City Council Chambers
The Common Council of the City of Jeffersonville met in a workshop on Monday March 3, 2014. Council
President Julius called the workshop to order at 6:02pm and on the roll call members present were:
Councilpersons Mike Smith, Lisa Gill, Nathan Samuel, Ed Zastawny, Bryan Glover, Matt Owen, and Zach
Payne.
Guests include: Len Ashack, Dale Orem, Scott Lewis and Vicki Conlin
Consent Decree
The Council met in a workshop to discuss the Consent Decree and sewer projects with WWTP Director
Len Ashack.
Mr. Ashack stated that the Consent Decree became effective November 24, 2009. Mr. Ashack outlined
for the Council all the requirements of the Decree and stated that it includes all documents as a result of
the City entering into this agreement with the EPA. Mr. Ashack discussed the various Consent Decree
Requirements. One requirement was to revise the CSO Operation Plan (CSOOP) and implementation of
the revised, approved CSOOP. Mr. Ashack stated that they did submit this in 2010 to the Federal
government but never received a comment back from them and they are supposed to approve it before
the City can implement it.
Mr. Ashack outlined for the Council all the penalties that were stipulated by the Decree and stated that
he knows of only one minor D.O. violation and doubts that this will result in a fine. Mr. Ashack stated
that the sanitary sewer discharge is the one thing that they have had the most trouble with. Mr. Ashack
said they haven't had dry weather CSO discharges, but Indiana American Water flushes their hydrants
into the combined sewer system which goes into the sewer system and then the river. They have had
discussions with them about how best to control their flushing's. Indiana American Water has to flush
their system in order to keep in compliance with the Safe Drinking Water Act. Councilperson Glover
asked if we are complying or have complied with the stipulated penalties to the best of our ability to -
date and Mr. Ashack stated yes, with the exception of the River Port II SSO and explained that they have
just finished a project that will take care of all of that.
Mr. Ashack outlined for the Council the Consent Decree compliance status. Mr. Ashack noted that the
Capacity, Management, Operation & Maintenance (CMOM) Program was completed and submitted to
EPA on July 12, 2012, the Long -Term Control Plan was submitted April 1, 2010, and approved on April
15, 2011. Mr. Ashack explained that they have until 2025 to comply with the LTCP and when EPA
approved the LTCP, it became part of the Consent Decree.
Mr. Ashack explained that in the Consent Decree there are three tables that outline what they needed
to do in order to comply with the LTCP. Phase 2 Projects, as estimated in the LTCP, were 29.5 million
dollars and so far we have spent 27.35 million dollars. Mr. Ashack stated that the Phase 2 Projects are
really the heart of the LTCP. There were basically two projects — 1) the interceptor to catch the CSO

(combined sewage) and 2) the storm water conveyance system which were estimated at a cost of 77.2
million dollars.
Councilperson Samuel thanked Mr. Ashack for taking his time to present the information to the Council.
Councilperson Samuel made the motion to ADJOURNED, seconded by Councilperson Zastawny passing
on a vote of 9-0. Meeting adjourned at 6:55 PM
