The City of Jeffersonville, IN (referred to as "Jeffersonville")and FitNLife agree to enter
into a contract that will include a component of Jeffersonville's wellness program.
FitNLife will complete a personal wellness profile (referred to as "PWP") for the
employees and/or designated individuals of Jeffersonville. All duties and
responsibilities for the PWP contract are listed below. Also listed below is the payment
schedule that Jeffersonville will pay to FitNLife for such services.
PERSONAL WELLNESS PROFILE SYSTEM
*health risk assessments
*onsite biometric analysis
*individual counseling with all participants who fall into a high risk category
*development of a game plan for those individuals in a high risk category
*detail individual report and recommendations
*aggregate group report and recommendations for program focus
*quarterly follow up of the game plans; with report to the wellness committee
PAYMENT
Payment for each PWP is $85. FitNLife will be paid a minimum fee equaling 33% of all
employees for the City.
INDEMNITY
Jeffersonville and FitNLife will hold each harmless from any loss, damage, liability or
expense resulting from any injury to or death of any person, or any loss of or damage to
any property, caused by or resulting from any act or omission of or any officer, agent,
employee, invitee or visitor in or about the premises or building.
MISCELLANEOUS
Employees of FitNLife will not perform any work or do anything outside of their regular
duties as outlined in the contract unless under special instruction in writing from
Jeffersonville.
FitNLife will not conduct itself in any manner which is inconsistent with the character of
Jeffersonville. FitNLife agrees that it shall not willfully do or omit to do any act or thing
which shall discriminate or segregate upon the basis of race, color, sex, creed, or
national origin in completion of the contract duties.
This contract shall be governed by, and shall be construed in accordance with, the laws
of the State of Indiana. The parties to this contract have participated fully in the
negotiation and preparation hereof. Accordingly, this contract shall not be more
strictly construed against any one of the parties hereto.
This contract contains all covenants and agreements between Jeffersonville and
FitNLife relating in any manner to the matter set forth in this contract. Not prior
agreement or understanding pertaining to the same shall be valid or of any force or
effect, and the covenants and agreements of this contract cannot be altered, changed,
modified or added to except in writing signed by Jeffersonville and FitNLife.
