COMMON COUNCIL OF THE CITY OF
JEFFERSONVILLE, INDIANA
SEPTEMBER 18, 2000
The Common Council of the City of Jeffersonville met in regular session in the Multi-
Purpose Meeting Room in the City County Building, Jeffersonville, Indiana at 7:00
p.m on the i8th day of September, 2000.
The meeting was called to order by Council President Ron Ellis, with Deputy Clerk's
Lynne Mayfield and Sharon Wilder at the desk. Mayor Galtigan and Clerk Treasurer
Wilder were absent.
Council President Ellis asked all those present to stand as Council President Ellis gave
the invocation. Council President Ellis asked all those present to join him in the pledge
of allegiance to the flag.
The roll was called and those present were Councilpersons Les Merkley, Ron Ellis,
Denny Frantz, Rob Waiz, Barbara Wilson, and Ron Grooms.
Absent: Vicki Conlin Council Attorney Shon Leverett was in attendance.
There were no minutes for approval.
Councilperson Merkley made the motion to approve the agenda, seconded by
Councilperson Frantz and carded unanimously.
Councilperson Merkley questioned the Animal Shelter Spay/Neuter claims. He said he
was under the impression that the new Animal Shelter Director who is a veterinarian,
would be doing the spay/neutering. He will seek an answer from the Mayor.
Councilperson Merldey said he has a problem with a claim to Oakes Flag Co. to be paid
out of the Council budget for $1,456.00 for flags and setups. He said he wasn't aware we
had a new city flag until he saw the front page of the Evening News and the ceremony
regarding the flag that the Council was not invited to as far as he knows. Merkley said he
has a real problem with the Council not being notified about something beforehand that is
then wanted to come out of the Council's promotion budget. He said the Mayor should
take it out of his budget if he wants new flags or he should consult the Council.
Councilperson Merkley made the motion to delete the claim to Oakes Flag Co. from the
Council budget, seconded by Councilperson Waiz and carried unanimously.
Councilperson Ellis made a statement that a number of times the Council has had to
approve claims for money spent out of the Council budget that no one has given prior
approval for. He said he hopes the members of the Council will start being proactive on
this situation and any money that is spent in the Council budget without having some
approval from someone on the Council be omitted or removed from being paid from the
Council budget. Councilperson Ellis also said that a claim was approved last month for
supplie~ for the Clerk-Treasurer's office. He said the supplies were probably needed but
someone on the Council should have been asked about those supplies before it was put on
the claim list to be paid from the Council budget.
Councilperson Wilson asked Clerk Lynne Mayfield how much of the claim to Oakes
Flag Co. was to be paid by the Fire Department: Clerk Mayfield responded that $300.00
was to be paid from the Fire Dept. budget.
Ordinance No. 2000-O11-52 - An ordinance authorizing the city of Jeffersonville Indiana
to issue it's "City of Jeffersonville, Indiana Multifamily Housing Revenue Bonds
(Armstrong Farms Apartment Project) Series 2000. Councilperson Merkley made the
motion to pass the ordinance on the second and third reading, seconded by Councilperson
Waiz and carried unanimously.
Ordinance No. 2000-OR- 53- An ordinance amending certain portions of section 1 of
Ordinance No.99-OR-49 Sanitary Board Members Salary. Councilperson Merkley made
the motion to pass the Ordinance on the second and third reading, seconded by
Councilperson Wilson, passing on the following roll call vote:
Ayes: Councilpersons Merkley, Grooms, Ellis, and Waiz.
Nays: Councilperson Frantz
Ordinance No. 2000-OR-54- An ordinance transferring certain funds within same
department (Planning and Zoning Budget) .Councilperson Wilson made the motion to
pass the Ordinance on the second and third reading, seconded by Councilperson Merkley,
and can-ied unanimously.
Ordinance No. 2000-OR-55-An ordinance establishing a non-reverting fund to hold
monies to be used at the individual discretion of each council member for project
improvement use. Councilperson Ellis said the Council has discussed this ordinance. It is
designed to put $5,000.00 in the budget for each council member to use for project
improvements in their district. Council Attorney Shon Leverett commented that he is still
checking on one legal consideration, which is the ability of the council to unilaterally
enter into a contract for services without approval by the Board of Public Works and
Safety. There may be some changes before final adoption of this ordinance.
Councilperson Grooms made the motion to pass the Ordinance on the first reading,
seconded by Councilperson Merkley, and carried unanimously.
Councilperson Grooms told Council Attorney Leverett that he doesn't want the wording
in the ordinance to restrict or interfere or confuse the two members of the Council at
Large. He said the word district is used and from a legal point of view he asked Attorney
Leverett that the two Council at Large members be'stated in the wording, as district
should not be applied to them. Council Attorney Leverett said the wording would be
changed to reflect this. Councilperson Grooms also questioned the wording in Paragraph
3. Attorney Leverett said the wording reflects the intent to prevent the funds from being
utilized for any particular individual group that would be based solely on religion,
gender, or race. The intent and purpose of this ordinance is solely for improvement,
renovation, and beautification projects that would touch upon the city's physical
characteristics.
C OIVlMENT S:
Councilperson Merkley said that a neighborhood meeting was held last week by the
Cherry Drive residents. He said 35 to 40 people attended. Mayor Galligan and Planning
and Zoning Director Ecker were in attendance. The Cherry Drive residents are wanting to
start a block watch program such as the one the Rose Hill residents have.
Councilperson Frantz said he was riding down Utica Pike on Sunday night and observed
the fire at the Wathen/Smith house that the McCullough Fire Dept. was working. He said
it was a mess and said that funding for six additional firefighters should be seriously
considered.
Councilperson Wilson said Steamboart Days was better this year but she said a lot more
people are needed to keep it going. She thinks the Mayor and the City Council should
make an effort to see about helping with the funding. She said that year after year the
Council approves abatements for big companies who say they want to be part of the
community but when it comes down to helping the community they aren't there. She said
Steamboat Days either needs to be built back up or forgot about altogether. She asked
that her fellow Councilmembers think about this.
There being no further business to come before the Council, Councilperson Merkley
made the motion to adjourn at 7:40 p.m., seconded by Councitperson Grooms, passing
unanimously.
