PROFESSIONAL AGREEMENT
PEAK CAPACITY AND MISCELLANEOUS IMPROVEMENTS
DOWNTOWN WASTEWATER TREATMENT PLANT
This AMENDMENT NO. 2, made as of the � day of — 4 - A , -. 1 %-% 4 ' ,44 —' 1 , in the
year Two Thousand Thirteen by and between the JEFFERSONVILLE SANITARY SEWER
BOARD, JEFFERSONVILLE, INDIANA (hereinafter called OWNER) and HDR
ENGINEERING, INC. (hereinafter called ENGINEER), shall amend and become a part of the
Professional Agreement between OWNER and ENGINEER dated the 8th day of October, 2009
and Amendment No. 1 dated the 2nd day of June, 2011 (hereinafter called AGREEMENT).
In accordance with Section 8, Article 8.1 of the AGREEMENT, the following shall be
incorporated into the AGREEMENT:
SECTION 6 - Payment to Engineer
Amend Article 6.1 in the following manner:
For Article 2.5 - Services During Construction, increase the lump sum payment to the
ENGINEER by $69,388 due to an extension of construction duration from 12 months to
22 months. The revised total amount for this task shall be $167,388.
Delete Article 6.2 as previously revised by Amendment No. 1 and replace with the
following:
6.2 For the Scope of Services in Article 2.10, the OWNER shall pay the ENGINEER
based on a not -to- exceed amount of $221,910 for Resident Construction
Representation. Said amount is based on a construction duration of 22 months.
IN WITNESS WHEREOF, the parties hereto have made and executed this
AMENDMENT NO. 2 as of the day and year first written above.
