COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
NOVEMBER 9, 2000
The Common Council of the City of Jeffersonville, Indiana met in special session
in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana,
at 7:00 P.M. on the 9th day of November 2000
The meeting was called to order by Mayor Thomas R. Galligan, with Clerk and
Treasurer Peggy Wilder at the desk. Also present were City Attorney Anne Marie
Galligan, Council Attorney Shon Leverett, and Deputy Clerk Barbara Hollis. Mayor
Galligan welcomed all in attendance, asking all those present to stand as Councilperson
Grooms gave the invocation. Mayor Galligan then asked all those present to join him in
the pledge of allegiance to the flag.
The roll was called and those present were; Councilpersons Ron Ellis, Les
Merkley, Denny Frantz, Rob Waiz, Ron Grooms, and Vicki Conlin.
Absent: Coancilperson Barbara Wilson.
There were no minutes presented.
There were no claims presented.
City Attorney Anne Made Galligan stated the purpose of the meeting is to
consider Ordinance No. 2000-OR-46, An Ordinance For Annexation Of Area 7 Territory.
This Ordinance was passed on the first reading previously. Attorney Galligan gave a
general explanation of the area. A public hearing was held previously. This meeting has
also been set for a public hearing. The meeting was opened to comments.
Mr. Gordon Ingle, Attorney representing several residents in the affected area,
stated he believes the issue is "dead on arrival". Attorney Ingle said the law is clear,
referring to Indiana Code 36-4-3-13. He said the City does not meet one of the three
requirements from this section of the code. He also stated the City does not meet
contiguity requirements. Attorney Ingle assures the City a remonstrance will be filed.
He also has several problems ~vith the fiscal plan. Attorney Ingle said it stretches the
imagination that the City will not spend more on police and fire as the annexation almost
doubles the size of Jeffersonville. He questions that insurance rates will decrease and he

also has a problem with there being no definite answer to the cost of installing the sewer
lines. Attorney Ingle asks the Council to vote down the ordinance.
There being no further comments, Councilperson Conlin made the motion to pass
Ordinance No. 2000-OR-46 on the second and third readings, seconded by Councilperson
Merkley. Mayor Galligan asked for additional comments. There being no comments, the
motion passed on a vote of 5-0-1. Council President Ellis abstained.
There being no further business to come before the Council, Councilperson
Merkley made the motion to adjourn at 7:25 P.M., seconded by Councilperson Conlin,
passing unanimously.
