HomeMy WebLinkAbout2000-OR-47ORDINANCE NO. 2000-OR- ~v~ An Ordinance Repealing and Replacing Ordinance No. 97-OR-46 (Replacing Ordinance NO. 93-OR-66) Establishing Retiree's Health Insurance Benefits For City Employees. WHEREAS, the City of Jeffersonville ('~the City") presently offers its full time employees healthcare insurance benefits during their employment with the City; and WHEREAS, in Ordinance No. 97-OR-46, the Common Council of the City of Jeffersonville ("the Council") previously established retirees' health insurance benefits for City employees pursuant to the provisions of I.C. 5-10-8 et seq.; and WHEREAS, the Council now wishes to update the provisions of the City Ordinance establishing its retirees health insurance benefits; NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Jeffersonville that the provisions of Ordinance 97-OR-46 are hereby repealed and replaced, effective September 1, 2000, with the following: SECTION 1: Definitions 1.1 Ci.ty shall mean the incorporated City of Jeffersonville, Indiana. 1.2 Retired Ci~, Employee shall mean an employee who: · Leaves employment with the City at~er June 30, 1986; and · Has completed twenty (20) years full time employment with a public employer (as defined in I.C. 5-10-8-1), ten (10) years of which are completed immediately proceeding the retirement date; and · Has reached the age of fffiy-five (55) years on or before the retirement date for Medicare coverage; and · Files a written request with the p~rsonnel department requesting retiree insurance benefits within ninety (90) days after the retirement date or the enactment of this ordinance. 1.3 Ci~. Insurance shall mean individual or family group medical insurance benefits made available by the City to all full-time City employees. 1.4 Surviving Spouse shall mean a Retired City Employee's spouse who has paid the amount the Retired City Employee would have been required to pay for City Insurance Coverage; and · Is not eligible for Medicare; and · Has not survived his/her City Employee spouse for more that 2 years; and · Has not remarried. SECTION 2: Benefits 2.1 Until a Retired City Employee or Surviving Spouse is eligible for Medicare coverage the City shall pay Sixty percent (60%) of the Retired City Employee's or Surviving Spouse's City Insurance premium if the Retired City Employee or Surviving Spouse elects family coverage benefits. If the Retired City Employee or Surviving Spouse elects single coverage benefits, the City shall pay sixty-seven percent (67%) of the City Insurance Premium. When a Retired City Employee or Surviving Spouse becomes eligible for Medicare coverage, the Retired City Employee or Surviving Spouse's eligibility for participation in the City Insurance shall automatically terminate. 2.2 The Retired City Employee or Surviving Spouse shall be responsible for payment of any balance of his / her monthly City Insurance premiurm The City Insurance premium shall be established by the Personnel Department each year within thirty (30) days of the renewal of the City Insurance. SECTION 3: Payments 3.1 If a retired City Employee or Surviving Spouse receives retirement benefits directly fi:om the City, the Retired City Employee or Surviving Spouse's portion of the monthly City Insurance Premium may be deducted fi:om the Retired City Employee' s or Surviving Spouse's retirement benefit check by payroll deduction. 3.2 If a Retired City Employee or Surviving Spouse receives benefits under the Public Employment Retirement Fund (PERF) or any other public retirement fund, it shall be the duty of the Retired City Employee or Surviving Spouse to forward his/her portion of the monthly City Insurance premium directly to the Clerk Treasurer of the City of Jeffersonville on or before the first (1~) day of each month. 3.3 If a Retired City Employee or Surviving Souse fails to deliver to the Clerk Treasurer the Retired City Employee or Surviving Spouse's portion of the monthly City Insurance premium on or before the 1a day of every month, the City may terminate the Retired City Employee's or Surviving Spouse's City Insurance coverage after notice and a hearing before the Board of Public Works and Safety ("The Board"). In cases of hardship or upon good cause shown, the Board, at it's sole discretion, may allow a Retired City Employee or Surviving Spouse to continue receiving City Insurance coverage if the Retired City Employee or Surviving Spouse makes the delinquent payment in the manner required by the Board. This Ordinance shall be in full force and effect from and after its passage and approval. SECTION II - BENEFITS During the lifetime of a retired City employee, the former employee shall be eligible to receive up to Two Hundred Dollars ($200.00) per month, payable by the City for benefit of the retired City employee, to only be applied to said employee's City insurance premium. However, if a retired City employee opts to receive individual coverage, rather than family coverage, the Employee shall be eligible to receive a maximum benefit of only One hundred Dollars ($100.00) per month. The employee shall be responsible for payment of any balance of the monthly City insurance premium. A retired City employee who receives benefits under this ordinance shall be required to disclose the availability of health insurance benefits to the employee of the employee'.,; spouse. Failure of the retired City employee to disclose this information and to allow the City to verify this info~nation shall make the retired City employee ineligible to receive benefits under this ordinance. A retired City employee who does not receive City insurance shall not be entitled to receive any other benefits under this ordinance. SECTION III - PAYMENTS If a retired City employee receives retirement benefits directly from the City, the balance of any premium due for City insurance, over and above the portion paid pursuant to Section II above, may be deducted from the employee's retirement benefit check by payroll deduction. If a retired City employee receives benefits under the Indiana Public Employee's Retirement Fund (PERF) or any other public retirement fund, it shall be the duty of the employee to forward the balance of monthly premiums over and above the portion paid pursuant to Section II above, directly to the Clerk-Treasurer of the City of Jeffersonville on or before the 1 st day of each month. 2 If a retired City employee fails deliver to the Clerk-Treasurer of the City the uncovered balance of an City insurance premium when due (the 1st day of the month), the City shall cease providing City insurance to the retired employee. However, in cases of hardship or upon good cause shown, the Board of Public Works and Safety, at its sole discretion and after a heating, may allow a retired City employee to continue in the City insurance program if the retired City employee makes the delinquent payment as permitted, but not more than 30 days past due. SECTION IV - EFFECTIVE DATE This Ordinance shall be in full force and effect upon the 1st day of the month after its timely passage, promulgation and approval by the Mayor. PARKER,/JR.,'MAYOR 3 ORDINANCE #93-OR- &b AN ORDINANCE ESTABLISHING RETIREE'S HEALTH INSURANCE BENEFITS FOR CITY EMPLOYEES WHEREAS, the City of Jeffersonville presently offers its full-time employees health care insurance benefits during their employment with the City of Jeffersonville; and WHEREAS, in order to benefit long-term employees of the City of Jeffersonville and provide an incentive for early retirement of some City employees the Common Council of the City of Jeffersonville desires to extend health care insurance benefits to retired city employees pursuant to I.C. 5-10-8 et seq.; NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Jeffersonville, State of Indiana, as follows: SECTION I - DEFINITIONS 1. City shall mean the incorporated City of Jeffersonville, Indiana. 2. Retired City Employee shall mean a City employee who: (a) has been a full-time employee of the City for a total of at least twenty (20) years; (b) leaves employment with the City after June 30, 1986; (c) has not yet attained the age of sixty-five (65) years or is not qualified to receive Medicare benefits, Medicaid benefits; (d) is otherwise not eligible, him/herself or through her/his spouse, to receive health insurance coverage which is comparable (but not identical) to City insurance for a monetary contribution which is comparable (but not identical) to City insurance benefits; (e) has continuously participated in any City sponsored health insurance program for at least two (2) years immediately prior to the time the employee leaves City employment (or application for City insurance, if already retired); 3) City Insurance shall mean individual or family group medical insurance benefits made available by the City to all full-time City employees. 4) Surviving Spouse shall mean a Retired City Employee's spouse who haS paid the amount the Retired City Employee would have been required to pay for City Insurance coverage and: a) is not eligible for Medicare; and b) has not survived his/her City Employee spouse for more than 2 years; and c) has not remarried. SECTION II - BENEFITS Until a Retired City Employee or Surviving Spouse is eligible for Medicare coverage, the City shall pay Fifty-one percent (51%) of the Retired City Employee's or Surviving Spouse's City Insurance premium if the Retired City Employee or Surviving Spouse elects family coverage benefits.
