An Ordinance Vacating Public Rights-of-Way
WHEREAS, the Jeffersonville Redevelopment Commission has petitioned the Common
Council of the City of Jeffersonville ("the Council") to vacate the following described public right-
of-way in the City of Jeffersonville, Indiana, to-wit:
Being all of Third Street between Blocks 17 and 20, and all ora 20 foot wide alley
in said Block 17 in the City of Jeffersonville, Clark County, Indiana, and being
further described as follows:
Beginning at a steel pin on the northeast corner of Lot 9, in said Block 17; Thence
N.4°30'08"E., along the 3¢estem Right-of-Way line of Illinois Avenue, 60 feet to an
iron pipe on the southeast comer of Lot 16, in said Block 20; Thence N.85°29'52"W.,
along the north line o£ said Third Street, 131.1 feet to the west Right-of-Way line of
said 20 foot wide alley; Thence S.4° 30'08"W., along the west line of said alley,
435.28 feet to the north Right-of-Way line of Market Street; Thence S.85° 22'53"E.,
along said Right-of-Way line, 20 feet to a steel pin on the southwest comer of Lot 16
in said Block 17; Thence N.4° 30'08"E., along the east line of said alley, 375.32 feet
to a steel pin on the northwest comer of Lot 9 in said Block 17; Thence
S.85°29'52"E., along the south line of said Third Street, 111.1 feet to THE PLACE
OF BEGiNNiNG.
Containing 0.353 acre and being subject to all easements of record; and
WHEREAS, after publishing notice in accordance with the provisions of I.C. 5-3-1 and
notifying adjacent property owner(s) by certified mail, the Council held a public hearing on the 18th
day of November, 1996 to hear comments and concerns regarding the vacation of said right-of-way,
during which hearing comments and concerns were recorded; and
WHEREAS, the Council having examined and heard evidence on said petition and being
duly advised, now find that said petition should be granted;
NOW, THEREFORE, IT IS HEREBY ORDAINED that the above-described rights-of-way
are hereby vacated and the fee simple title to said rights-of-way shall vest in.
This ordinance shall be in full force and effect fi'om and after its passage and approval.

NOTICE OF PUBLIC HEARING
Notice is hereby given that the Jeffersonville Redevelopment Commission has filed a petition
with the Common Council of the City of Jeffersonville ("the Council") requesting vacation of the
following described right-of-way within the City of Jeffersonville, County of Clark, State of Indiana,,
to-wit:
Being all of Third Street between Blocks 17 and 20, and all ora 20 foot wide alley
in said Block 17 in the City of Jeffersonville, Clark County, Indiana, and being
further described as follows:

Notice is further given that the Council will hold a public hearing on the aforesaid petition
on the 18th day of November, 1996, at 7:00 p.m., in Room 308 of the City-County Building, in the
City of Jeffersonville, Indiana.

TO THE JEFFERSONVILLE COMMON COUNCIL:
The Jeffersonville Redevelopment Commission (the "Petitioner"), hereby requests that the
Common Council of the City of Jeffersonville, Indiana, ("the Council") vacate the right-of-way in
the City of Jeffersonville, County of Clark, State of Indiana described in Exhibit "A" attached hereto.
Due to the construction of the Clark Memorial Bridge, the above-referenced right-of-way is no
longer accessible for general public use.
The Petitioner hereby acknowledges that property owners adjacent to the above-referenced
right-of-way must be notified by certified mail, return receipt requested, of the time and date of the
Council's hearing on this petition.
WHEREFORE, the Petitioner requests that public notice be given pursuant to the provisions
ofI. C. 5-3-1 and a public hearing be held and thereafter, that the Council grant this petition to vacate
the right-of-way described in Exhibit A attached hereto.
