HomeMy WebLinkAboutApril 19, 2010COUNCIL PROCEDDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA April 19, 2010 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 6:30 P.M. on Monday April 19, 2010. Mayor Tom Galligan, called the meeting to order. Also present were City Attorney Darren Wilder, Council Attorney Greg Clark, and Deputy Clerk Treasurer Tiffany Timberlake. Mayor Galligan welcomed all in attendance, asking all those present to stand as Council President Nathan Samuel gave the invocation. Mayor Galligan then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons Mike Smith, Ed Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Nathan Samuel, and Ron Grooms. Council President Samuel made the motion to approve the agenda as presented, seconded by Councilperson Sellers and passed 7-0. Councilperson Wilson made the motion to approve the minutes for the Apri15, 2010 Special Session, seconded by Councilperson Fetz and passed 6-0. Councilperson Grooms abstained. Councilperson Wilson made the motion to approve the minutes for the Apri15, 2010 meeting at 6:30, seconded by Councilperson Fetz and passed 6-0. Councilperson Grooms abstained. The claims list was presented to the Council. Councilperson Grooms made the motion to approve the claims as presented, seconded by Council President Samuel and passed 7-0. Councilperson Grooms made the motion to pre-approve the Parks claims list as presented, seconded by Councilperson Wilson and passed 7-0. Public Comment Matt Owen explained to the Council that he was not recording tonights meeting due to a broken piece of recording equipment. He has spoken with IT Director Roger Hardy and the problem should be fixed before the next meeting. Mr. Owen also told the Council that he will be training a Jeffersonville High School student to replace him. He believes that he will be training the student for at least the next month or two. April 19, 2010 2 Department Head Reports There were no Department Head Reports. Agenda Items Levois Davis came before the Council to request a Sewer Tie In Exemption. Mayor Galligan explained that this is a matter that should have been handled during a Sanitary Sewer Board meeting and asked Mr. Davis to contact his secretary to set up a meeting to discuss this matter further. James Gales ap~eared before the Council to request they change the name of Locust Street. from l Ot Street to Riddle Street, to honor Mr. Thomas Bryant. Mr. Bryant was the NAACP President for 20 years and made a big impact on many Jeffersonville Residents. Councilperson Smith commented that changing the streets name would not impact Spring Hill School. Councilperson Samuel is supportive of honoring Mr. Bryant but he would like for there to be some sort of procedure set in place so that they have guidelines to use with this and future requests. Councilperson Fetz will work with Bryan Fogle, Planning and Zoning Assistant Director, to contact the residents that would be affected by this change and give them a chance to come to a Board of Works meeting to voice their opinions and/or concerns on this matter. Deb Ashack and Peggy Duffy came before the Council with an update on the proposed Canal Project. There will be a website for this project set up for the public to get information and it should be available by the end of the month. A link will be on the City's website. Ms. Ashack felt that there is a lot of support for this project from the community and had a good turn out at the public meeting held March 22. Pat Barrow came before the Council to present a PowerPoint slide show on the various zoning violations she feels Mac Construction and Excavating has been allowed to make. Ms. Barrow said that this matter will be turned over to a legal team if no action is taken to remove the asphalt plant in the next 30 days. City Attorney Darren Wilder came before the Council to present Ordinance 2010- OR-7, An Ordinance amending 2009-OR-7 Regarding Refuse/Garbage Collection on the second reading. Councilperson Zastawny made the motion to approve the Ordinance on the second reading, Councilperson Wilson seconded the motion and it passed 7-0. Council President made the motion to approve Ordinance 2010-OR-8, Ordinance Transferring Funds within same Department (Fire Merit) on the second and third readings, seconded by Councilperson Sellers, the motion passed 7-0. Council President made the motion to approve Ordinance 2010-OR-9 Ordinance Transferring Funds within same Department (Police Merit) on the second and third readings, seconded by Councilperson Sellers, the motion passed 7-0. April 19, 2010 Councilperson Grooms made the motion to approve Ordinance 2010-OR-10 Ordinance of Additional Appropriation (Construction) on the second reading, seconded by Councilperson Wilson and passed 7-0 Councilperson Grooms made the motion to approve Ordinance 2010-OR-11 Ordinance of Additional Appropriation (Motor Vehicle) on the second reading, seconded by Councilperson Fetz and passed 7-0 Council Attorney Greg Clark presented 2010-OR-12, Ordinance Setting Registration Fees for Construction Site Qualified Professional Inspectors and Requiring Proof of Registration to Obtain Storm Water Quality Management Permits. Councilperson Fetz made the motion to approve the Ordinance on the second and third reading, seconded by Councilperson Sellers and passed 7-0. Council President Samuel made the motion to approve 2010-OR-13, Ordinance Amending 2010-OR-6 Fixing Basic Salaries of Appointed Officers and Employees of the City of Jeffersonville, on the second and third reading. Councilperson Grooms seconded the motion and it passed 7-0. Councilperson Sellers made the motion to approve 2010-OR-14 Ordinance Transferring Funds Within Same Department - IT Disaster Recovery on the second and third reading. Councilperson Fetz seconded the motion and it passed 7-0. Councilperson Grooms made the motion to pass on the second and third reading Ordinance 2010-OR-15, Ordinance Transferring Funds Within Same Department -Salary Admin Project, seconded by Councilperson Wilson and passed 6-1. Councilperson Fetz voted against. Councilperson Grooms presented Ordinance 2010-OR-16, An Ordinance Transferring Funds Within Same Department -Info Tech Hardware. Following a brief discussion Councilperson Zastawny made the motion to approve the Ordinance on the first reading, seconded by Councilperson Sellers and passed 7-0. Council President Samuel made the motion to approve 2010-OR-17 Ordinance of Additional Appropriation -Legal Services, on the first reading. Councilperson Wilson seconded the motion and it passed 7-0. City Attorney Darren Wilder presented 2010-OR-18, Ordinance Regulating Taxi Cab Service and Drivers in Jeffersonville. Council President Samuel made the motion to approve on the first reading, seconded by Councilperson Smith and passed 7-0. Councilperson Grooms explained the need to go over the current Employee Handbook and look into making changes to the Employee Benefits Section. Council President Samuel suggested that they schedule a workshop to further address the sections that need to be looked into. April 19, 2010 Committee Reports, Council & Mayor Comments 4 Councilperson Smith commented that Thunder went very well but he thinks there needs to be more trash receptacles put out next year. He also had a complaint from a resident on Riverside Dr. about having a vendor set up in front of their property and wants to possibly look into the Ordinance that prohibited that in the past. Councilperson Sellers wanted to thank Officer Grimes and everyone else who helped with Thunder. She felt the turnout was great but would like to see more food vendors next year because the lines for food were extremely long. She has also received calls from Residents asking if the Summer Relief fund that the sewer department officers could be extended from 3 months to 5 months. Councilperson Wilson said that the Spay/Neuter Program did well parking cars for Thunder. Councilperson Grooms would like to thank Officer Grimes for attending the meeting. There will be a finance committee meeting Thursday at 9:00 A.M. He also heard about there being a need for more food vendors at Thunder. Council President Samuel is trying to schedule a workshop with the FOP for May 17t". He asked the Mayor if he had met with the company Curb Appeal. Samuel also asked the Mayor about the Levy Appeal and the Mayor will contact Umbaugh to make sure they are working on it. Mayor Galligan said that the Star will be removed soon. He reminded everyone that Friday at 11 there will be a retirement party for City Engineer Bob Miller. Mayor Galligan feels that Thunder went well and that everyone involved did a great job. He believes that it brought in a lot of revenue for the City. As there was no further business to come before the Council, the meeting was adjourned at 9:17 P.M. THOMAS R.
