WHEREAS, the Mayor desires to designate the Common Council to give notice and to conduct a public hearing and to notify the Mayor of recommendations regarding the disposal of such property by lease pursuant to IC 36-1-11-3; and, WHEREAS, the Common Council is a disposing agent for a tract of property located at the foot of Spring Street along the Ohio River in the City of Jeffersonville. (Property is illustrated on Exhibit A, attached herewith); and, WHEREAS, the Common Council has determined that the property shown in Exhibit A, attached herewith, cannot be feasibly disposed of under IC 36-1-11-10 (Lease of property; procedure) because of difficulties in appraising such property, and because of additional public improvements that will be required if a commercial development is constructed thereon; THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE AND MAYOR THEREOF THAT: 1. The Mayor hereby designates the Common Council to give notice and to conduct a public hearing, and to notify the Mayor of recommendations regarding the disposal of such property by lease pursuant to IC 36-1-11-3. 2. The Common Council hereby determines that the property shown in Exhibit A, attached herewith, cannot be feasibly disposed of under IC 36-1-11-10 (Lease of property; procedure) because of difficulties in appraising such property, and because of additional public improvements that will be required if a commercial development is constructed thereon. 3. The Mayor hereby grants authorization to the Common Council to use provisions of IC 36-1-11-12 (Lease of property: Request for Proposal). 4. The Common Council has reviewed a "Request for Proposal to Lease Five Hundred (500) Feet of River Frontage at the Foot of Spring Street" (Exhibit B, attached herewith) and hereby approves the Request for Proposal, certifying that all necessary statements are contained therein. 5. Notice of the "Request for Proposal" shall be given by publication in accordance with IC 5-3-1 as soon as possible after the passage of this resolution. 6. Upon passage of these resolutions by the Common Council and approval by the Mayor of the City of Jeffersonville, copies of the Request for Proposal may be distributed to any interested persons and/or entity.
