COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
July 11, 2011
The Common Council of the City of Jeffersonville, Indiana met in regular session
in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 6:30 P.M.
on Monday June 20, 2011.
Mayor Tom Galligan, with Chief Deputy Clerk Treasurer Suzy Bass at the desk,
called the meeting to order at 6:45 P.M. Also present were City Attorney Darren Wilder
and Council Attorney Mickey Weber. Mayor Galligan welcomed all in attendance,
asking all those present to stand as Councilperson Samuel gave the invocation. Mayor
Galligan then led all those present in the pledge of allegiance to the flag.
The roll was called and those present were; Councilpersons Mike Smith, Fd
Zastawny, Connie Sellers, Barbara Wilson, Wayne Carter and Nathan Samuel.
Absent: Councilperson Keith Fetz.
Councilperson Samuel made the motion to approve the agenda as presented,
second by Council President Smith, passing on a vote of 6 -0.
Mayor Galligan presented the minutes for consideration. Councilperson Wilson
made the motion to approve the minutes of June 20, 2011 (5:30 P.M.) as presented,
second by Councilperson Sellers, passing on a vote of 6 -0. Councilperson Wilson made
the motion to approve the minutes of June 20, 2011 (6:30 P.M.) as presented, second by
Councilperson Carter, passing on a vote of 6 -0.
Chief Deputy Bass presented the claim list for consideration by the Council.
Council President Smith asked to remove the claim to Budget Printing because it is much
higher than the bid. Events Coordinator Sam Schutz is researching it. Following
discussion, the motion was made by Council President Smith to approve the remaining
claims as presented, second by Councilperson Samuel, passing on a vote of 6 -0.
PUBLIC COMMENT:
Pat Barrow appeared before the Council concerning claims for Chester Hicks and
Larry Wilder. According to the claims list it says the total payment is for the lawsuit with
the City and cited items on the invoice that have nothing to do with that case.

Councilperson Samuel said that the claims list only allows for a brief description of
everything on a claim. Chief Deputy Bass said that all claims are available for inspection
in the Clerk- Treasurer's Office.
Vicki Burkett appeared before the Council and said that the air conditioning was
out at one of the rooms at the animal shelter. She and her husband were going to pay to
have it fixed but she called the Mayor and Councilperson Sellers and it has been fixed.
Director Wilder noted later that the thermostat was broke, not the air conditioner. She
also asked about getting speed bumps installed on Kingsfield St. The Mayor said that he
will add it to his list if money for asphalt holds out.
Kelley Curran appeared before the Council questioning several claims that were
on the previous claims list. Again, it was explained that the detail on the list was very
limited and the original claim could be accessed in the Clerk Treasurer's Office.
Joe Hubbard, FOP President, told the Council that he believed there was a deal on
the table but when he took it back to the body, they voted it down. One of the issues was
the wording in regards to the merit board. They have not adopted their rules and
regulations on disciplinary procedures. He also stands behind removing the physical
fitness section as he feels it is an administration call as to the physical fitness
requirements.
Attorney Mike Gillenwater appeared before the Council to ask the Council to
attend the settlement meeting on Friday. He said that his client wants to settle and
discussed several options of settlement.
COUNCIL COMMENT:
There was no Council comment.
DEPARTMENT HEAD REPORTS:
There were no Department Head reports.
AGENDA ITEMS:
The motion was made by Councilperson Samuel to table 2011- OR -32, second by
Councilperson Sellers, passing on a vote of 6 -0.
Attorney Weber told the Council that he will have the Ethics Commission
appointments ready for the next meeting.

Attorney Weber asked to go on record saying that despite the fact that many
things Attorney Gillenwater spoke on earlier stating that he was sure Attorney Weber
agreed with, he in fact does not agree.
Attorney Weber was asked to look into ways the City can receive more money
from traffic fines written by the JPD. He told the Council that the officers need to write
the tickets as an ordinance violation. Mayor Galligan said he will talk with the JPD
Tuesday morning about this.
Attorney Weber said that he believes that July 7' was the deadline to have all
benches removed within the City. Mayor Galligan asked that he confirm this and he will
have the Street Department to begin removing them.
Mayor Galligan informed the Council that this was a public hearing concerning
the following additional appropriation requests:
Chief Deputy Bass said that the following three ordinances were previously
approved and were sent to the paper for advertisement. Unfortunately, the
advertisements were not published 10 days prior to approval so they have to be approved
again.
Mayor Galligan presented 2011 -OR -35 (previously 2011- OR -28), an additional
appropriation from the Gaming Fund. The motion was made by Council President Smith
to suspend the rules in anticipation of passing the ordinance on all three readings, second
by Councilperson Wilson, passing 6 -0. The motion was made by Council President
Smith to pass 2011 -OR -35 on all three readings, second by Councilperson Wilson
passing 6-0.
Mayor Galligan presented 2011 -OR -36 (previously 2011- OR -27), an additional
appropriation from the General Fund. The motion was made by Councilperson Samuel to
suspend the rules in anticipation of passing the ordinance on all three readings, second by
Councilperson Sellers, passing 6 -0. The motion was made by Councilperson Samuel to
pass 2011 -OR -36 on all three readings, second by Councilperson Wilson passing 6-0.
Mayor Galligan presented 2011 -OR -37 (previously 2011- OR -26), an additional
appropriation from the LOIT Fund. The motion was made by Councilperson Samuel to
suspend the rules in anticipation of passing the ordinance on all three readings, second by
Councilperson Sellers, passing 6 -0. The motion was made by Councilperson Samuel to

pass 2011 -OR -37 on all three readings, second by Councilperson Wilson passing 6-0.
Mike Hutt asked why this was not put into the original budget and the Mayor explained
that because of the Circuit Breaker, it was cut from the budget.
Mayor Galligan presented 2011- OR -38, an additional appropriation from the
EDIT fund. Council President Smith made the motion to table 2011- OR -38, second by
Councilperson Zastawny passing 6-0. Council President Smith said that he wants to
make sure this has been paid in the past before he agrees to pay it this year.
Mayor Galligan presented 2011- OR -39, an additional appropriation from the
LOIT fund. Council President Smith made the motion to approve 2011 -OR -39 on the 1"
and 2 " reading, second by Councilperson Sellers passing 6 -0.
Bethany Mull appeared before the Council asking permission for Director Wilder
to purchase heartworm and parvo testing kits to help prevent the diseases from spreading
so quickly. She said according to the printouts she received, there is plenty of money in
the donation and other animal shelter funds to pay for these kits. They are only asking to
keep about 100 test kits on hand. Councilperson Sellers said that she has been
researching the tests and talking with vets in the area and would like to discuss this
further with Director Wilder before recommending buying the tests. The parvo tests kits
run about $10.00 — $25.00 per test and the heartworm tests are about $5.00 but they
should be administered by a vet tech.
Council President Smith asked the Council to approve moving forward with the
City venturing into a grant with local communities to purchase tasers and refills. This is
a no match grant and Clarksville will be administering the grant. The motion was made
by Councilperson Zastawny to approve the request, second by Councilperson Sellers,
passing 6-0.
Councilperson Samuel said that August 2 is National Night Out. He is
encouraging all neighborhood associations to take part in this. Director Hulse is working
to make neighborhoods aware of this event.
Councilperson Wilson said that she attended the Community Garden dedication.
She also said that the concert Friday was wonderful.
Councilperson Zastawny said that the kids' triathlon this past weekend was a huge
success with almost 200 participants. He said the Parks Department did a great job.

Council President Smith said that the LOIT money received from the County
Auditor was cut 25 %. He said the Auditor took it upon himself to distribute it 75% -
25%. Council President Smith said the he supports funding the 911 system but feels the
distribution is completely out of line. He read that Mr. Snelling said he has gotten no
opposition from any communities for his actions. Council President would like the
Council to instruct the Council Attorney to send a letter to Mr. Snelling informing him •
that the City feels the distribution was not acceptable. The motion was made by
Councilperson Wilson to approve the request, second by Councilperson Zastawny,
passing 6 -0.
Council President Smith said he would like to have an Executive Session on
Friday July 15`" at 1:00 pm on the 3 floor in the Council Conference Room. Attomey
Weber will advertise.
Mayor Galligan said that he recently visited Oklahoma City to look at their canal.
He said met with the Mayor and was very impressed with all he saw. He talked to many
people and that the reason they originally created the canal was to make their City a
better place to live and make it so businesses will want to settle there. The built a ball
park and made the canal along an area that was nut down. The canal was not built
because of drainage issues. It is thriving and the community is continuing to grow. Ile
said it was a great experience.
As there was no further business to come before the Council, the meeting was
adjourned at 8:20 P.M.
