To Whom It May Concern:
Please consider this letter as my Notice of Claim in accordance with the Indiana
Tort Claims Act. In accordance with the Act, please accept the following:
This letter is to put the City of Jeffersonville on notice, at this time I am seeking a
monetary settlement of $ 25,000 to cover losses of property, mental and physical
anguish and damages to my home at 1012 Springdale Drive. On August 04, 2009 raw
sewage flooded my basement, causing my family to evacuate as instructed by city sewer
workers because of toxic gases.
With the waste floating in my basement sanitary napkins, toilet paper, solid feces and
sludge. This problem had never happened before the sewer maintenance project. I feel
the lack of communication, training and possible disregard for Indiana OSHA
regulations/requirements by not having the bypass pump that was on the location,
hooked up to the temporary lines for such an emergency was; a major factor of the
tragedy on 08/4/2009 .
Once the city workers turned on the pump, all waste water started receding leaving the
sludge, solid waste and debris behind, but this wasn't attempted till after we had 7"-8"
of sewage .We have had hard street flooding rains in the past 8 years of our living at this
residence with no flooding of sewage.
This neglect has caused undo emotional stress on me and my family, with loss of two full
rooms of furniture, displacement of my son whom resided in the basement while
attending college, tearing out walls, paint peeling off of the floors due to the toxins in
the sewage.
As of the date this letter is being prepared I have had to drain my savings and get in my
retirement with stiff penalties, and use my charge cards for building materials to rebuild
and restore my property, not even able to replace lost furniture and clothing at this time
a shower also has to be taken out and replaced in the basement.
Electric bill tripled in August due to the heavy dryers and blowers, pressure washer's
used to decontaminate the property, and special suits were purchased for family
members so property could be removed from the basement. It is my feeling and belief
the Mayor of the City of Jeffersonville, and Sewer Department should take full
responsibility of this event due to the possible neglect of its employees, and or faulty
equipment. This is what I was told the city carries insurance for, their mistakes and
accidents.
