SANITARY SEWER BOARD
MINUTES OF MAY 23, 2013 SPECIAL MEETING
The Sanitary Sewer Board of the City of Jeffersonville, Indiana met In a Special
Meeting on Thursday, May 23, 2013 at 9:00 A.M in the City Hall Mayor's Conference
Room. Mayor Mike Moore called the meeting to order at 9:05 A.M. Board Members
present are Dale Orem, Bill Saegesser and Mayor Mike Moore. Also present are Utility
Director Len Ashack, Assistant Director Lori Kearney, Board Attorney Scott Lewis, City
Attorney Les Merkley, Jorge Lanz representing Jacobi, Toombs; Don Thornberry and
Scott Thornberry representing T +C Contracting, Inc., attorney Gerry Stovall
representing T +C Contracting, Inc., and attorney Tim Martin representing Great
American Insurance Company.
Board Member Saegesser made a motion to approve a written Agreement
between the Sewer Board and T +C Contracting, Inc., regarding the Crum's Lane
Interceptor Project, wherein in part, the Sewer Board withdraws its May 7, 2013 letter
declaring a contractor default and termination, without prejudice, and T +C agrees to
proceed and complete the said Project pursuant to all the terms, provisions,
specifications and other items as set forth in the original contract, in addition to the
specific conditions as set forth in the said written Agreement which is attached hereto as
Exhibit "A" and incorporated herein by reference. Motion seconded by Board Member
Orem, passing on a vote of 3 -0.
