City Hall Council Chambers The Common Council of the City of Jeffersonville met in Special Session on Wednesday, July 28, 2010. Council President Nathan Samuel called the meeting to order at 6:10 P.M., and on call of the roll those members present were: Councilpersons Connie Sellers, Barbara Wilson, Ron Grooms, and Nathan Samuel. Also present were Attorney Greg Clark, and Deputy Clerk Treasurer Barbara Hollis. In attendance representing the F.O.P. are Joe Hubbard and Josh Lynch along with Leo Blackwell their attorney. The first area of discussion was with article Thirty-four Fitness Standard. Officer Hubbard reviewed the proposed changes. All agreed to change the word legitimate to documented in article 34.4. Officer Hubbard noted the reason for article 34.5 was to provide incentive rather than punishment. Councilperson Grooms would like to come back to this and 34.6. Councilperson Smith arrived at 6:25 P.M. Councilperson Grooms, referring to 34.7, said comp time is being abolished in the City handbook. Councilperson Smith feels this would take officers off the street when the City is trying to ramp up for annexation. Council Attorney Clark suggests a change in 34.3 to read "shall be included in the annual or biannual report to the merit board" He is also concerned, with regard to 34.8, that the merit board may refuse to hear a case. F.O.P Attorney Blackwell voiced concern for taking it out. Council President Samuel feels both sides agree with all but 34.4, 34.5, and 34.6. Officer Hubbard explained Exhibit A is based on academy exit standards. Council President Samuel said he would not support crunches. Officer Hubbard offered to take crunches out. At the conclusion of all discussion, it was agreed by all to accept Exhibit A with the removal of crunches and add procedures referenced as Indiana State Police procedures and protocols as amended, and to strike minimum times for sit ups and pushups, and change 61 to 60 in the last age group. Council President Samuel presented Jeffersonville Contract Negotiations, Fraternal Order of Police, Mayor, City Council 2010, as attached. Tax caps and appeals are a real concern. The offer is a $300 addition to base pay. Councilperson Smith said the DLGF has reported a record number of appeals with most being granted. Council President Samuel said it is not the desire to include the tabled items. F.O. P. Attorney Blackwell asked if this is the last, best, final offer. Council President Samuel replied, yes. Council President Samuel then said it is the perception that all City employees are overpaid. He then explained a salary survey has been done and the goals for it. All are trying to work with the money the City has. There is a need to be conservative, as the upcoming revenue is unknown. Officer Hubbard reviewed the offer is $300 on base pay and to strike articles 34.5, 34.6, and 34.7. This will be presented to the membership for a vote and will be kept open until August 16, 2010. Council President Samuel suggests the pay and Article Thirty-four be separated for the vote. F.O.P. Attorney Blackwell requests the offer be presented in writing.
