Task Orders will contain the scope and fee limits, with a not -to- exceed without further authorization. r a SUPPLEMENTAL AGREEMENT NUMBER 5 SUPPLEMENTAL AGREEMENT, NUMBER FIVE This Supplemental Agreement, Number Five, to the AGREEMENT FOR PROFESSIONAL SERVICES, dated December 23, 2009 (the Agreement), between City of Jeffersonville (Owner) and HNTB Corporation (HNTB) is made effective as of date of Owner signature below. 1. HNTB shall perform and has performed the following services: See Attachment A — Scope of Services 2. Title: Vcte S ; rj Title: Vice President Date: Date: ZO2fZ Prepared by: City of Jeffersonville HNTB Corporation Supplemental Agreement, Number Five 19 November 2012 Page 1 of 5 ATTACHMENT A SCOPE OF SERVICES POST- DESIGN OF BIG FOUR BRIDGE RAMP APPROACH & LIGHTING & ELECTRICAL REVISED FINAL TRACINGS Additional RFI Responses Supplemental Agreement Number 3 scope provided for responses to twenty (20) Requests for Information (RFI) from the Contractor after Contractor Notice to Proceed, which occurred April 2012. As of November 14, 2012 ninety -three (93) RFI's (see Attachment 1) have been coordinated and responded to by HNTB. Additional Shop Drawing Reviews HNTB was to provide up to two (2) reviews for the steel box girder shop drawings assuming an approximate count of eighty (80) sheets. However, seven (7) reviews, some of which were revisions from the fabricator, were provided for a total of four hundred (400) sheets (see Attachment 2). Removal of Lighting and Electrical Work from bridge plans After INDOT and the City decided to pull the Electrical Construction Change Order and make it a stand -alone contract, HNTB was asked to eliminate the lighting and electrical work from the bridge construction documents. This required revisions to bridge quantities and thirty -five (35) plan sheets. Revise and Repackage Stage 3 and Final Tracings for Lighting and Electrical Contract With the lighting and electrical work removed from the bridge construction documents, HNTB was asked to prepare a set of construction documents for review and bidding. Authorization was provided to begin this work on September 25, 2012, utilizing $11,200 from Supplemental Agreement Number 3 to get started. That number was taken into account in the development of this contract modification. This work included the following tasks: a. Coordinate electrical service requirements with local utility provider b. Coordinate and meet with INDOT and Client c. Revise and repackage lighting, electrical, and pertinent bridge plan sheets d. Perform additional lighting calculations following IESNA Recommended Lighting for Walkways and Class 1 Bikeways guidelines, INDOT Design Manual Chapter 78, AASHTO Guidelines, and the Rose Hill Neighborhood Streetscape Guidelines. e. Revise electrical unique special provisions and coordinate for INDOT review f. Develop estimated quantities of materials for INDOT payment items and develop cost estimate. Develop and coordinate INDOT forms and paperwork for Stage 3 and Final Tracings submittals h. Submit Stage 3 Plans and Final Tracings The following represent the assumptions for these efforts: a. Design work is for the north approach work only. No electrical provisions are included for any equipment or lighting beyond the north approach work, i.e. the main span truss bridge. b. Work is for lighting design only on the pedestrian walkway, support piers, and for box girder interiors. No provisions are included for closed circuit TV (CCTV), emergency call systems, or other special systems. c. The DMX lighting control system, that changes colors within the exterior vertical Tight column fixtures, and the vertical Tight column fixtures themselves have been eliminated from the project at the Client's direction. d. The design now incorporates an illuminated handrail that will run the length of the bridge and approach on both sides and will be connected to the railing installed by the Contractor on the bridge contract. This system received approval from the Client, INDOT, and the Rose Hill Neighborhood Association in compliance with the Section 106 MOA. The compensation to be paid for performance of the Services identified in Attachment A — Scope of Services will be a lump sum amount of $66,100, which includes expenses, raising the total compensation under the Supplemental Agreement Number 3 to the amount of $186,100. Execution of this contract shall be considered as the notice to proceed. Invoices for the previous month's work shall be submitted monthly based on the percentage of completion of the work authorized in this amendment as of the date of each such invoice. HNTB may alter the compensation distribution between individual phases, tasks or work assignments to be consistent with the Services actually rendered, within the total lump sum amount. At the request of the Owner, HNTB stopped work on the design of the rolling floodgate on October 23, 2012. On November 7, 2012 HNTB was directed to change to a post and panel fioodwall with a 40' opening. Therefore, Supplemental Agreement Number 4 is revised to include the same scope previously outlined, as well as the work completed through October 23, 2012 on the rolling floodgate. The compensation to be paid for performance of the Services identified in Attachment A — Scope of Services, as well as those services performed prior to October 23, 2012, will be a lump sum amount of $103,800, which includes expenses, reducing the total compensation under the Supplemental Agreement Number 4 by $50,000. Notice to proceed with the work was already received on November 7, 2012. Invoices for the previous month's work shall be submitted monthly based on the percentage of completion of the work authorized in this amendment as of the date of each such invoice. HNTB may alter the compensation distribution between individual phases, tasks or work assignments to be consistent with the Services actually rendered, within the total lump sum amount. Site visits by HNTB staff to observe unforeseen conditions and /or unique construction issues. Effort will be limited to offering recommendations to the Project Construction Inspection Engineer versus creating detailed analysis or plan revisions. e. Review of electrical shop drawings. HNTB services do not include design or plan revisions needed to reduce contract cost to meet Contractor bid estimates, value- engineering proposals by the Contractor, INDOT, or Client, or changes in unanticipated conditions beyond HNTB's control or responsibility. Estimate of Fee A. HNTB will be reimbursed for the work defined in the scope above according to the billing rates listed under Supplemental Agreement Number 3, Attachment C, Section 1.b. B. Based upon the information available, the estimate of fee for the above services ranges from $10,000 to $25,000. C. We will not exceed $25,000 without prior written approval from the City.
