WHEREAS, the Common Council of the City of Jeffersonville believes that it is in the best interest of the taxpayers of the City of Jeffersonville to repeal Ordinance No. 2000 - OR- 4, an Ordinance Establishing a Sanitary Board. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Jeffersonville, Indiana, that Ordinance No. 2000-OR -4 is hereby repealed. Galligan, Mayor 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 STATE OF INDIANA BEFORE THE JEFFERSONVILLE COMMON COUNCIL ORDINANCE NO. 00-OR-4 AN ORDINANCE ESTABLISHING SANITARY BOARD WHEREAS, Indiana law~ authorizes the Common Council of the City of Jeffersonville to adopt an ordinance whereby transferring from the municipal works board to a Sanitary Board the supervision and control of the construction, acquisition, improvement, operation, and maintenance of sewage works. WHEREAS, the Common Council of the City of Jeffersonville desires to exercise its statutory authority to establish a Sanitary Board to perform those duties and responsibilities as allowed under Indiana law. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Jeffersonvitle, that a Sanitary Board is hereby established. IT IS FURTHER ORDAINED that the Sanitary Board shall supervise and control any and all construction, acquisition, improvement, operation, and maintenance of sewage works under the present and future jurisdiction of the City of Jeffersonville. IT IS FURTHER ORDAINED that the Sanitary Board shall consist of the following: 1) the Mayor; 2) one (1) person appointed by the Common Council of the City of Jeffersonville; and 3) one (1) person, who must be a registered professional engineer, jointly chosen by the Mayor and the Council appointee. The engineer shall not have the right to serve on the Sanitary Board without the ratification and confirmation of the Common Council of the Jeffersonville. In the event, that the Mayor and the non-engineer appointee are unable to agree on a suitable engineer within thirty (30) days of the effective date of the Sanitary Board or the expiration of the engineer's tem~ then the Common Council of the City of Jeffersonville shall have the sole authority to unilaterally appoint the engineer. IT IS FURTHER ORDAINED that in consideration for the Mayor having a greater role in the selection of the engineer to the Sanitary Board than required under Indiana law the Jeffersonvilte Board of Public Works shall upon the passage of this ordinance consists of the following: 1) the Mayor; 2) one (1) member of the Common Council of the City of Jeffersonville chosen by the Council subject to the ratification and confirmation of the Mayor; and 3) one (1) member appointed by the Mayor. The Council member shall serve for a term of one (1) year. IT IS FURTHER ORDAINED that the original engineer appointee to the Sanitary Board shall serve for a term of two (2) years, and the non-engineer appointee serves for a term of three (3) ~Currently I.C. 36-9-23-3 (as amended) 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 years. IT IS FURTHER ORDAINED that when the term of a member of the Sanitary Board expires, a successor shall be appointed for a term of three (3) years consistent with the aforementioned procedures. IT IS FURTHER ORDAINED that the Mayor shall serve as chairman of the Sanitary Board. IT IS FURTHER ORDAINED that the Sanitary Board shall select a vice chairman from its members, and shall select a Secretary-Treasurer, who need not be a member of the board. The officers selected serve at the pleasure of the board. IT IS FURTHER ORDAINED that the Common Council of the City of Jeffersonville may compensate each member of the Sanitary Board in an amount not to exceed $1,000.00 per month as a salary or as payment for meetings attended provided that said compensation is fixed by the Mayor upon the approval of the Common Council. Each member of the Sanitary Board is also entitled to payment for reasonable expenses incurred in the performance of his or her duties. The aforementioned compensation and expenses may be adjusted annually by the Common Council. IT IS FURTHER ORDAINED that the Common Council of the City of Jeffersonville may also compensate the Secretary-Treasurer of the Sanitary Board provided that said compensation is fixed by the Mayor upon the approval of the Common Council. IT IS FURTHER ORDAINED that the Common Council of the City of Jeffersonville shall fix the bond required of each member of the Sanitary Board and of the Treasurer of the board. These bonds shall be filed with the county recorder under I.C. 5-4-1-5.1. IT IS FURTHER ORDAINED that the Sanitary Board shall provide the Common Council of the City of Jeffersonville with written reports and updates as to the status of the sewage works at each regularly scheduled council meeting and more frequent if so requested by the Council. IT IS FURTHER ORDAINED that the Sanitary Board may establish rules, and by-laws:. ' necessary for its own government. IT IS FURTHER ORDAINED that the Sanitary Board shall become effective upon July 1, 2000. This ordinance shall be in full force and effect upon its adoption. SO ORDAINED on this __ day of ,2000.
