THIS AMENDMENT TO LEASE AGREEMENT is entered into this 28 day of
February, 2013, between Clark County, Indiana, an Indiana municipal corporation,
whose address is 501 East Court Ave., Jeffersonville, IN 47130, ( "Landlord "), and the
City of Jeffersonville, Indiana, an Indiana municipal corporation whose address is 500
Quartermaster Court, Jeffersonville, IN 47130, ( "Tenant "),
WHEREAS, Landlord and Tenant entered into a certain Lease Agreement on
August 1, 2006, concerning the premises in Jeffersonville, Clark County, Indiana,
consisting of approximately 2,920 square feet of storage space in the basement of the
City- County Building, located at 501 East Court Ave., Jeffersonville, IN 47130, and
WHEREAS, Landlord and Tenant desire to amend the aforementioned Lease
Agreement as hereinafter set out,
IT IS THEREFORE AGREED between Landlord and Tenant that the Lease
Agreement dated August 1, 2006, be and it hereby is amended as follows:
The Tenant shall receive the space at no rental charge for 2010, 2011, 2012, 2013
and 2014. In consideration of the Tenant receiving no rental charge, the Landlord
agrees to pay the Tenant the sum of $150,000.00 as full payment and settlement
for all monies owed and due to the Tenant for Landlord's share of the costs
related to the operation of the J.B. Ogle Animal Shelter for 2010, 2011, 2012 and
2013. Said $150,000 shall be paid to the Tenant in two (2) equal installments with
the first due no later than March 31, 2013 and the other due no later than October
1, 2013.
In all other respects, said Lease Agreement shall remain in full force and effect.
IN WITNESS WHEREOF, the parties have executed this Amendment to Lease
Agreement this 28 day of February, 2013.
