HomeMy WebLinkAbout11-06-1995COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA NOVEMBER 6t 1995 The Common Council of the City of Jeffersonville met in regular session in the Multi-Purpose Meeting Room in the City-County Building, jeffersonville, Indiana, at 7:30 P.M. on the 6th day of November 1995. The meeting was called to order by Mayor Jr., with Clerk and Treasurer C. Richard Spencer Mayor Parker welcomed all in attendance, asking all Raymond J. Parker Jr, at the desk. those present to stand as Councllperson Steven Stemler gave the invocation. He then asked all those present to Join him in the pledge of allegiance to the flag. The roll was called and those present were Councilpersons Bill Wolpert, Andrew Williams III, Donna M. Frantzt Peggy Knight Wilder, Barbara Wilson, Steven R. Stemler, and Robert L. Potter. Absent: None. Mayor Parker presented the minutes of October 16, 1995, for consideration by the Council. Wilder made the motion to approve the minutes as presented, by Councllperson Wolpert and carried unanimously. Clerk and Treasurer Spencer presented the claim the meetings of Council President seconded consideration by the Council. Following all discussion, Councllperson Wolpert made the motion to approve the claims as presented, seconded by Councilperson Williams. Council President Wilder explained she list for PAGE 2 NOVEMBER 6, 1995 will abstain from the vote on the claims as her husband Attorney Larry Wilder is on the list for Judge pro-rem pay. The claims were approved with the following roll call vote: Ayes: Councilpersons Wolpert, Williams, Frantz, Wilson, Stemler, and Potter. Nays: None Abstain: Council President Wilder. Attorney Glllenwater presented Ordinance No. 95-OR-44, An Ordinance Regulating Certain Adult Businesses And Establishing A Classification Of Businesses Deemed Potentially Harmful To The City of Jeffersonvllle, as revised, announcing this has been advertised as a public hearing. This is upon recommendation of the Plan Commission and he will be happy to answer any questions. Council President Wilder made the motion to suspend the rules for Ordinance No. 95-OR-44, seconded by Councilperson Potter and carried unanimously. Council president Wilder then made the motion to pass Ordinance No. 95-OR-44 on all three readings, seconded Mayor Parker asked for comments from the comments the motion passed unanimously. by Councllperson audience. Councilperson Frantz has a desired amendment to this Ordinanace and asked Attorney Gillenwater what he recommends. Due to the time involved Attorney Giltenwater PAGE 3 NOVEMBER 6, 1995 recommends passage with an amendment then made the motion to suspend the seconded by Councilperson Councilperson Frantz then made 95-OR-45 on all three readings, of the Ordinance through the Plan as presented and then follow up Commission. Councllperson Williams presented Ordinance No. Ordinance Amending Certain Portion of Ordinance Establishing A Spay/Neuter program, explained this has following first reading passage. Councllperson Williams introduced No. and explained Ordinance 95-OR-46, An Ordinance Amending Certain Portion Of Ordinance No. PAGE 4 NOVEMBER 6, 1995 78-0R-43, 92-OR-14, and 93-OR-14, Directing Animal Shelter Fine Revenues To Spay/Neuter Fund. Councilperson Williams made the motion to suspend the rules for Ordinance No. Councllperson Frantz, passing unanimously. then made the motion to pass Ordinance No. readings, seconded by Councllperson Frantz. 95-OR-40, seconded by Councllperson Williams 95-0R-46 on all three Councllperson Williams then read the Ordinance. Following the reading the motion passed unanimously. Mayor Parker made the following appointments to the Adult Entertainment Commission pursuant to Ordinance No. 95-OR-35; Reverend Clifford Vogelsant, Pastor of St. Augustine's Church, Ms. Joan Crooks, 18~7 Utica Pike, Jeffersonvllle, and Sportsman Drive, Jeffersonvllle. Council Ms. Beverly Anderson, Ms. Melba Doggett, Ms. Janice Leavell, 1411 President Wilder recommended and Mr. Jerry Lemons to the Commission. Council President Wilder made the motion to approve the appointments as recommended, seconded by Councilperson Potter, passing unanimously. There is one appointment left to be made. Councilperson Frantz will pass on the subject of weed control at l~th and Spring as permission has not been granted to be on the railroad property. Councllperson Wilson introduced and explained Ordinance No. 95-OR-46, An Ordinance Amending Certain Portions Of Ordinance No. 94-OR-24 (Parks and Recreation Fund). Wilson made the motion to suspend the rules for 95-OR-47, seconded by Councllperson Wilson Councitperson then made the Section 1 Of Councllperson Ordinance No. Williams, passing unanimously. motion to pass Ordinance No. PAGE 5 NOVEMBER 6, 1995 95-OR-47 on all three readings, seconded by Councllperson Williams, following roll call vote: Councilpersons Wolpert, and Potter. Williams, passing on the Ayes: Wilson, Stemler, Nays: No. Frantz, Wilder, Councllperson Wilson then introduced and explained Ordinance 95-OR-48, An Ordinance Transferring Certain Funds Within Same Department motion to suspend the rules for Ordinance No. Council President Wilder, passing unanimously. then made the motion to pass Ordinance No. (Parks and Recreation Fund). Councilperson Wilson made the 95-OR-48, seconded by Councilperson Wilson 95-OR-48 on all three seconded by Councilperson Williams, passing on the following readings, roll call vote: Ayes: Councilpersons Wolpert, Williams, Frantz, Wilder, Wilson Stemler, and Potter. Nays: None. Councilperson Frantz reported she has received a number of calls regarding the leaf program and they have not been good. Residents feel the City should have a vacuum truck that could pick the leaves up from the gutter. Perhaps the Council could address this next year. Councllperson Frantz asked if Jeffersonville has a "good character law". Attorney Gillenwater is not aware of one. Councilperson Frantz read part of an article stating she feels the Council should pass a "Good Character" Ordinance with regard to the Solid Waste District. The Solid Waste District Board does not have PAGE 6 NOVEMBER 6, 1995 authority to pass an Ordinance. Attorney Gillenwater would like to see an example. Councilperson Frantz will ask the Solid Waste District Board to made a recommendation to the Council. Mayor Parker asked all to exercise their right to vote tomorrow. Councilperson Potter asks the same. Councilperson Stemler reported the internal audit was performed at Humana and has been completed by Arthur Anderson. There will be an exit summary meeting within the next two weeks with the formal report to follow. Councllperson Williams read aloud a letter from a Jeffersonvllle High School student expressing the need for sidwalks on Allison Lane. Council President Wilder has the same concerns in her district where there are several schools as well as the YMCA with no sidewalks. She agrees this is a need she would like to pursue. Administrative Assistant Baird has served on the KIPDA Bike and Pathway Committee and reports there is a booklet available on the discussion. There is possible funding through KIPDA. Mr. Les Kavanaugh explained if there could be shown a reduction in traffic there is a possibility of funding. The City is in place to get this under a five year program. This money is very competetive. Engineer Miller explained there will be sidewalks on both sides of Hamburg Pike. Mayor Parker explained the Jeffersonville High School situation has been a problem for years. There have been requests for traffic lights. Park Superintendent Elliott explained the school entrance PAGE 7 NOVEMBER 6, 1995 does not line up with Wooded View entrance, and the school will not give up the entrance. Councilperson Williams announced Street Commissioner Trembly has received a grant of $15,000 to buy equipment. This is a reimbursable grant. Commissioner Trembly explained this is for a truck that will be used for chipping. The total cost of the truck is $35,382 and he has all but the $15,000 available. He does apologize as he did not know this a reimbursement program. Council President Wilder commends Commissioner Trembly for pursuing the grant and promises the Council will look for the money before the next meeting. There will be a Council Workshop Thursday, November 30, 1995 at 5:00 P.M. in the Mayor's Conference Room. Councllperson Frantz asked if the Building Commission Office has been getting calls regarding Hoke's. Councllperson Frantz stated it has gotten bad again. Councllperson Choir of Jeffersonvllle, Commissioner Gavin will check on this. Stemler would like to donate to the Children's and suggests a transfer be made from Council Travel to Promotion.
