HomeMy WebLinkAbout09-11-2000COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA SEPTEMBER 11, 2000 The Common Council of the City of Jeffersonville met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana, at 7:00 P.M. on the 1 lth day of September, 2000. The meeting was called to order by Mayor Thomas R. Galligan, with Clerk and Treasurer Peggy Wilder at the desk. Mayor Galligan welcomed all in attendance, asking all those present to stand as Council President Ron Ellis gave the invocation. Mayor Galligan asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were Councilpersons Les Merkley, Ron Ellis, Denny Frantz, Rob Waiz, Barbara Wilson, Ron Grooms, and Vicki Conlin. Absent: None. Mayor Galligan presented the minutes of the meeting o£August 28, 2000 for consideration by the Council. Councilperson Grooms asked to have the following corrections made; change let to led in the second paragraph of page 1; change flowing to following in paragraph 5, page 1; add pay following longevity in paragraph I of page 2; and change 30,000 and 20,000 to 30,000,000 and 20,000,000 in the same paragraph. Councilperson Wilson made the motion to approve the minutes as corrected, seconded by Councilperson Conlin and carried unanimously. Councilperson Grooms made the motion to approve the workshop minutes of August 28, 2000, seconded by Councilperson Conlin, passing unanimously. Councilperson Merkley asked that the 6~ item on the agenda (Ordinance To Repeal Sanitary Sewer Board) be removed from the agenda, quoting Robert's Rules Of Order. It was also requested the sewer bond ordinance, sewer board claims, Armstrong bond, and additional appropriation be added to the agenda. Council President Ellis made the motion to approve the agenda with the deletion and additions as requested, seconded by Councilperson Grooms, passing unanimously. Clerk and Treasurer Wilder presented the claim list for consideration by the Council. Councilperson Merkley made the motion to approve the claims as presented, seconded by Councilperson Conlirg passing unanimously. September 11, 2000 Page 2 of 6 PUBLIC COMMENT: Mr. William P. Chambers appeared before the Council saying he is disturbed by the method used to collect drainage fees. Mr. Chambers feels this should be a part of the property tax bill. Recently fire protection has been added to the water bill, there is a recycling f~e, and now drainage. He feels this is "buck passing". Mr. Bill Fry asked for additional information regarding the Perrin Lane project. He would like replacement of some of the trees being removed. He has many questions about the project and the time flame. Mayor Galligan explained the drainage and road needs to be improved and the plan is to take trees down next to the road on the left side (going to Utica Pike), put in sidewalks and plant trees. This will be done in sections, taking two years,, three at the most. He is trying to make it as simple as possible. Mr. Fry said there is a need for up fi'ont information and he would like advance detailed information. Mr. James Hollis echoes Mr. Fry's comments, also stating a need for road repair. Mayor Galligan said some patching will be done. Ms. Mary Gowens asked how far down Pen-in Lane will the project be taken. She would like to be properly informed and is also concerned for the time frame. Mayor Galligan explained the first need is to get the utility lines moved and cut down the necessm3r trees. He is trying to solve 3 or 4 problems in one project. Ms. Frances Hunter agrees with the other comments regarding Perrin Lane. Mr. William Kiger also agreed with the Perrin Lane comments. Mayor Galligan asked Eric B. Rowe to approach the front of the room. Mayor Galligan explained Eric is 12 years old and has raised more then $13,000 in five years for Kosair Children's Hospital. Mayor Galliganpresented Eric with the Commodore Of The Port certificate saying thanks as what he does for others is appreciated. Eric will be participating in a walk this Saturday at the Louisville Zoo. Councilperson Conlin said Eric has been named a corporate sponsor and is a great role model. AGENDA ITEMS: City Attorney Galligan introduced Ordinance No. 2000-OR-52, An Ordinance Authorizing The City Of Jeffersonville, Indiana To Issue Its "City Of Jeffersonville, Indiana Multifamily Housing September 11, 2000 Page 3 of 6 Revenue Bonds (Armstrong Farm Apartments Project) Series 2000" And Approving And Authorizing Other Actions In Respect Thereto, announcing this meeting has been advertised as a public hearing. Attorney Galligan asked for any concerned to speak. There being no response Attorney Galligan asked again for public comment. There was no response to the two requests for comments. Councilperson Conlin then made the motion to pass Ordinance No. 2000-OR-52 on the first reading, seconded by Councilperson Waiz, passing unanimously. Mayor Galligan introduced Ordinance No. 2000-OR-40, An Ordinance Fixing A Schedule Of Rates And Charges To Be Collected By The City Of Jeffersonville, Indiana, From Users And Owners Of Property Served By The Storm Water Utility Of Said City, Other Matters Connected Therewith And Amending Ordinances In Conflict Herewith, for the.second reading. Attorney Galligan explained some technical changes need to be made. Councilperson Grooms made the motion to pass Ordinance No. 2000-OR-40 on the second reading, seconded by Councilperson Merkley. Councilperson Grooms expressed several concerns that he feels should be addressed in the Ordinance. Council President Ellis suggests a workshop before the third reading. It was recommended the third reading take place at the October 2, 2000 meeting. Councilperson Merkley asked what has been done to notify the residents. Mayor Galligan answered it has been in the newspaper. The only other way he knows is to send a brochure to every home, and have meetings in the community. Mayor Galligan said the reason he likes a fee is so it is known where the money goes. The motion to pass Ordinance No. 2000-OR-40 passed on the second reading on a vote of 6-0-1. Councilperson Conlin abstained fi.om the vote. Ordinance No. 2000-OR-41, An Ordinance Of The City Of Jeffersonville Authorizing The Issuance Of Sewage Works And Storm Water Revenue Bonds For The Purpose Of Providing Funds To Pay The Cost Of Certain Additions, Extensions And Improvements To The Municipal Sewage Works Of Said City, Providing For The Safeguarding Of The Interests Of The Owners Of Said Bonds, Other Matters Connected Therewith, Including The Issuance Of Notes In Anticipation Of Bonds, And Repealing ordinances Inconsistent Herewith, was introduced. Councilperson Waiz made the motion to pass Ordinance No. 2000-OR-41 on the second reading, seconded by Councilperson Merkley. Councilperson Grooms made the motion to add City Sanitary Board on page 33 (b), seconded by Council President Ellis passing on a vote of 5-1-1. Councilperson Frantz voted against September 11, 2000 Page 4 of 6 the amendment and Councilperson Conlin abstained. The motion to pass Ordinance No. 2000-OR-41 on the second reading passed on a vote of 6-0-1. Councilperson Conlin abstained. Councilperson Merkley made the motion to override Mayor Galligan's veto of Ordinance No. 2000-OR-43, An Ordinance Amending Certain Portions Of Section 1 Of Ordinance No. 99-OR-49 (Sewage Department), seconded by Council President Ellis~ Mayor Galligan recommends $1,000 a month. The motion failed on the following roll call vote: Ayes: Councilpersons Grooms, Wilson, Ellis, and Merkley. Nays: Councilpersons Conlin, Waiz, Frantz. Ordinance No.2000-OR-53, An Ordinance Amending Certain Portions Of Section 1 Of Ordinance No. 99-OR-49 (Sewage Department) was introduced. Councilperson Merkley made the motion to pass Ordinance No. 2000-OR-53 on the first reading seconded by Councilperson Grooms, passing on the following roll call vote: Ayes: Councilpersons Merkley, Ellis, Wilson, Waiz, and Grooms. Nays: Councilpersons Frantz and Confin. Ordinance No. 2000-OR-51, Ordinance Of Appropriations And Tax Rates was presented. Clerk Treasurer Wilder asked for comments on the proposed tax rate as t?ds is the final hearing and reading. Councilperson Merkley made the motion to amend Ordinance 2000-OR-51 to reflect no increases in salary for elected officials, seconded by Councilperson Grooms, passing unanimously. Councilperson Merkley made the motion to adjust the City Court budget by $5,304 due to a calculation error, seconded by Councilperson Wilson, passing unanimously. Councilperson Merkley made the motion to add $455 for City Judge salary in the Probation User Fund Budget, seconded by Councilperson Waiz, passing unanimously. Councilperson Merkley then made the motion to pass Ordinance No. 2000-OR-51 as amended on the third and final reading, seconded by Councilperson Grooms. Councilperson Confin hopes the Council will work for funding of more police and fire. Council President Ellis feels the $125,000 in drainage should have been removed and more police and fire considered as they are needed. He is uncomfortable with the drainage funds in the budget as is. The motion to pass Ordinance No. 2000-OR-51 on the third and final reading passed on the following roll call vote: Ayes: Councilpersons Grooms, Wilson, Waiz, Frantz, and Merkley. September 11, 2000 Page 5 of 6 Nays: Councilpersons Conlin and Ellis. Clerk Treasurer Wilder noted the tax rate as passed is $.04 lower than this year. Ordinance No. 2000-OR-54, An Ordinance Transferring Certain Funds Within Same Department (Planning and Zoning) was introduced. Clerk Treasurer Wilder explained this is no additional money to the budget. Councilperson Cor~in made the motion to pass Ordinance No. 2000- OR-54 on the first reading, seconded by Councilperson Wilson, passing unanimously. Attorney Galligan recommends a minimum bond for the Sanitary Sewer Board, as the City is adequately insured. Council President Ellis made the motion to approve a $1.00 surety bond for the Sanitary Sewer Board, seconded by Councilperson Conlin, passing unanimously. Council President Ellis made the motion to give the Sanitary Sewer Board permission to approve all claims for the Sewer Utility, seconded by Councilperson Grooms. Councilperson Merkley made the motion to amend the motion to state the Sanitary Sewer Board is authorized to approve the claims as long as they revert back to the Council. Councilperson Conlin said the Council put a Councilperson on the Board of Public Works for this purpose. Following discussion, Councilperson Merkley withdrew his amendment motion. The motion passed on a vote of 5-2 with Councilpersons Frantz and Conlin, voting against. Approval of payroll claims discussion followed. Councilperson Merkley made the motion to have the Board Of Public Works approve the payroll, seconded by'Councilperson Conlin, passing unanimously. Vehicle Maintenance Director Mike Ewton explained the need for passage of Resolution No. 2000-R-31, A Resolution Authorizing Advertisement For An Additional Appropriation (General Fund . Vehicle~ Maintenance). Fuel consumption is up 4% to 5%, with the price up 40%. Council President Ellis requests a list of all City vehicles and fuel consumption from January thru August of 2000. Councilperson Merkley made the motion to pass Resolution No. 2000-R-31, seconded by Council President Ellis, passing unanim?msly. Council President Ellis announced a workshop to discuss drainage fees and gasoline for Monday, October 2, at 5:30 P.M. September 11, 2000 Page 6 of 6 There being no further business to come before the Council, Councilperson Merkley made the motion to adjourn at 8:50 P.M., seconded by Councilperson Wilson, passing unanimously.
