect upon its adoption. The first step is to amend the preliminary plat that was approved by the Plan Commission in 2009. The second step is to rezone the Tots that are intended for commercial uses. A development plan was submitted for review if the Plan Commission recommends the requested zoning. The intended use requires a special exception use so the approval of the development plan would be contingent on the Board of Zoning Appeals decision. Figure 1: Vicinity Map Property Location and History The property is located along State Road 62 and is on the northern boundary of the City's limits. A new road connecting 1- 265 to State Road 62, to be called River Ridge Parkway, will intersect with SR 62 roughly This property was annexed by the City in January 2008. Annexed properties were assigned a zoning district that was most similar to the prior zoning in Clark County. During the annexation process, the applicant requested that this property be zoned R3 and C2 because of some variances and permits that were granted by the County. In April 2009, the Plan Commission approved the Preliminary Plat for the Stacy Spring Subdivision (Figure 3). Preliminary Plat Approval Request The proposed changes to the Preliminary Plat would create two new commercial lots and eliminate 11 residential lots. Coronado Court was planned to provide access to these residences so it would also be removed from the plat. The area that would be affected contains 6.401 acres. Figure 6: Plat with Zon Page 6 of 14 Figure 7: Zoning Map PC -14-18: Stacy Springs Preliminary Plat & Rezoning Zoning Change Procedure The Jeffersonville Zoning Ordinance and Indiana State Statute IC 36-7-4 outlines that the following should be considered when the Plan Commission is reviewing a Rezoning Request: • The Comprehensive Plan; • Current conditions and character of structures and uses in each district; • The most desirable use for which the land in each district is adapted; • The conservation of property values throughout the jurisdiction; and • Responsible development and growth. Comprehensive Plan & Planning Districts The Jeffersonville Comprehensive Plan identifies this property for "Mixed -Use" and places it in the Traditional Neighborhoods and Traditional Workplace Planning Districts. The Plan provides the following guidance: "The Traditional Neighborhood is characterized by predominantly residential uses, by a grid pattern of streets with sidewalks and often including alleys. Residential lots are predominantly narrow and often deep, but the neighborhood may contain sections of large estate lots, and also sections of lots on which appropriately integrated higher density residential uses may be located... Traditional neighborhoods often have and are encouraged to have a significant proportion of public open space such as parks or greenways and may contain civic uses as wells appropriately located and integrated neighborhood -serving land uses such as offices, shops, restaurants and services." "The Traditional Workplace is characterized by predominantly small to medium scale industrial end employment uses. The streets are typically narrow in a grid pattern and often have alleys. Building has little or no setback from the street. The provisions that regulate this land use district should not overly restrict normal business practices. This district can be used adjacent to all other commercial districts and the "R3," "M1" and "M2" residential districts. However, buffering should be provided between this district and any residential district. Jeffersonville's Plan Commission and Board of Zoning Appeals should strive to use this district with the "C1" District to encourage a strong and stable area for commerce. The Plan Commission and Board of Zoning Appeals should not encourage "strip development", rather development in clusters which share resources and minimize the cost of public utilities and services. The Plan Commission and Board of Zoning Appeals should also strive to minimize lighting, un -landscaped large parking lots, parking lots fronting major streets, and traffic conflicts in the "C2" District. The provisions that regulate this land use district should protect, maintain and promote where possible the "old city residential character" in Jeffersonville. Jeffersonville's Plan Commission and Board of Zoning Appeals should strive to protect this district from business encroachment, conflicting land uses, and non - family oriented businesses. The Plan Commission and Board of Zoning Appeals should strive to promote an average net density of 7 to 8 dwelling units per acre community -wide in the "R3" district. The plan includes seven buildings of various sizes and two drives onto Lucas Avenue. The property has frontage on State Road 62 but no entrances are planned for that side of the property. Mini -storage facilities are a special exception use in the C2 zoning district so an approved development plan would be dependent on the BZA granting the special exception use. Development Plan Review The following chart summarizes the standards that apply to this development and how the proposed improvements compare. The Plan Commission can grant waivers from the development standards for building setbacks, landscaping, and signs. The applicant is requesting a waiver from the landscaping standards. The variances to be considered by the Board of Zoning Appeals are highlighted in yellow.
