HomeMy WebLinkAboutOctober 19, 2009P COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA October 19, 2009 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M. on Monday October 19, 2009. Mayor Tom Galligan, with Deputy Clerk Treasurer Barbara Hollis at the desk, called the meeting to order at 7:50 P.M. Also present were City Attorney Darren Wilder, Council Attorney Greg Clark, and Administrative Assistant Laura Boone. Mayor Galligan welcomed all in attendance, asking all those present to stand as Reverend Conrad Moorer gave the invocation. Mayor Galligan then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons Mike Smith, Ed Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Nathan Samuel, and Ron Grooms. Absent: None. Councilperson Samuel made the motion to approve the agenda, second by Councilperson Wilson, passing on a vote of 7-0. Mayor Galligan presented the minutes for consideration. Councilperson Grooms made the motion to approve the minutes of October 7, 2009, second by Councilperson Zastawny, passing on a vote of 7-0. Councilperson Wilson then made the motion to approve the minutes of September 30, 2009, second by Councilperson Grooms, passing on a vote of 7-0. Deputy Clerk Hollis presented the claim list for consideration by the Council. Discussion followed regarding the Police Merit Board Attorney claim and the ability of the Board to contract. Council Attorney Clark will contact Attorney Braun. At the conclusion of all discussion, Council President Sellers made the motion to approve the claims, minus the claim for Attorney Braun, second by Councilperson Fetz, passing on a vote of 7-0. Councilperson Grooms made the motion to preapprove the Park claims as presented, second by Councilperson Wilson, passing on a vote of 7-0. October 19, 2009 2 PUBLIC COMMENT: There was no public comment. COUNCIL COMMENT: There was no Council comment. DEPARTMENT HEAD REPORTS: There were no Department Head reports. AGENDA ITEMS: Parks Facilities Board Member Sandy Knott gave a video presentation regarding vandalism in City Parks. Ms. Knott explained vandalism has become an epidemic. The Police have come out many times. The Parks maintenance staff works hard to keep up with the destruction. Councilperson Fetz said he would arrange for a presentation on a flash-cam system. Ms Knott noted the need to act. Mayor Galligan asked the Government class students present at the meeting what they would do. Councilperson Smith has concerns regarding banning offenders from the Parks. Mr. Jack Vissing, representing ICON-Jeffersonville Development, LLC, explained the need for passage of Ordinance No. 2009-OR-38, An Ordinance Changing The Zoning Map Of Real Estate Located At The Intersection Of Peach Blossom Drive & Orchard Hills Drive, Jeffersonville, Clark County, Indiana Being 2.3 Acres From C2 (Medium To Large General Commercial) To M2 (Medium Density Multi Family Residential). This change received unanimous Plan Commission approval. Councilperson Fetz noted the only comment at the Plan Commission meeting was with regard to a retention basin. Councilperson Samuel made the motion to pass Ordinance No. 2009-OR-38, second by Councilperson Fetz. Council Attorney Clark questioned the Plan Commission certification. Councilperson Samuel made the motion to amend his motion to attach the certified copy of the Plan Commission certification to the Ordinance, second by Councilperson Fetz, passing on a vote of 7-0. Councilperson Zastawny presented Resolution No. 2009-R-20, A Resolution Advertising An Additional Appropriation From The Share Of Gaming Revenue Fund. Councilperson Zastawny made the motion to pass Resolution No. 2009-R-20 for sidewalks only, second by Councilperson Wilson. Mayor Galligan said he has been stopped several times by a greeter at Meijer that says it is "stupid" to have the r October 19, 2009 3 Charlestown Pike sidewalks. Councilperson Zastawny noted a sidewalk naysayer has apologized. The motion to pass Resolution No. 2009-R-20 passed on a vote of 7-0. Councilperson Fetz made the motion to pass Ordinance No. 2009-OR-37, An Ordinance Transferring Certain Funds Within Same Department (General Fund -Police Department), on the second and third readings, second by Council President Sellers, passing on a vote of 7-0. Deputy Clerk Treasurer Hollis explained the need for passage of Ordinance No. 2009-OR-39, An Ordinance Transferring Certain Funds Within Same Department (Annexation -Police Merit Board). Councilperson Samuel made the motion to suspend the rules for Ordinance No. 2009-OR-39, second by Councilperson Grooms, passing on a vote of 7-0. Councilperson Samuel then made the motion to pass Ordinance No. 2009- OR-39 on all three readings, second by Councilperson Fetz, passing on a vote of 7-0. Councilperson Fetz reviewed the changes to Ordinance No. 2009-OR-36, An Ordinance Prohibiting Individuals That Are Required To Register Upon A "Sex Offender Registry" Either In Indiana Or Any Other State From Entering Public Property Owned By The City Of Jeffersonville. Councilperson Fetz then made the motion to pass Ordinance No. 2009-OR-36 on the second reading, second by Councilperson Zastawny, passing on a vote of 7-0. City Attorney Darren Wilder reviewed and discussed options with regard to Ordinance No. 2009-OR-40, An Ordinance Amending Ordinance 2007-OR-50 An Ordinance To Regulate The Use Of Legal Fireworks Within The City Of Jeffersonville. Councilperson Samuel voiced concern for the months not covered by the Ordinance. He feels the Ordinance is too restrictive. Councilperson Grooms noted the exclusion of Memorial Day. At the conclusion of all discussion, Councilperson Grooms made the motion to table Ordinance No. 2009-OR-40, second by Councilperson Fetz, passing on a vote of 7-0. Councilperson Grooms noted Ordinance No. 2009-OR-35, 2010 Salary Ordinance, includes a 3.8% increase. The Finance Committee recommends this Ordinance not be passed. Councilperson Grooms made the motion to pass Ordinance No. 2009-OR-35 on the third reading, second by Councilperson Zastawny, failing on a vote of 0-7. I October 19, 2009 4 CLERK TREASURER COMMENTS: There were no Clerk Treasurer comments. COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS: Councilperson Samuel appreciates the Jeff High students in attendance. Councilperson Grooms says thank you to Mat Owen and the Police for attendance. Councilperson Wilson thanked all for coming, reminding all about Halloween Downtown. Councilperson Smith will be reviewing Ordinance No. 2004-OR-22, regarding paper boxes. He noted one business has 12 boxes. Councilperson Zastawny said there has been some discussion regarding fitness testing for the Fire Department. He will bring this up in the next couple of months. Councilperson Fetz will schedule a water conservation system at the next meeting. Council President Sellers announced a Council workshop for November 2 at 6:00 P.M. She will send an email regarding Police and Fire Merit Board applications, as the appointments need to be made by the end of the first week in November. Mayor Galligan said work is being done on Market and Mulberry due to a sewer cave in. He explained the scenario. Mayor Galligan announced a restaurant is coming in on Court Avenue. It will be open in about six weeks. This is a positive in Jeffersonville. He is still working on a baseball complex. Mayor Galligan asked the students about the graffiti in the Parks. Student Spencer Whiteland commented about Police patrols. Councilperson Samuel noted the brim in front of the old Street Department has been started. He said thank you to Mayor Galligan. Mayor Galligan asked citizens to get the license number of cars that throw trash out and call the Police. All need to be more vigilant. October 1 ~, 2009 adjourned at 9:05 P.M.
