HomeMy WebLinkAboutAugust 2, 2010COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA August 2, 2010 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 6:30 P.M. on Monday August 2, 2010. Mayor Tom Galligan, with Chief Deputy Clerk Treasurer Suzy Bass at the desk, called the meeting to order at 6:30 P.M. Also present was City Attorney Darren Wilder, Mayor Galligan welcomed all in attendance, asking all those present to stand as Councilperson Nathan Samuel gave the invocation. Mayor Galligan then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons Mike Smith, Ed Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Ron Grooms, and Nathan Samuel. Absent: None. Councilperson Grooms made the motion to approve the agenda with the addition of #12a, Amendment to Salary Ordinance and 13a, Surety Bond Ordinance, second by Councilperson Sellers, passing on a vote of 7-0. Mayor Galligan and the City Council recognized two members of the community for their work with City Pride and the community and presented them with the Ruther Fairfax Award. The recipients were Pat Elder and Peggy Duffy. Mayor Galligan presented the minutes for consideration. Councilperson Wilson made the motion to approve the minutes of June 30, 2010 second by Councilperson Sellers, passing on a vote of 7-0. Councilperson Wilson made the motion to approve the minutes of July 19, 2010 second by Councilperson Grooms, passing on a vote of 7-0. Councilperson Wilson made the motion to approve the minutes of July 28, 2010 second by Councilperson Samuel, passing on a vote of 7-0. Councilperson Sellers made the motion to approve the minutes of July 26, 2010 second by Councilperson Samuel, passing on a vote of 7-0. August 2, 2010 2 Chief Deputy Clerk Bass presented the claim lists for consideration by the Council. Councilperson Zastawny made the motion to approve the regular claims as presented, second by Councilperson Fetz, passing on a vote of 7-0. Councilperson Grooms made the motion to preapprove the Park claims as presented, second by Councilperson Zastawny, passing on a vote of 7-0. PUBLIC COMMENT: Carol John Smith, Glass Steelspoke to the Council encouraging them to deal with the crisis that affects issues not only nationally but also locally. This includes foreclosures, unemployment, loss of mobile services and jobs. COUNCIL COMMENT: There was no Council comment. DEPARTMENT HEAD REPORTS: There were no Department Head Reports. AGENDA ITEMS: Peggy Duffy appeared before the Council to update the Council. She told the Council there are now large planters in Youngstown Plaza. There is continuing efforts in the downtown area. She told the Council that she has been working closely with Economic Director Clarence Hulse on several projects. She told the Council that they are facing a financial dilemma concerning the upkeep of landscaping throughout the City. She asked the Council to start thinking about what would be the best way to approach this problem; either by utilizing employees in the Parks Department or hiring another employee to help with watering and weeding. She said that she would be happy to work with the Parks Department on scheduling, etc. Ms. Duffy told the Council that Walnut Ridge has donated their service to upkeep the landscape at Riverstage. City Council Attorney Greg Clark presented the Council with his resignation letter (attached), effective 30-45 days from this meeting. He has accepted a job with the Council that it was a hard decision and he thanked the Council and Mayor for their support during his tenure. Mayor Galligan presented Ordinance No. 2010-OR-28, An Ordinance Amending the Salary Ordinance (2010-OR-13) For Jeffersonville, Indiana. Councilperson Fetz made the motion to pass Ordinance No. 2010-OR-28 on the first reading, second by August 2, 2010 3 Councilperson Sellers. Mayor Galligan said that he feels there is a discrepancy in the evaluation of the two top Clerk positions in the Clerk Treasurer's Office. He intends to contact HR Affiliates and have an amendment to these positions at the next meeting. The motion passed 7-0. Council Attorney Clark presented 2010-R-18 at the request of several Council members. Mr. Clark was asked to determine the powers and responsibilities of the City's Elected Official, particularly, the Clerk Treasurer. Mr. Clark explained the functions of the Clerk Treasurer and the powers of the Council in regards to the Clerk Treasurer. After discussing the resolution, Mr. Clark reiterated that the duties of the Clerk Treasurer's Office were being done efficiently therefore he asked the City Council and the public to move forward carefully. The motion was made by Councilperson Grooms to approve 2010-R-18, second by Councilperson Fetz passing on a vote of 7-0. Mayor Galligan said that he understands the frustration of some of the citizens but the City has functions to perform and must move forward. He said that Peggy has been cooperative and Suzy and her staff continue to work well with his administration. He feels there will be no purpose served to do anything further and he would like to continue to get along with the Clerk Treasurer's Office. He said she is an Elected Official and deserves to be there and he wishes her well. Council Attorney Clark presented 2010-OR-30, an Ordinance Regulating the Maintenance of Existing Buildings and Property within the City of Jeffersonville. After discussion, the motion was made by Councilperson Sellers to approve the ordinance, second by Councilperson Fetz passing on a vote of 5-1-1, with Councilperson Samuel voting no and Councilperson Grooms abstaining. Councilperson Grooms presented 2010-OR-31, an Ordinance of Additional Appropriation. The motion was made by Councilperson Grooms to pass the ordinance on the 1St and 2°d reading, second by Councilperson Zastawny, passing a vote of 7-0. Councilperson Grooms presented 2010-OR-32, An Ordinance of Additional Appropriation. The motion was made by Councilperson Grooms to approve the ordinance on the 1St and 2°d reading, second by Councilperson Zastawny, passing on a vote of 7-0. ~~ . •e August 2, 2010 4 As there was no further business to come before the Council, the meeting was adjourned at 8:15 P.M.
