AN ORDINANCE ESTABLISHING THE POLICE NON - REVERTING FUND FOR THE
CITY OF JEFFERSONVILLE, INDIANA AND DIRECTING THE DEPOSIT OF ALL FUNDS NOW
COLLECTED AND DEPOSITED IN THE SERVICES CHARGES FOR FALSE ALARM FUND
ESTABLISHED BY ORDINANCE 2009- OR -11; IN THE NON - REVERTING AUTOMOBILE FUND
ESTABLISHED BY ORDINANCE 97- OR -63; AND THE POLICE SWAT NON - REVERTING FUND
ESTABLISHED BY ORDINANCE 2004 -OR -2
WHEREAS, the City Council is the fiscal body of Jeffersonville, Indiana pursuant to
Indiana Code;
WHEREAS, the City of Jeffersonville desires to continue to su
and upgrade special equipment needed for the operations of the Po per K end and S to improve
purchase vehicles and supplement the educational budgets provided under h teams,
budgets; and;
the City operational
WHEREAS, the City of Jeffersonville shall continue to fine Persons for false alarms; and;
WHEREAS, Indiana Code permits the creation of a special, non - reverting operating fund
for the collection of reasonable fees, fines, permits and funds received from donations, sale of
equipment, appropriations and any other legal source; and;
WHEREAS, it is economically desirable to create such fund for the management of
certain monies charged by the Board as reasonable recreational activity fess and to provide for
the disbursement thereof and such collective fund will allow for some activities to be supported
from the excess revenues of other activities; and
WHEREAS, the City Council desires that these funds continue to be collected, but
deposited into a single non - reverting fund for the purposes set forth in their respective
enabling ordinances.
NOW, THEREFORE, BE IT ORDAINED:
1. A non - reverting operating fund (Fund 351) is hereby established for the purpose of
receiving and holding fines, fees, impound fees, parking violations, donations and
other permitted revenues charged by Jeffersonville Police Department for false
alarms, VIN Check fees, handgun permits, photo copies and permitted legal
revenues.
2. The fund shall be entitled "Police Non - Reverting Fund ".
3. The monies may be expended from the fund by the filing of a proper claim in
issuance of a warrant for payment by the Fiscal Officer after appropriation by the
Board so long as such expenditures are for the benefit of the Police Department
SWAT and K -9 Units, purchase of vehicles and for educational purposes.
4. All funds collected pursuant to Ordinances 2009- OR -11, 97 -OR -63 and 2004 -0R -2
shall be deposited into the "Police Non - Reverting Fund."
5. All other provisions of Ordinances 2009- 0R -11, 97 -OR -63 and 2004 -0R -2 shall
remain in effect with the exception the funds collected shall be deposited into the
"Police Non - Reverting Fund."
This ordinance shall be in full force and effect on January 1, 2013 after its passage by the
Common Council and approval by the Mayor.
