AN ORDINANCE ESTABLISHING A NON-REVERTING FUND
FOR THE JEFFERSONVILLE CITY COURT
WHEREAS, the Jeffersonville City Court (the "Court") is organized under the
provisions oflC 33-10.1-1 et seq. and the Jeffersonville Municipal Code; and
WHEREAS, the Court has implemented a local program for Alcohol Education
including fees to be paid by offenders for the Alcohol Education Program; and
WHEREAS, to enhance the Jeffersonville City Court Probation Department's
ability to monitor probationers, including requiring them to attend various education
programs, the Jeffersonville City Court Probation Department needs additional staff,
supplies and equipment; and
WHEREAS, the Alcohol Education Program fees collected by the Court would
be a non-tax source of income to help fund the Jeffersonville City Court Probation
Department expenses;
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City
of Jeffersonville, Indiana that it hereby establishes a non-reverting fund for the purpose of
receiving and holding fees paid by offenders for the Jeffersonville City Court Alcohol
Education Program. The non-reverting fund will be used for the purpose of
supplementing the Jeffersonville City Court Probation Department's budget for salaries,
supplies and equipment. This fund shall be entitled the "Jeffersonville City Court Non-
Reverting Fund" and monies shall be expended from this fund only upon the filing of a
proper claim in issuance of a warrant for payment by the Clerk-Treasurer after approval
by the Common Council of the City of Jeffersonville. This fund shall be a non-reverting
fund and all monies received as revenues from fees for the Alcohol Education Program
collected by the Jeffersonville City Court shall hereafter not be required to be received
into the general fund of the City, but shall be deposited into this non-reverting fund.
This Ordinance shall be in full force and effect from and after its passage and
approval.
