A RESOLUTION DESIGNATING THE JEFFERSONVILLE PUBLIC ARTS
COMMITTEE AS THE BODY TO REVIEW, CONSIDER AND DETERMINE THE
CREATION AND PLACEMENT OF PUBLIC ART ON CITY -OWNED
PROPERTY SUBJECT TO CERTAIN APPROVALS
WHEREAS, the Common Council for the City of Jeffersonville, Clark
County Indiana (hereinafter the "Council "), is the City's statutory Legislative Body
pursuant to Indiana Code 36 -4 -6 et seq.;
WHEREAS, the Council has previously established the Jeffersonville
Public Arts Committee for the purpose of the consideration, promotion and
development of public art on city property. "Public Art" includes, but is not limited
to, sculptures, statutes, paintings and murals.
WHEREAS, the Council now designates the Jeffersonville Public Arts
Committee as the body to review, consider and determine the creation and
placement of public art on city -owned property;
WHEREAS, the Jeffersonville Public Arts Committee's determination of
the creation and placement of public art on city -owned property shall be subject
to the approval of the appropriate city board, city commission, or other city entity
that has legal ownership or other legal control and /or legal responsibility over the
particular city -owned property on which a proposed public art item shall be
located.
WHEREAS, if the determination of the creation and location of public art
involves the expenditure of any city funds, then the said determination shall also
be subject to the approval of the Common Council as the fiscal body for the City.
NOW, THEREFORE, BE IT RESOLVED by the Common Council as
follows:
1. That the Jeffersonville Public Arts Committee shall be the body to review,
consider and determine the creation and placement of public art on city -owned
property.
2. That the Jeffersonville Public Arts Committee's determination of the creation
and placement of public art on city -owned property shall be subject to the
approval of the appropriate city board, city commission, or other city entity that
has legal ownership or other legal control and /or legal responsibility over the
particular city -owned property on which a proposed public art item shall be
located.

3. That if the determination of the creation and location of public art involves the
expenditure of any city funds, then the said determination shall also be subject to
the approval of the Common Council as the fiscal body for the City.
