I% OF THE COMMON COUNCIL OF JEFFERSONVILLE ACCEPTING THE PROPOSAL SUBMITTED IN RESPONSE TO THE REQUEST FOR PROPOSALS TO LOCATE COMMERCIAL DEVELOPMENT AT THE TERMINUS OF SPRING STREET, RELEASED BY THE CITY OF JEFFERSONVILLE. WHEREAS, the City of Jeffersonville wishes to locate a commercial development at the foot of Spring Street to further the completion of the Jeffersonville Riverfront Master Plan, adopted in November, 1992; WHEREAS, the Common Council, as the disposing agent for the City, authorized the release of a "Request for Proposals to Lease Five Hundred (500) Feet of River Frontage at the Foot of Spring Street" on January 24, 1994; WHEREAS, the Request for Proposal was advertised and one proposal was received from Jeffersonville Riverfront Developers, L.P., on March 21, 1994; and, WHEREAS, the.Common Council has reviewed the proposal and has evaluated its responsiveness using the criteria oUtlined in the Request for PrOposal; NOW, THEREFORE, LET IT BE RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, THAT: 1. The Common Council hereby determines that the proposal for commercial development submitted by the Jeffersonville Riverfront Developers, L.P. may be the most appropriate response to the Request for Proposals, contingent upon the execution of a mutually acceptable lease agreement. 2. The Common Council renders authority to the Department of Redevelopment of the City of Jeffersonville to begin negotiations with the developer to clarify th~ proposal, to discuss potential revisions to the proposal consistent with the Request for Proposals, and to finalize a mutually acceptable lease agreement, with specific attention being given, but not limited to, noise, parking, subleasing, land use, utilities, necessary permits, and rent payments. 3. The Common Council further authorizes the City Attorney to proceed with notice of a Public Hearing to be conducted to hear public comment and recommendations regarding the disposal of the River Frontage Property by the lease agreement, in accordance with IC 36-1-11-3. ~O RESOLVe,ED THIS FOURTH DAY OF A~IL, 1994.
