AN ORDINANCE AMENDING ~ 96.06 OF THE JEFFERSONVILLE
MUNICIPAL CODE
BE IT ORDAINED BY THE COMMON COUNCIL OF JEFFERSONVILLE,
INDIANA:
WHEREAS, Secdon 96.06 of the Jeffersonville Municipal Code provides for
A City Sidexvalk Replacement program; and
WHEREAS, the Sidexvalk Replacement Program is partially funded through
tax dollars and partially funded by individual contributions; and
WHEREAS, 996.06 of the Jeffersonville Municipal Code is in need of some
technical amendments to alloxv smoother operation of the Sidewalk Replacement
Program.
NOW THEREFORE, IT IS HEREBY ORDAINED that Section 96.06 of
the Jeffersonville Municipal Code is hereby amended to read as follows:
[96.06 FUNDS FOR SIDEWALK IMPROVEMENT.
(A) There is hereby created a nonreverfing fund in the~gU~2~.~ v-'5 P-L~ ':737L:
reva~lffe~et entitled Sidewalk Renovation Nonreverting Fund. The
Cit'3, Council may appropriate tax funds for expen~tirure from the Sidewalk
Renovation fund. 3,
(13) The City Engineer and ~ ,th~W~ii~mr shall prioritize applications for
side~valk improvement projects eligible to receive matching funds from the
Sidewalk Renovation Nonreverting Fund, considering public safety and
present side~valk conditions as criteria, and giving preference to residential
property owners.
(C) The City Engineer ~vill develop application forms and development
standards for side~valk improvements.
(D) The City Engineer wilt periodically advertise that the CiU' is accepting
applications from property owners ~vho xvish to participate in the sidexvalk
improvement program.

necessaos', for the efficient, ' 's~adon o ' - -im rovement
program th~ado~n Nonr?er,,dn~ Fund.
(F) With ~e approval of the City En~neer and the~, renovated
sidexvalks may be narroxved or rerouted to avoid des~cdon of existing
trees. In ad~fion, ~e Ci~ En~neer may require renovated sidewalks to
match any adjoi~ng sidew~ks.
Approved sidewalk improvement projects xvill be funded from the
Sidexvalk Nonreverting Fund on a 50/50 basis xvith the property owner
providing 50% of the necessary funds and the City prm4ding 50% of the
necessary funds.
(H) The property oxvner must deposit xvith the Clerk-Treasurer 50% of the
approved sidewalk project's estimated cost prior to beginning construction.
The Clerk-Treasurer must hold the property owner's deposit in escrow
pending completion of the project.
(I) The~ must approve the contractor proposed to perform the
approved sidewalk project as the lowest responsible and responsive bidder
for the project, or a group of approved projects.
0) At the property oxvner's request and after payment of the cost to the Clerk-
Treasurer to be deposited into the Side~valk Renovation Nonreverdng
Fund, the City will tear out and haul axvay the existing sidexvalk at a cost of
$2.50 per lineal foot. Alternatively, the property o~vner may tear out and
haul a~vay the existing sidexvalk at his/her own expense.
(K) After completion of the sidewalk renovation project and the City
Engineer's inspection and acceptance of the construction, the fin,'d cost of
the project xvill be forwarded to the Clerk-Treasurer. If the project cost is:
in excess of the estimate, the property owner must remit to the Clerk-
Treasurer 50% of the excess cost ~vithin 15 days of receiving xvritten notice
of the excess. If the property oxvner fails to timely remit the excess, the
City Engineer may file a lien against the property as provided for in IC 36-
1-6-2. If the project is completed at a cost less than the estimate, the Clerk-
Treasurer x411 prompdy remit 50% of the savings to the property oxvner.
After completion of the project and refund of any savings to the properts'
o~vner, the Clerk-Treasurer must deposit the propert7 owner's share of the
project cost into the Sidexvalk Renovation Nonreverdng Fund.
This Ordinance shall be in full force and effect from and after its passage and
approval.
