HomeMy WebLinkAboutOctober 17, 2011 COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA OCTOBER 17, 2011 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 6:30 P.M. on Monday October 17, 2011. Mayor Tom Galligan, with Deputy Clerk Treasurer Barbara Hollis at the desk, called the meeting to order at 6:35 P.M. Also present was City Attomey Darren Wilder and City Council Attorney Mickey Weber. Mayor Galligan welcomed all in attendance, asking all those present to stand as Councilperson Nathan Samuel gave the invocation. Mayor Galligan then led all those present in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons Mike Smith, Ed Zastawny, Connie Sellers, Barbara Wilson, Wayne Carter and Nathan Samuel. Absent: Councilperson Keith Fetz. Councilperson Samuel made the motion to approve the agenda as presented, second by Councilperson Carter, passing on a vote of 6 -0. Mayor Galligan presented the minutes for consideration. Councilperson Wilson made the motion to approve the minutes of October 3, 2011 (6:30 P.M.) as presented, second by Councilperson Samuel, passing on a vote of 6-0. Deputy Clerk Hollis presented the claim lists for consideration by the Council, Following discussion, Councilperson Samuel made the motion to approve the claim list in the amount of $294,283.92 as presented, second by Councilperson Zastawny, passing on a vote of 6 -0. Councilperson Wilson made the motion to preapprove the Park claims in the amount of $25,010.17 as presented, second by Councilperson Zastawny, passing on a vote of 6-0. Councilperson Samuel made the motion to approve the Canal ROW & Flood Mitigation claim list in the amount of $398,024.48 and the TIP claim list in the amount of $1,144,641.55 as presented, second by Councilperson Sellers, passing on a vote of 6-0. Mayor Galligan welcomed Wall Street Methodist Church, Boy Scout Troop Nl to the Council meeting. • October 17, 2011 2 PUBLIC COMMENT: There was no public comment COUNCIL COMMENT: There was no Council comment. DEPARTMENT HEAD REPORTS: There were no Department Head reports. AGENDA ITEMS: Finance Officer Monica Harmon presented and explained Ordinance No. 2011 - OR-53, An Ordinance For Appropriations Of Locally Controlled Funds. Councilperson Samuel voiced concern that the EDIT and LOTT Funds are fully budgeted. He would like to see a reserve for the Rainy Day Fund. Officer Harmon noted the current year balance will be available for a reserve. Councilperson Carter made the motion to pass Ordinance No. 2011 -OR -53 on the third reading, second by Council President Smith, passing on a vote of 6-0. Officer Hannon presented Ordinance No. 2011- OR -54, An Ordinance Transferring Certain Funds Within The Same Department (General Fund — Animal Shelter). Councilperson Samuel made the motion to pass Ordinance No. 2011 -OR -54 on the third reading, second by Councilperson Sellers, passing on a vote of 6 -0. Officer Harmon presented Ordinance No. 2011- OR -55, An Ordinance Transferring Certain Funds Within The Same Department (LOIT). Council President Smith made the motion to pass Ordinance No. 2011 -OR -55 on the third reading, second by Councilperson Wilson, passing on a vote of 6-0. Officer Hannon next presented Ordinance No. 2011- OR -56, An Ordinance Which Amends 2011 -OR-40 Which Amends 2011 -OR -16 Amending 2010 -OR -39 Fixing Basic Salaries Of Appointed Officers And Employees Of The City Of Jeffersonville, Indiana. Councilperson Samuel made the motion to pass Ordinance No. 2011 -OR -56 on the third reading, second by Councilperson Zastawny, passing on a vote of 5 -0 -1. Councilperson Sellers abstained. Officer Hannon presented Ordinance No. 2011- OR -57, An Ordinance For Appropriations And Tax Rates. Councilperson Zastawny made the motion to pass October 17, 2011 3 Ordinance No. 2011 -OR -57 on the third reading, second by Councilperson Wilson, passing on a vote of 6 -0. Officer Harmon presented and explained Ordinance No. 2011- OR -58, An Ordinance Of Additional Appropriation (General Fund — Council). Council President Smith made the motion to suspend the rules for Ordinance No. 2011- OR -%8, second by Councilperson Sellers, passing on a vote of 6 -0. Council President Smith then made the motion to pass Ordinance No. 2011 -OR -58 on all three readings, second by Councilperson Wilson, passing on a vote of 6-0. Officer Harmon presented and explained Ordinance No. 2011- OR -59, An Ordinance Of Additional Appropriation (General Fund — Vehicle Maintenance). Councilperson Carter made the motion to pass Ordinance No. 2011 -OR -59 on the fast and second readings, second by Councilperson Zastawny, passing on a vote of 6 -0. Attorney Bruce Paul explained the area and the need for passage of 2011 -R -27, A Resolution Of The Common Council Of The City Of Jeffersonville, Indiana Consenting To The Issuance By The Town Of Sellersburg, Indiana Of An Economic Development Revenue Not For Profit Community Enterprises Properties, LLC. Andrew Takami, Executive Director of Resource Development for Ivy Tech reviewed the intentions. Councilperson Samuel says welcome, asking if this is a Not For Profit. Mr. Takami answered yes. Council President Smith is familiar with the building and Ivy Tech and feels this is good, noting revenue will be derived from students. Mayor Galligan said welcome and thank you to Ivy Tech for being a major partner. Council President Smith made the motion to pass Resolution No. 2011 -R -27, second by Councilperson Wilson, passing on a vote of 6 -0. Planning and Zoning Director Brian Fogle presented and explained the need for passage of Ordinance No. 2011- OR -60, An Ordinance Rezoning 2.6 Acres From C2: Medium To Large Scale General Commercial & M2: Medium Density Multi Family Residential To IS: Institutional Uses. This request received a favorable recommendation from the Plan Commission. Mr. Ron Ellis of Saint James United Methodist Church said the Church has purchased property and demolished the existing home explaining the area that will be used for a parking lot. Following all discussion, Councilperson Samuel made October 17, 2011 4 the motion to pass Ordinance No. 2011- OR -60, second by Councilperson Sellers, passing on a vote of 6 -0. Director Fogle next explained Resolution No. 2011 -R -28, An Interlocal Cooperative Agreement Between Indiana Department Of Transportation And The City Of Jeffersonville Concerning Construction And Maintenance Of Indiana Approaches to The Big Four Bicycle And Pedestrian Bridge Over The Ohio River. Local funding for this project is 20% up to $10,000,000 and 100% over $10,000,000. Councilperson Samuel made the motion to pass Resolution No. 2011 -R -28, second by Councilperson Zastawny, passing on a vote of 6-0. Communications Director Larry Thomas explained website proposals were sent to seven vendors and he received proposals from 5. Information Technology Director Roger Hardy and Finance Officer Monica Hannon have reviewed the proposal. Attorney Weber has also looked at the proposal. Director Thomas recommends the proposal from Blackstone Media in the amount of $30,900. This will integrate with the Cartegraph system. Councilperson Samuel made the motion to approve the proposal and an amount not to exceed $30,900 from the Gaming Fund for this project and $90 an hour for tech support, second by Councilperson Wilson, passing on a vote of 6 -0. COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS: Councilperson Samuel continues to hear complaints regarding the volume of the televised Council meetings. Communication Director Thomas will work on improving the level of sound. Another concern Councilperson Samuel has been hearing is the money being spent on the 10 Street median plantings. The funding for this project comes from TIF revenue that must be spent on upgrades. He also hears concerns for the improvements being made just before the election and concerns that the plants may be damaged by salt during the winter. Mayor Galligan said this is the planting season. Councilperson Samuel did note the project was bid. Councilperson Zastawny said salt exposure was considered in the plan and there is a two-year contract for maintaining the plantings. Councilperson Wilson noted "Halloween Downtown" is next Monday, saying "bring the children ". October 17, 2011 5 Councilperson Zastawny asked that the paint striping on 10 Street be redone as it is hard to see. Councilperson Zastawny would like the Council to consider transferring money to the Rainy Day Fund. He feels the City is in good financial shape. Council President Smith commends Jeff Johnson for the electrical work on the 1ran/Afghanistan Memorial. This is something to be proud of.
