HomeMy WebLinkAbout07-31-1995cOUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA JULY 31, 1995 The Common Council of the City of jeffersonville met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, Indiana, at ?:30 P.M. on the 31st day of July 1995. The meeting was called to order by Mayor Jr., with Clerk and Treasurer C. Richard Spencer Mayor Parker welcomed all in attendances asking all stand as asked all Councilperson Steven Stemler gave the invocation. He those present to ~oin him in the pledge of allegiance to Raymond J. Parker Jr, at the desk. those present to then the flag. Bill Wilder, The roll was called and those present were Councilpersons Wolpert~ Andrew Williams Ills Donna M. Frantz, Peggy Knight Barbara Witsons Steven R. Stemler, and Robert L. Potter. Absent: None. Mayor Parker presented the minutes of the meetings of July 10 and July 13, 1995, for consideration by the Council. Councilperson Stemler made the motion to approve the minutes as presented, seconded by Councilperson Wolpert and carried unanimously. Clerk and Treasurer Spencer presented the claim list for the Council. Following all discussion, Councilperson motion to approve the claims as presenteds seconded indigent care and he feels this clinic is self-serving to the hospital. Ms. Hilton cannot speak for the hospital. Ms. Sharon Hilton of the Clark County Health Care Clinic explained the Clinic is doing something that needs to be done. The clinic does keep people out of the emergency room. The hospital has been very supportive. The grant funding is ending and Ms. Hilton is requesting SAOsO® from the County and $40,000 from the City. Other sources have been looked at. Mr. Charles Kenneth White stated Clark County Hospital has been given tax breaks as they are responsible for PAGE 8 JULY 31, 1995 Ordinance No. 95-0R-21, An Ordinance Vacating A Platted Easement On Lot ~104, Suburban Acres Subdivision~ Section 4, was presented for consideration. Mr. Greg Fifer~ Attorney representing B. C. Construction presented all supporting documentation, and explained the area. Building Commissioner Gavin said the area is not being used for drainage and never will be. Following discussion, Council President Wilder made the motion to suspend the rules for Ordinance No. 95-0R-21, seconded by Councilperson Potter, passing unanimously. Council President Wilder then made the motion to pass Ordinance No. 95-0R-21 on all three readings, seconded by Councilperson Williams, passing unanimously. Council President Wilder introduced Ordinance No. 95-0R-19, An Ordinance Deeming Offensive Odors A Nuisance stating there has been much discussion concerning an offensive odors ordinance that would not be vague, but would be an answer to the problems the City is experiencing. The Council does feel the problem is basically singular and does not want to introduce an Ordinance that is going to affect business owners that should not be affected. There are Ordinances on the books now that could be enforced. There is a Zoning Ordinance that says the same thing but has no penalties. Penalties need to be included in the Zoning Ordinance. The Legislative body does have power to assess penalties with the Zoning Code. She does believe the two Ordinance are saying the same thing. Council President Wilder then made the motion to defeat Ordinance No. 95-0R-19~ seconded by Councilperson Williams, and carried unanimously. Mayor Parker introduced and read aloud Resolution No. 95-R-15~ A Resolution To Enforce Current Odor And Nuisance Laws. Mayor Parker asked if there were any questions from the audience, explaining it is not the desire to distract any business or hurt the economic development of the area. Council President Wilder would like to see penalties imposed. Following discussion, Council President Wilder made the motion to pass Resolution No. 95-R-15, seconded by Councilperson Wilson, passing unanimously. PAGE 3 JULY 31, 1995 Attorney Gillenwater introduced Ordinance No. 95-0R-22, An Ordinance Changing Zoning On One Parcel Within The City Of Jeffersonville (5013 East Highway 62)7 explaining this has been passed by the Plan Commission and properly advertised. Attorney Virgil Bolley explained the area is changing in character. Council President Wilder explained there were no objections meeting. Attorney Gillenwater explained there have been numerous contacts with Mr. Thorpe~ owner of Falls City Roofing Co. Mr. Miller, PAGE 4 JULY 31~ 1995 Mr. Lakeman, and Mr. Mara have been in the area. Many promises have been made by Mr. Thorpe. The only improvements that have been made are that the field has been cut and some tires have been stacked, however the ditch has not been cleaned. Attorney Gillewater explained the drainage Ordinance which Mr. Thorpe has been cited under talks about developers of subdivisions- It is not sure this is in a subdivision. The weed Ordinance would require he cut to 8 inches, but would not require dredging the ditch which is needed. Attorney Gillenwater has presented the Council with a first draft of an Ordinance requiring property owners to maintain drainage ditches and easements on their properties. This would give the City Engineer the right to inspect and be similiar to the one with regard to keeping grass cut. Mr. Thorpe has complained to Engineer Miller that Attorney Gillenwater calls him too much with regard to the problem. Councilperson Frantz believes it is past time to get this into court. Following all discussion, Councilperson Wilson made the motion to pass Ordinance No. 95-OR-RA, An Ordinance Requiring Maintenance Of Drainage Ditches And Easements on the first and second reading, seconded by Councilperson Frantz. Attorney Gillenwater explained this will allow the imposing of a fine and will give the right to go on the property to inspect, and allow for the request of a court order. This will be a powerful tool. Engineer Miller explained there is only a six inch fall from Kehoe Lane to the floodwall. There are Ordinances but not the fall~ which is that deal with width and debth of ditches most important. To correct this problem would involve "big bucks". Council President Wilder then made the motion to suspend the rules for Ordinance No. 95-0R-26~ An Ordinance Fixing Basic Salaries Of Appointed Officers And Employees Of The City Of Jeffersonville~ Indiana For The Year 19967 seconded by Councilperson Frantz, passing unanimously. Council President Wilder then made the motion to pass Ordinance No. 95-OR-R6 on all three readings~ seconded by Councilperson Frantz, passing on the following roll call vote: Ayes: Councilpersons Wilson, Stemler, and Potter. Nays: None. Council President down again this year. Councilperson Williams made the motion to approve the advertisment as prepared by Clerk and Treasurer Spencer, seconded by Council President Wilder, and carried unanimously. Councilperson Williams then made the motion to authorize Council President Wilder to advise the Clerk and Treasurer of minor changes~ seconded by Councilperson Wolpert and carried unanimously- There being no further business to come before the Council, Councilperson Potter moved to adjourn at 8:55 o'clock P.M. seconded by Councilperson Wolpert and unanimously carried.
