HomeMy WebLinkAboutFebruary 6, 2012 COUNCIL PROCEEDINGS OF THE • COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA FEBRUARY 6, 2012 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101,500 Quartermaster Court, Jeffersonville, In, at 7:00 P.M., on Monday February 6, 2012. Council President Ed Zastawny, with Vicki Conlin City Clerk at the desk, called the meeting to order at 7:r P.M. Council President Zastawny welcomed all in attendance, asking those present to stand as Bobby Campbell gave the invocation, Council President Zastawny then led all those present in the pledge of allegiance to the flag. The roll call and those present were: Councilpersons Ed Zastawny, Connie Sellers, Zach Payne, Lisa Gill, Dennis Julius, Matt Owen, Nathan Samuel, and Mike Smith. Those absent were: Councilperson Glover. Councilperson Smith requested under New Business, Item 119 City Council Statement on Storm water Conveyance /Storage /Flooding to be TABLED. Councilperson Samuel made the motion to APPROVE the Agenda as Amended, seconded by Councilperson Julius, passing on a vote of 8 -0. Council President Zastawny presented the minutes for consideration. Councilperson Samuel made the motion to APPROVE the minutes of January 23, 2012 (7:12 P.M.), seconded by Councilperson Owen, passin: • on a vote of8.0. City Controller Monica Harmon presented the claims list for consideration by the council. Councilperson Sellers stated the under the line item in the Mayor's Department - 01/25/2012,110429 Clark County Republican Party for $325.00 be removed. Councilperson Sellers made the motion to APPROVE the civil ci claim list in the amount of 5351,236.34 with the deletion of the 5325.00., seconded by Councilperson Smit passing on a vote of 8-0. Councilperson Julius discussed the City of Jeffersonville claims list totaling 5395,933.07 and requested the t the council considered removing HNTB claim of 5175,000.00 until discussed at the February 29, 2012 Redevelopment Commission meeting. City Controller Monica Harmon stated that the claims have not bee approved by the Redevelopment Commission and conveyed to the council that the approval by the council would be considered a Pre - Approval of the claims. Councilperson Julius made the motion to PRE - APPROVE with the deletion of 5175,000.00 seconded by Councilperson Samuel. Councilperson Owen stated he woul • not be in favor of voting for the Pre - Approved claim list, and asked to have them presented at the next Cou cil meeting. Councilperson Julius withdrew his original motion, Councilperson Samuel withdrew his second. Councilperson Owen made the motion to TABLE the claims of 5395,933.07, seconded by Councilperson Smi h, passing on a vote of 8 -0. Councilperson Samuel made the motion to APPROVE the claims list for the TIF in the amount of 5543,750.00, seconded by Councilperson Sellers, passing on a vote of 8-0. Councilperson Samuel made the motion to APPROVE the TIF claims in the amount of 533,133.08, seconded by Councilperson Smith, passing on a vote of 8 -0. Councilperson Sellers made the motion to PRE- APPROVE the Parks Department Claim in the amount of 567,323.94, seconded by Councilperson Julius, passing on a vote of 8 -0. • Fire Chief Eric Hedrick, Jeffersonville Fire Department , informed the council members as of January 1, • 2012 the Fire Departments overtime budget was $210,000 due to all the over time the budget is presently . t 592,000.00 He reported possibly discussing the hiring of new employees and feels this move would cut do in overtime being paid out. Councilperson Julius stated that he feels hiring is not an immediate fix, but for he council to work with the chief and administration IN devising a plan. UNFINSHED BUSINESS: Item 1: Councilperson Samuel made the motion to TABLE, An Ordinance Repealing Ordinances and Establishing Sewer Rates and Sewer Capacity Fees, seconded by Councilperson Julius, passing on a vote of :- 0. Item 2. Greg Fifer presented to the council An Ordinance Vacating an Unimproved Portion of Ninth Street, a Public Way in the thy of Jeffersonville, Indiana, for the final readings. Councilperson Samuel ma. the motion to PASS Ordinance No. 2012 -0R -3 AN ORDINANCE VACATING AN UNIMPROVED PORTION OF NINTH STREET, A PUBLIC WAY IN THE CITY OF JEFFERSONVILLE, INDIANA on the 2 and 3 reading, secon „ ed by Councilperson Smith, passing on a vote of 8 -0. NEW BUISNESS: Item 1: City Clerk Vicki Conlin presented Ordinance 2012 -0R -4 An Ordinance Transferring Certain Fun • with the Same Department for Office Supplies. Councilperson Smith made the motion to PASS 2012 -OR-4 in • the 1” and 2 readings, seconded by Councilperson Julius, passing on a vote of 8-0. Item 2: City Controller Monica Harmon presented Ordinance 2012 -0R -5 An Ordinance with Amends 2I • - OR -51 Fixing the Salaries of Appointed Officers and Employees for all the Departments of the City of Jeffersonville, Indiana for the Year 2012. Councilperson Sellers made the motion to TABLE 2012.OR -5 AN ORDIANCE WHICH AMMENDS 2011 -or-51 FIXING SALARIES OF APPOINTED OFFICERS AND EMPLOYEES • ALL THE DPEARTMENTS OF THE CITY OF JEFFERSONVILLE, INDIANA FOR THE YEAR 2012, seconded by Councilperson Gill, passing on a vote of 8-0. Item 3: City Controller Monica Harmon presented Ordinance 2012 -OR-6 An Ordinance of Additional Appropriation. Councilperson Julius made the motion to TABLE 2012-0R-6 AN ORDINANCE OF ADDI11O APPROPRIATION, seconded by Councilperson Owen, passing on a vote of 8 -0. Item 4: City Controller Monica Harmon presented Ordinance 2012.OR -7 An Ordinance of Appropriation Reduction. Councilperson Smith made the motion to TABLE 2012 -or -7 AN ORDINANCE OF APPROPRIATIO REDUCTION, seconded by Councilperson Julius, passing on a vote of 8-0. Item 5: City Council Attorney Scott Lewis presented Ordinance 2012.OR -8 An Ordinance Amending the 2012 Budget- Ordinance Reduction of Budget Appropriations. Councilperson Owen made the motion to Suspend the Rules In Anticipation of Passing 2012 -OR -8 AN ORDINANCE AMENDING THE 2012 BUDGET ORDINANCE OF REDUCTION OF APPROPRIATIONS on all three readings, seconded by Councilperson Seller , passing on a vote of 8.0. Councilperson Owen made the motion to PASS 2012.OR -8 AN ORDINANCE AMENDING THE 2012 BUDGET- ORDINANCE OF REDUCTION OF APPROPRIATIONS on all three readings, • seconded by Councilperson Smith, passing on a vote of 7-1. Item 6: City Council Attorney Scott Lewis presented Ordinance 2012 -0R -9 An Ordinance Amending the 2012 Budget — An Ordinance of Additional Appropriation (By Reduction of Appropriations). Councilperso Owen made the motion to Suspend the Rules in Anticipation of Passing 2012 -OR -9 AN ORDINANCE AMENDING THE 2012 BUDGET — API ORDINANCE OF ADDITIONAL APPROPRIATION (BY REDUCTION OF APPROPRIATIONS) on all three readings, seconded by Councilperson Smith, passing on a vote of 8-0. Councilperson Owen made the motion to PASS 2012•OR -9 AN ORDINANCE AMENDING THE 2012 BUDGET AN ORDINANCE OF ADDITIONAL APPROPRIATION (BY REDUCTION OF APPROPRIATIONS) on all three readings, seconded by Councilperson Payne, passing on a vote of 7 -1. Item 7: City Council Attorney Scott Lewis presented Ordinance 2012 -0R -10 An Ordinance Amending the Non-Collective Bargaining Salary/Wage Administrative Policy. Councilperson Smith made the motion to SUSPEND THE RULES IN ANTICIPATION OF PASSING 2012-0R -10 AN ORDIANANCE AMENDING THE NON - COLLECTIVE BARGANING SALARY/WAGE ADMINISTRATIVE POLICY on all three readings, seconded by Councilperson Payne, passing on a vote of 8 -0. Councilperson Smith made the motion to PASS 2012 -0R -10 AN ORDINANCE AMENDING THE NON - COLLECTIVE BARGANING SALARY /WAGE ADMINISTRATIVE POLICY • n all three reading, seconded by Councilperson Sellers, passing on a vote of 7 -1. Rem 8: Creation of City Law Department —City Council Attorney Scott Lewis reported that the above ordinances created the City Law Department no action needed from the council. • Item 9: City Council Statement on Stormwater Conveyance /Storage /Flooding Projects — TABLED. (SEE PARAGRAPH 4 APPROVAL OF THE AGENDA) Rem 10: Pat Eckert with the Jeffersonville High School Band Boosters presented information regarding t e Jeff High Band. Jeff High Band Boosters reaching out to the community in behalf of the band for communi awareness and fundraiser. Boosters are selling tickets on $10,000, $20.00 per ticket or three for $50.00 W • one in 1000 chances to win. Anyone interested in purchasing tickets may contact Ms. Eckert at 502-572-66 or her e-mail address patsirishdream@yahoo.com. Ms. Eckert was not asking for any monetary support fr • m the council. Item 11: Exit 0 Ministries —John Mustain, Paul Stensrud, CEO of Jesus Cares, and Kelly Curran presented information regarding the homeless and the person items that are destroyed or bst during the sweeps that have taken place. During the sweeps many of the homeless person documents, ID's and family heirlooms a e taken to the landfill which makes it very difficult for the person to retain their personnel items back or to h. e ID's reissued. Requested by the speakers that the council either look at an ordinance or mandate that wh n a date scheduled for the sweeps that a notice is posted of the date and Exit 0 Ministries be able to assist in the efforts to collect the items. Councilperson Smith suggested the group also meet with Clarksville Town Council and New Albany City Council for a joint effort consideration as this is a bigger problem than just Jeffersonville and a mutual understanding for all communities. Mr. Mustain stated Exit 0 Ministries would e hosting an Information Program on February 16, 2012 at 6:30 P.M., Park Memorial Church, Jeffersonville, Indiana, inviting community leaders, council members and business leaders to establish a focus group. Councilperson Samuel thanked both Mr. Mustain and Mr. Stensrud and suggested maybe a passing a recommendation to the administration for the street department to notify Mr. Stensrud regarding when th • sweep may take place. Councilperson Gill suggested bring the information to the Board of Public Works Council President Zastawny pointed Councilperson SAMUEL as the point person to work together with Exit 1 Ministries as the Council works together on a recommendation. • Item 12: Councilperson Sellers made the motion to TABLE City Council Appointments to the Building Authority, seconded by Councilperson Smith, passing on a vote of 8 -0. City Attomey also stated that he an Corporate Counsel Attorney Tom Lowe are working together on the City Appointments and will present at he next Council meeting. REPORTS AND COMMENTS: Councilperson Smith, the Ice Rink is shut down and last report from Ms. Schutz was well over $70,000.01 and over 10,000 rentals way above which was expected. Ms. Schutz is working on group rates for churches and organizations. Councilperson Smith is looking forward to next year and working with the UEZ, Redevelopment and City Council on putting together a financial package, one expense that will not have to u included in the financial package is for the electrical service and transformer this was a onetime cost. Proj that Councilperson Smith is working on with Bill Whitaker, last year city had it first car show that was Crusi ' with the Monarchs and had well over 100 street rods and hot rods, this year going to do the same event a d will be with the Blue Brothers to be held June 29, 2012. Councilperson Payne — No comment. Councilperson Sellers in the last Parks Authority Meeting had issue regarding Vissing Park being 2 million over budget. Councilperson Sellers would like Construction Solutions to come before the council to explain the increase. • Councilperson Gill — No comment. Councilperson Julius earlier last week meeting with Chris from Security Pro in regards to options for cameras and surveillance in the parks, pump stations and other areas of concern. Councilperson suggested the Department Heads give to the council what is spent annually for damages due to vandalism to figure a plan and justify if the surveillance cameras are needed. Councilperson Owen Last week article regarding the Riverstage I and II and what the administration has decided what is going to be done to Riverstage II. Considering the council has acted as the Parks Authority since 2008, it was surprising to find out that the administration had decided to move forward with scrappin Riverstage 11 as a project, and the council has not seen any financial information on the cost of repairing Riverstage I. Shocking and disappointing that decision are being made to scrap projects when adequate information has not been presented. Secondly and another article was in the News and Tribune regarding t e Parks Authority according to Indiana Code for a Class 2 City describes the makeup of a Parks Board and was the understanding that unless the city executive decided to make the change that the previous makeup of e Parks Authority was acceptable. It was Councilperson Owen that the administration was going to be accep 'ing of how the Parks Authority make-up, and surprise about the comments made regarding the administration just now finding out about the Indiana Code for a Class 2 City. There has been no discussion with the administration regarding the change and the comment that was made that the City Council was reluctant ti speak with the Mayor and has no idea where evidence of this comment has come from. Councilperson 0 n thanked everyone for attending the meetings and the great turnout. Spoke with the Drainage Board representative regarding Waverly Road, has been working with the residents, and has the completed • Stormwater Master Plan and Waverly Road is addressed in the plan. Councilperson Owen thanked Ms. Eck rt for coming to the Council meeting and Jeff High has many programs, which shine positive lights on our community. • Councilperson Samuel — No comment. Council President Zastawny reported on the retreat this past Saturday spent seven plus hours working together on communication, building relationships, vision and plans on the cities futures to better Jeffersonville.
