RESOLUTION NO. 02,b0$ '-D%Z • RESOLUTION AMENDING THE RESOLUTION OF THE JEFFERSONVILLE REDEVELOPMENT COMMISSION ENTITLED "DECLARATORY RESOLUTION OF THE JEFFERSONVILLE REDEVELOPMENT COMMISSION" WHEREAS, the Jeffersonville ( "City") Redevelopment Commission ( "Commission ") did on December 22, 1995, adopt a Declaratory Resolution, as amended on December 1, 1999 and June 15, 2005 (collectively, as amended, "Declaratory Resolution ") establishing the Inner City Road Economic Development Area ( "Original Area ") and the Declaratory Resolution was confirmed by a confirrnatory resolution adopted on February 28, 1996; WHEREAS, the Declaratory Resolution approved the Economic Development Plan, as amended "Plan" which Plan contained amended ( "Plan"), specific recommendations for economic development in the Original Area; WHEREAS, the Declaratory Resolution established an allocation area in accordance with IC 36- 7 -14 -39 ( "Original Allocation Area ") for the purpose of capturing property taxes generated from the incremental assessed value of real and depreciable personal property ( "Tax Increment ") located in the Original Allocation Area WHEREAS, the Commission now desires to: (i) add new territory to the Original Area and Original Allocation Area (as set forth in the map attached hereto as Exhibit A -1 and the parcel list attached hereto as Exhibit A -2), which : will constitute an enlargement of the boundaries of the Original Area and Original Allocation Area of less than 20 %; and (ii) add the construction of certain local public improvements to the project list (as set forth in Exhibit B attached hereto); WHEREAS, IC 36 -7 -14 -17.5 authorizes the Commission to amend the Declaratory Resolution, after conducting a public hearing, if it finds that: 1. The amendments are reasonable and appropriate when considered in relation to the Declaratory Resolution and the Plan and the purposes of IC 36 -7 -14; and 2. The Declaratory Resolution and the Plan, with the proposed amendments, conform to the comprehensive plan for the City; WHEREAS, on May 15, 2008, the Commission published notice of the substance of a proposed amendments to the Declaratory Resolution in accordance with IC 36 -7 -14 -17.5 and IC 5 -3 -1, which notice also gave notice of a hearing on the proposed amendments to be held by the Commission, and notice to neighborhood associations and property owners; and WHEREAS, the Commission on May 27, 2008, conducted a public hearing at which the Commission heard all persons interested in the proceedings and considered all written remonstrances and objections that were filed; and DULY ENTERED FOR TAXPo SUBJECT TO FINAL ACCEPTANCE. The Declaratory Resolution and the Plan are hereby amended to expand the Original Area and Original Allocation Area by less than twenty percent, as described in Exhibit A -1. 2. The Declaratory Resolution and the Plan are hereby further amended to add the construction of certain local public improvements to the project list (as set forth in Exhibit B attached hereto. 3. The Commission now finds and determines that the amendments described in Sections 1 and 2 are reasonable and appropriate when considered in relation to the Declaratory Resolution and the Plan and to the redevelopment and economic development purposes set forth f' in IC 36 -7 -14. 4. The Declaratory Resolution and the Plan, as amended, conform to the comprehensive plan for the City. 5. The Secretary is instructed to submit this resolution to the Common Council for approval of the amendment to the Declaratory Resolution and Plan. ctifri 6. The Secretary is hereby directed to record this resolution with the Clark County Recorder, immediately to notify the Department of Local Government Finance of the amendment to the Plan and to file this resolution with the Clark County Auditor. z 7. (... - 2- 1/2138114.2 June 2, 2008 Description of the Boundary Of an Expansion to the Gateway Redevelopment District and the Inter City Road Economic Development Area Jeffersonville, Indiana Beginning at a point in the boundary of the Gateway Redevelopment District, said point being at the southwesterly intersection of Mechanic Street and 12 Street, at the northeast comer of the Quandrangle, then proceeding as follows: Eastwardly, 620 feet, more or less, along the southerly line of 12 Street to the easterly line of Dutch Lane; E' Northwestwardly, 780 feet, more or less, along the easterly line of Dutch Lane to the southerly property line of the B & 0 Railroad (currently known as CSX); Northwestwardly, 4970 feet, more or less, along said southerly line of the railroad to the northerly corner of America Place, which is also the westerly corner of the platted Woodhaven Subdivision; Southeastwardly, 2230 feet, more or less, with the line dividing America Place and Woodhaven Subdivision to the southerly line of Plank Road; Northeastwardly, 2160 feet, more or less, along said southerly line of Plank Road to the southwesterly intersection of Plank Road and E. 10 Street; Eastwardly, 60 feet, more or less, to a point in the boundary of the Intercity Road Development Area at the northeasterly intersection of E. 10 Street and Kehoe Lane; Southeastwardly, 110 feet, more or less, along the existing Intercity Road Development Area boundary; Southeastwardly, 340 feet, more or less, along the boundary of the existing Intercity Road Development Area, which is also the easterly line of Kehoe Lane to a corner of the Intercity Road Development District.
