HomeMy WebLinkAbout1993-OR-35ORDINANCE 93-0R~_~ ORDINANCE OF THE COM~ON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA, ESTABLISHING PROCEDURES FOR A MORE EFFECTIVE OPERATION OF GOVERNMENT AND DELEGATING RESPONSIBILITIES AMONG THE COUNCIL BY ESTABLISHMENT OF A SEVEN MEMBER CABINET WHEREAS, the Common Council of the City of Jeffersonville, Indiana, recognizes the importance of governmental responsibilities and the execution of goals in a professional, efficient and structured manner; and WHEREAS, the Common Council of the city of Jeffersonville, Indiana, can further enhance the City of Jeffersonville, economically, culturally, fiscally and responsibly by establishing a more effective operation of government which will respond to the needs of the citizenery and delegates responsibility for doing so and accountability among its members. WHEREAS, the following seven areas of services are most involved in the operation of government within the City of Jeffersonville and a description of that area follows: 1. INTERIOR / NATURAL RESOURSES - public lands within city limits, parks, general conditions of city lands, and any other related matters. 2. LABOR RELATIONS pensions, insurance, sentatives, employee other related matters. / HUMA/~ RESOURCES employment, union repre- welfare, benefits, and any 3. ENVIRONMENT / PUBLIC SAFETY - fire, police, sanitation services, recycling, hazardous materials, and any other related matters. 4. ECONOMIC DEVELOPMENT - planning for business and industrial development, KIPDA project updates, long and short term development objectives, comprehensive master plan briefings/- updates, planning and zoning updates, innovative workforce program, economic development promotional plan, and other related matters. 5. TRANSPORTATION - maintenance, repair, and creation of streets and roadways, travel service i.e. public transportation by Tarc, water taxi, etc., and other related matters. 6. BUDGET / FINANCE - long and short term fiscal goals, projections, and objectives, quarterly budget comparison reports, creative financing, investments, grants, bonds, taxes, and other related matters. 7. GOVERNMENTAL / COMMUNITY RELATIONS - interaction with Clark County, Greater Clark County School Board, Jeffersonville Township Library Board, civic organizations, churches, Chamber of Commerce, State Legislative liaison, other governmental entities and other related matters. NOW, THEREFORE BE IT ORDAINED by the Common Council of the City of Jeffersonville, Indiana, that a Common Council Secretary Cabinet is hereby established to better identify, define and execute said governmental responsibilities and goals for the advancement of the effective operation of government for the City of Jeffersonville; That the delegation of responsibilities shall consist of seven elected Common Council Members given authority to hold their respective Secretary positions as mutually agreed upon between them and assigned by the Common Council Members. The Common Council Secretary Cabinet shall consist of the following positions: 1. Council Secretary for Interior / Natural Resources 2. Council Secretary for Labor Relations / Human Resources 3. Council Secretary for Environment / Public Safety 4. Council Secretary for Economic Development 5. Council Secretary for Transportation 6. Council Secretary for Budget / Finance 7. Council Secretary for Governmental / Community Relations That these appointments to the Cabinet shall be undertaken and assigned at the first meeting of the Council for each year, which by statute is on the first Monday of January after its election. That from time to time, at meetings, or otherwise, when matters are presented to the Common Council and affect any of the seven Secretary positions, then the Common Council President shall assign to the Council Secretary for that area, that particular issue and that Common Council Secretary shall be required to report to the entire Common Council at its next meeting what action if any has been taken, the status of the issue and further state, if necessary, a recommended course of action. If the Council Secre- tary fails to act in any of the respects noted above, then the Common Council President is free to reassign that particular issue to whatever Council Member is willing to accept the assignment. That the respective Council Secretary shall hold and chair public hearings from time to time as deemed necessary by the Council Secretary to gather pertinent data to assist in the most advantageous direction for the City of Jeffersonville if it is inclined to pursue a related matter; That after these public hearings have been held, the data gathered shall be prepared in a "Fact Finding Report" form by the the Council Secretary. The Council Secretary shall then present the report along with a written recommendation plan to the Mayor of the city of Jeffersonville for his review and recommendation; That the Mayor of the city of Jeffersonville upon receiving the "Fact Finding Report" shall have ten (10) days to respond in writing to the report indicating whether he approves of the recommendation, dissaproves of it, or has an alternative plan. If the Mayor fails to act upon the reported findings within the ten (10) days, then the chairing Council Secretary shall next present the full report along with his or her written recommendation plan to the full Common Council of the City of Jeffersonville for their review, consideration and action. When the issue involved is characterized by the Council Secretary as requiring "substantial action", the Mayor may request additional time from the Council Secretary to respond to the report and for those times he shall be granted by the Council Secretary at least a ten (10) day but no more than a thirty (30) day extension. That to provide for a more effective operation of government and to keep the elected officials updated as to the condition of the City, at least one time per year the Mayor and/or the President of the Common Council shall publicly give an address to be known as "The State of the City" address which sets forth the state of affairs of the city, including its financial condition and what projects, if any, said elected official intends to pursue in the upcoming year for the city of Jeffersonville. That this Ordinance was created to help facilitate the effective operation of the city of Jeffersonville and is not intended to supersede or circumvent any authority granted by legislative or administrative branches. BE IT FURTHER ORDAINED that the Clerk-Treasurer of the city of Jeffersonville, Indiana is hereby ordered and directed to give notice of this proposed ordinance as provided by law.
