A RESOLUTION REQUESTING ENFORCEMENT OF
ORDINANCE 2004 -OR -74 REGARDING RETIREE
HEALTH INSURANCE BENEFITS
WHEREAS, the Common Council for the City of Jeffersonville, Clark
County Indiana (hereinafter the "Common Council "), as the City's statutory Fiscal
and Legislative Bodies, has previously passed and adopted Ordinance 2004 -OR-
74 whereby said Ordinance provided in part that until a retired City employee or
surviving spouse is eligible for medicare coverage, the City shall pay 60% of the
retired City employee's or surviving spouse's health insurance premium and the
remaining 40% of said premium shall be paid by the retired City employee or
surviving spouse.
WHEREAS, the Council has recently been informed by the City's financial
controller that the said Ordinance has not been enforced properly and that the
City has not been billing the City's retired employees and surviving spouses for
payment of 40% of their health insurance premiums.
WHEREAS, the Council has taken previous action to advise the City
financial controller to properly bill the retired City employees and surviving
spouses for 40% of their health insurance premiums pursuant to the said
Ordinance.
WHEREAS, pursuant to Indiana Code, the Mayor is the executive of city
government and as executive the Mayor is statutorily responsible for
enforcement of the City's duly passed and adopted Ordinances.

WHEREAS, the Council has been advised that the Mayor has instructed
the City financial controller not to bill the City's retired employees and surviving
spouses for payment of 40% payment of their health insurance premiums
pursuant to the terms and provisions of the said Ordinance.
WHEREAS, the Council, as the City's fiscal and legislative body, hereby
requests that the Mayor, pursuant to his statutory duty as the executive of city
government, enforce the said Ordinance and to instruct the City financial
controller to abide by all the terms and provisions of said Ordinance, including
but not limited to billing the City's retired employees and surviving spouses for
payment of 40% of their health insurance premiums.
NOW, THEREFORE, BE IT RESOLVED by the Common Council that the
Council requests that the Mayor enforce all terms and provisions of Ordinance
2004- OR -74.
