HomeMy WebLinkAbout2000-OR-28ORDINANCE NO. 2000-OR- ~ AN ORDINANCE AMENDING ORDINANCE NO. 90-OR-9 ESTABLISHING A SPAY-NEUTER PROGRAM FOR ANIMALS ADOPTED FROM THE JOSEPHINE B. OGLE ANIMAL SHELTER WHEREAS, in 1990 the Common Council of the City of Jeffersonville (the "Council") adopted an ordinance establishing a spay-neuter program for animals adopted from the Jeffersonville-Clark County Animal Shelter (the "Shelter"); and WHEREAS, often owners of animals adopted from the Shelter fail to have the spay/neuter procedure performed after they adopt the animal even though they have paid the necessary fee for the spay/neuter procedure and received a voucher; and WHEREAS, the Council wishes to adopt leg/slation that will decrease the number of unwanted animals the Shelter must deal with; and WHEREAS, the Council believes that spaying or neutering animals before new owners are allowed to take possession of animals adopted from the Shelter will reduce the population of unwanted animals over the course of time; and WHEREAS, the City of Jeffersonville wishes to hire a Shelter Veterinarian capable of performing all spay/neuter procedures on site at the Shelter prior to allowing new owners to take possession of animals adopted from the Shelter and wishes to pay the Shelter Veterinarian a portion of her/his salary from the nonreverting fund into which the fees provided by Ordinance No. 90-OR-9 are deposked; NOW, THEREFORE, BE IT ORDAINED that Ordinance No. 90-OR-9 adopting a spay/neuter program for the Shelter is hereby amended to read as follows: 1. All persons wishing to adopt an animal at the Josephine B. Ogle Animal Shelter (the "Shelter")?nust pay, along with their regular adoption fees, the cost of having the animal Spayed or neutered. 2. The Shelter Director is hereby ordered to obtain ar least annually from all licensed veterinarians in Jeffersonville Township quotes for fees those veterinarians charge the general public spay and neuter fees. The Shelter spay/neuter fee must be equal to the lowest and best quote from a responsible and responsive quoter. 3. If the animal to be adopted is of sufficient age and health to be spayed or neutered at the time of the adoption, the animal must be spayed or neutered prior to being released to the new owner, but after the new owner has paid the adoption fees and the spay/neuter fee. The new owner may take physical possession of the animal upon the Shelter Veterinarian's certification that the animal is sufficiently recovered from the spay/neuter procedure. If the animal is not sufficiently recovered within ten (10) days following the spay/neuter procedure, the new owner may, at his/her option revoke the adopdon and receive a refund of the adoption fee and the spay/neuter fee. If the animal to be adopted is not of sufficient age and health to be spayed or neutered at the time of the adoption, the Shelter will issue a voucher to the new owner of the animal requiring the spay/neuter procedure to be performed by the Shelter Veterinarian at the Shelter prior to an expiration date established by the Shelter Veterinarian. Subject to prior written approval by the Shelter Director, the new oxvner may refuse the spay/neuter procedure, however the ne~v owner must pay the spay/neuter fee unless the adopted animal has already been spayed or neutered. The Shelter must deposit all monies collected for the spay/neuter program with the Clerk-Treasurer of the City of Jeffersonville, for deposit in the Spay/Neuter Program Nonreverfing Fund created herein. A special non-reverting operating fund is hereby established for the purpose of receiving and holding fees charged by the Shelter for the spay/neuter program. This fund shall be entitled "Animal Shelter Spay/Neuter Non-Reverting Fund" and monies may be expended from this fund only upon the filing of a proper claim in issuance of a warrant for payment by the Clerk-Treasurer. Hereafter the Clerk-Treasurer may not deposit monies the Shelter receives as spay/neuter fees into the City's General Fund, but must deposit those fees into this non-reverting fund. 8. The Shelter is hereby required to use the Animal Shelter Spay/Neuter Non- Reverting Fund to the extent and in the manner allowed by law. This ordinance is in fttU force and effect upon its passage, promulgation and approval by the Mayor. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Jeffersonville that it hereby adopts a spay/neuter program for the Jeffersonville-Clark County Animal Shelcer on the following terms: 1. That all persons wishing to adopt an animal at the Jeffersonville-Clark County Animal Shelter must pay the cost of having an animal spayed or neutered with their adoption fees. 2. The Jeffersonville-Clark County Animal Shelter Director is hereby ordered to at least semiannually obtain quotes for spay and neuter fees from all licensed veterinarians in Jeffersonville Township, and the fees charged the general public as a part of the adoption fee for the sp~y/neuter charge shall be an amount equal to the quote which is deemed the lowest and best quote by the Jeffersonville-ctark County Animal Shelter Director. 3. That in the event that the animal is of sufficient age and health to be spayed or neutered at the time of the adoption, a voucher will be issued to the new owner of the animal with an expiration date of ten (10) days following the adoption in order to have the necessary spay/neuter procedure performed at the office of the licensed veterinarian in Jeffersonville Township chosen at the discretion of the Jeffersonville-Clark County AnimaLShelter Director. 4. In the event that the animal is not of sufficient age or health to undergo the spay/neuter procedure at the time it is adopted, the Jeffersonville-Clark County Animal Shelter Director shall at,his/her discretion establish an expiration date on the voucher given to the new owner in which time the procedure must be performed. 5. In the event that the new owner desires not to have the adopted animal altered they may assume that responsibility themselves, subject to prior written approval by the Animal Shelter Director, however, the fee for the procedure as established herein shall not be waived in any case unless the adopted animal has already undergone the spay/neuter procedure. The Jeffersonville-Clark County Animal Shelter shall deposit all monies collected for the spay/neuter program with the Clerk-Treasurer of the City of Jeffersonville, and thereafter shall process all claims from the selected veterinarians performing the procedures in the proper course of business upon receipt of the bill and elaim from said veterinarians. This Ordinance shall be in full force and effect upon its timely passage, promulgation and approval by the Mayor and publication in accordance with the law.
