HomeMy WebLinkAbout2000-OR-38ORDINANCE NO. 2000-OR- ~2 AN ORDINANCE ANNEXING CONTIGUOUS TERRITORY BY VOLUNTARY PETITION WHEREAS, the The Armstrong Family Trust, by Harold W. Armstrong, Trustee, the owner of a 40 acre parcel of land (hereinafter "the Parcel") located outside of but contiguous to the City of Jeffersonville (hereinafter "the City") has filed a petition requesting annexation of the Pamel (the "Petition"), which Petition is attached hereto as Exhibit A and incorporated herein by reference; and WHEREAS, the Petition was set for public hearing on July 17, 2000 at the regularly scheduled meeting of the Jeffersonville Common Council (the "Council"); and WHEREAS, on June 22, 2000, The Armstrong Family Trust, by Harold W. Armstrong, Trustee was provided ~witten notice of the public hearing of this Voluntary annexation; and WHEREAS, notice of the public hearing on the Petition was published in the Evening .News on June 24, 2000; and WHEREAS, after holding a public hearing at its regularly scheduled meeting of July 17, 2000, the Council finds: 1. The Parcel is contiguous to the City as required by lC 36-4-3-1.5 except that at least ~A, instead of 1/8 of the aggregate external boundaries of the Parcel coincide with the City's boundaries; 2. The Parcel is needed and can be used by the City for its development in the reasonably near future. 3.. The City has developed and adopted a written fiscal plan as memorialized in Resolution 2000-R- ; and WHEREAS, the Council believes it is in the best interests of the City that the Petition be granted and the Parcel be annexed into the City; NOW, THEREFORE, BE IT HEREBY ORDAINED that, pursuant to the provisions of Indiana Code 36-4-3-5, the Parcel is hereby annexed into the City as a portion of the Fourth Municipal Legislative District; and IT IS HEREBY FURTHER ORDAINED that pursuant to the provisions of Indiana Code 36-4-3-22, the Clerk-Treasurer of the City of Jeffersonville is hereby ordered to immediately: 1. File this annexation ordinance with the Clark County Auditor, the Clark Circuit Court Clerk, and the employee of the State Board of Tax Commissioners currently designated by the Governor as the state certifying official for the Boundary and Annexation Survey of the United States Bureau of the Census pursuant to the provisions of Indiana Code 6-1.1-30-15, and 2. Record a copy of this annexation ordinance in the office of the Clark Count)' Recorder. This Ordinance shall be in full force and effect from and after its passage and approval. Thence sourhwestwardly 502 feet, more or less, along said City's boundary and the dividing line of Surveys No. 21 and 34 to the south comer of said Armstrong tract; Thence northwardty 1,372 feet, more or less, continuing along said City's boundary, which is also Armstrong's southwesterly line to the northwesterly right-of-way line of the CSX Railroad, which is also southeasterly line of the Meadows Subdivision, and the boundary of the City of Jeffersonville. Thence northeastwardly 1,207 feet, more or less, continuing along said City's boundary and the Railroad right-of-way to the dividing line of Surveys No. 34 and No. 35; Thence southeasterly 1,653 feet, more or less, leaving said City's boundary along the line dividing Surveys No. 34 and 35 to the northwesterly line of Survey No. 22 and said City's boundary; Thence southwestwardly 660 feet, more or less, along the boundary of the City of Jeffersonville, which is the line dividing Surveys No. 22 and 34 to the north corner of Survey No. 21 and said City's boundary to the True Place of Beginning and containing 40 acres, more or less, of land.
