March 5, 2012
The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101 500
Quartermaster Court, Jeffersonville, In at 7:00 P.M., on Monday March 5, 2012.
Council President Ed Zastawny, with Vicki Conlin City Clerk at the desk, called the meeting to order at
7:00 P.M. Council President welcomed all in attendance, asking those present to stand as Blabby
Campbell gave the invocation, Council President Zastawny then led all those present in the pled e of
allegiance to the flag.
The roll call and those present were Councilpersons, Ed Zastawny, Connie Sellers, Lisa Gill, Mike
Smith, Bryan Glover, Dennis Julius and Matt Owen. Councilpersons Zach Payne and Nathan Samuel
were absent.
Approval of the Agenda:
Councilperson Julius made the motion to APPROVE the agenda as presented, seconded by
Councilperson Owen, passing on a vote of 7 -0.
Minutes to be Approved:
Council President Zastawny presented the minutes for consideration. Councilperson Sellers made
the motion to APPROVE the minutes of the February 21, 2012 (7:00 P.M.), seconded by Councilpgrson
Owen, passing on a vote of 7 -0. Councilperson Gill made the motion to APPROVE the minutes o the
Special Meeting, February 27, 2012 (6:00 P.M.), seconded by Councilperson Owen, passing on a v e of
7 - 0.
Claims to be Approved:
Monica Harmon, City Controller presented the claims list for consideration by the co ncil.
Councilperson Owen made the motion to APPROVE the claim list of $238,884.70 with the removal of
51,635.22 Computer Equipment from the Clerk's Department, seconded by Councilperson Sellers,
passing on a vote of 7 -0.
Councilperson Sellers made the motion to APPROVE the claim list of $32,877.59 for the !arks
Department, seconded by Councilperson Gill, passing on a vote of 7 -0.
Councilperson Glover made the motion to APPROVE the claim list of 512,960.65 for T.I.F., seconded
by Councilperson Gill, passing on a vote of 7 -0.
Councilperson Julius updated the council on the claim of $175,000.00 stating that he and Jamie ke,
members of the Redevelopment Commission does not feel that HTNB has justified the claim, di not
have a change order but the Supplement Agreement, Number Two was signed by the Mayor on Ja uary
7, 2012. Councilperson Smith made the motion to APPROVE the claim for 5175,000.00, seconded by
Councilperson Owen. Council President Zastawny requested for a Roll Call Vote. Motion APPR VED
passing on a vote of 5 -2. Roll call below:

Councilperson Smith made the motion to APPROVE the claim for $10,000.00 for litigation, seconded
by Councilperson Owen, passing on a vote 7 -0.

1) Les Merkley — 2012 -0R -17 AN ORDIANCE CHANGING ZONING LOCATED AT 410 E. 10'" STREET FROM
C1 TO C2.
Tom Lowe presented Ordinance 2012 -0R -17 for public hearing; Council President Zastawny opined
the Public Hearing Opened. Councilperson Smith discussed the change in the Zoning. Councilperso Gill
informed the public that the Jeffersonville Planning Commission passed on to the council w h a
favorable recommendation. Council President Zastawny closed the Public Hearing. Councilperson S ith
made the motion to APPROVE 2012- 0R -17, seconded by Councilperson Gill, passing on a vote of 7 •.
2) Les Merkley — 2012-0R-11 AN ORDIANANCE AUTHORIZING CERTAIN METHODS OF PAYMENT. (p. sed
on 1" reading)
Controller Monica Harmon presented the Ordinance 2012 -0R -11 and asked that the ordinan• - be
passed on second and third reading. Councilperson Sellers made the motion to APPROVE 2012 -• - -11
on the second and third readings, seconded by Councilperson Gill, passing on a vote of 7 -0.
3) Monica Harmon — 2012 -0R -14 AN ORDIANCE OF APPROPRIATOR REDUCTION — AMEN RING
ORDINANCE 2011- OR -57, (passed on 1" reading)
Controller Monica Harmon presented Ordinance 2012 -0R -14 stating needs to be amende on
"Exhibit A" the reduction amount of $109,125.00 needs to be changed to $118,300.00 and to be p. sed
on the second and third reading. Councilperson Owen made the motion to APPROVE 2012 -OR -14 o the
second and third reading, seconded by Councilperson Gill. Council President Zastawny requested . Roll
Call Vote. Motion FAILED FOR LACK OF MAJORITY OF COUNCIL MEMBERS. Roll call below:

AMENDING ORDIANANCE 2011- OR -57, (passed on 1" reading)
Controller Harmon presented Ordinance 2012 -0R -15 related to the positions discussed prior in 2011-
OR -14. "Exhibit A" Director of Communications $38,000 from General Fund, Mayor. Grant Writer
$43,000, Administrative Assistant $31,000 from Redevelopment. Councilperson Sellers made the motion
to PASS 2011-011-15 on the second reading, seconded by Councilperson Smith. Council Presi ent
Zastawny requested a Roll Call Vote. Motion FAILED FOR LACK OF MAJORITY OF COUNCIL MEMBE S.

Controller Hannon presented 2012.0R -16 for the third reading. Councilperson Owen mad the
motion to APPROVE 2012 -0R -16 on the third reading, seconded by Councilperson Gill, passing on . vote
of 7 -0.

REPORTS AND COMMENTS
Public Comment — None at this time.
Council Comments:
Councliperson Smith commented that people want to volunteer from the recent tornadoes, etro
United Way Disaster Volunteer Organization has set up in the Bales Building on 723 Spring S reet.
Volunteers will be asked to 1111 out an application /registration form to be filled out In the field - that
volunteers have expertise in. If services are needed the volunteer will receive a call and given a ss to
enter the areas. Rose Hill Neighborhood Association has Invited the council to a meeting on Wedn sday
night March 7, 2012.
Councilperson Sellers received an e-mail today retreat center in Henryville has a 300 room > reat
center that has opened for victims of the tornado. Eastside Church of Christ is taking up donatio s for
twin sheets, bedspread and blankets for the retreat center.
Councilperson Gill public thanked the police, fire, street and other departments for respo ding
quickly to help out Henryville and to Sara Green, Animal Shelter Director, The Dog inn for housin: the
displaced animals. Jeffersonville High School National Honor Society for their volunteer work a the
Josephine Ogle Animal Shelter.
Councilperson Glover — Nothing at this time.

Councllperson Julius spoke with Fire Chief Hedrick that within an hour or two over 50 boots we • on
the ground in Henryville. Working on a fundraiser in coordination with the Mayor, Council, Poll•: and
Fire Department and If anyone wants to volunteer to please contact one of the council mem•ers.
Councilperson Julius stated that he had contacted Senator Ron Grooms because he has received s eral
calls from downtown business owners regarding the economic impact on the business with the br , ges
construction. Both Councilperson Julius and Senator Grooms are not sure if there has been an Econ • mic
Impact Study done. The Ogle Foundation volunteered over $300,000 to do the study. Councilperson
Julius continues to state that Kentucky is in charge of building the bridges and the approaches t• the
bridges and Jeffersonville may need to communicate with Kentucky DOT instead of IN .OT.
Councilperson Julius will continue to keep the council abreast by verbal reports and e- mails.
Councilperson Owen stated that he works for one of the local EMS and on Friday went Into ork
after the tornado, being at the station and listening to the radio traffic. Councilperson Owen desc 'bed
how proud he was when Central Alarm reported to Henryville Command center that Chief Hedric was
sending two crews of firefighters, total of 26 firefighters and 24 police officers. Saturday David H. sea
and the Street Department, about a dozen workers went. Tornado relief fundraiser at the Ame can
Legion Post in Charlestown on Saturday March 12, 2012, Tanya Stephenson stated that she 1- the
Jeffersonville contact for the VFW fundraiser and can be contacted at 502- 544-9181; Mark Dept Is
taking monetary denotations and will be matching the donations 10096. Councilperson 1 -n
recognized the Boy Scouts for the services they rendered in Henryville.
Council President Zastawny recognized the Boy Scouts present for the Council meeting. Troo• 89
from Sacred Heart and Troop 1 from Wall Street Methodist Church.
Council President Zastawny reported on the meeting prior to the council meeting with Central Al: rm.
President Zastawny appointed a Committee who will be working on an Inter Local Agreement ith
Central Alarm.
