HomeMy WebLinkAboutRules, Procedures & Polices ~~~~ ~ ~~~~~~~ J~~~ ~~ ~~~~~ .~~ o,~ '~~ O N' W J JL~~ l~J-+ ~vJ ~1.J SECTION 1 -INTRODUCTION The City of Jeffersonville storm water user fee is a mechanism for recovering the cost of operating and maintaining the City's storm water management system, which includes funding the necessary capital improvements, repairs, replacements, and extensions of the City's storm water management system. The basis for the credit system is the implementation of storm water management controls that are designed, operated and maintained to treat storm water runoff and/or to mitigate the effects of increased storm water runoff rate, volume and velocity due to impacts of impervious areas as a result of development and redevelopment. The purpose of the storm water credits program is to enable non-residential parcel owners to seek a reduction in storm water charges, if specific value-added onsite storm water control measures have been implemented. The onsite storm water management measures need to significantly reduce the volume of runoff into the City's sewer system and/or enhance the water quality in the surface water bodies into which a parcel's runoff discharges. Storm water credits are associated with the construction, operation and maintenance of privately owned storm water facilities that compliment the City's storm water management efforts and benefit the City's Combined Sewer Overflow mitigation, storm water and surface water quality management activities. SECTION 2 -CREDITS TO STORM WATER USER FEES Credits to storm water user fees are available to owners of non-single family residential properties who implement onsite storm water management controls. There are three types of credits: 1. Direct Discharge Credits are available to properties that discharge their storm water into designated major waterways rather than the public drainage system. 2. Quantity Reduction Credits are available to those properties that control storm water runoff entering into the City's storm sewer system or surface water system (rivers, streams, etc). 3. Quality Control Credits are available on a case-by-case basis for parcels that implement Best Management Practices (BMP) to effectively control pollutants in runoff and to enhance water quality, such as, but not limited to: Green roofs Pervious pavement Vegetated swales Street swales Biofiltration Sand filters Dry detention ponds Rainwater harvesting Manufactured technology Roof gardens Tree planting Grassy swales Vegetated filter strips Vegetated infiltration basins Wet, extended wet, detention ponds Storm water wetlands Structural detention facilities 1 Credits will not be provided for storm water management systems that are under construction and/or are not fully functional and/or are not properly maintained. Also, design professionals shall take into consideration the location of the BMPs in relation to Wellhead Protection Areas. A. DIRECT DISCHARGE CREDITS The Direct Discharge Credit is available to properties which are contiguous to (or contain) a major waterway and discharges treated storm water runoff directly into the major waterway. Runoff that passes through a public storm water facility prior to outfalling to a major waterway is not considered direct discharge. Proportionate Direct Discharge Credit will be granted only for that portion of the property's impervious surface area that discharges directly into Silver Creek or the Ohio River. B. QUANTITY REDUCTION CREDITS Water Quantity Credits are available to properties whose peak storm water runoff rate is restricted and/or controlled through onsite facilities such as detention and retention ponds or chambers that are designed, constructed and maintained according to the City of Jeffersonville's Drainage Ordinance. Quantity Reduction Credits are offered to customers that control the post-development peak rates of storm water runoff at the pre-development rates for the two (2), ten (10), and one hundred (100) year design storms and have either or both of the following: 1. Additional Rate Reduction Credit (ARC) is available for storm water facilities that reduce the peak flow rate of storm water runoff in the post-developed condition at least 10% below the pre-development rates. This additional reduction in runoff rates is beneficial to the City because it allows the downstream system to convey runoff from larger storm events more efficiently. 2. Additional Volume Credit (AVC) is offered to customers that provide at least 10% additional volume in their detention facilities beyond City requirements. This additional volume is beneficial to the City because it provides storage to protect downstream properties from even larger storm events and/or from neighboring upstream properties that drain through the customer's property. C. QUALITY CREDITS Quality Credits (QC) are offered to properties that discharge a portion of the runoff to structural or non-structural BMP infrastructure, which significantly reduce pollutants in storm water runoff. The maximum aggregate allowable storm water credit for quantity and quality reduction is 30%. The following table is a percentage breakdown of the considered criteria. 2 Maximum Allowable Criteria Credit Direct Dischar a Credit 5 Additional Rate Reduction Credit 9 Additional Volume Credit 8 Water Qualit Credits 8 Total 3U"/o A credit application will not be considered complete and will not be processed unless accompanied by anon-refundable fee of $200.00. If the application fee check submitted is uncollectible, the review process will no longer continue until a valid application fee is credited. Any storm water credit that is provided to a parcel is contingent on continued maintenance and operation of the private storm water facilities or devices, as stipulated by the Jeffersonville Drainage Board. The City may revoke the storm water credits at any time for non-compliance. The approved credits are valid for atwo-year period. Renewal of the credits is contingent on the applicant submitting a Storm Water Credits Renewal Application accompanied by a non- refundable re-filing fee of $100. SECTION 6 -BURDEN OF PROOF The burden of proof shall be on the applicant to demonstrate the validity of the credit application by providing clear and convincing evidence. SECTION 7 -RIGHT-OF-ENTRY Following submission of a storm water credits application, the City shall have an automatic Right-of-Entry into the parcel, following notice to the parcel owner, for the sole purpose of inspecting the facility/structure or system in the parcel for which the fee adjustment appeal is requested. The applicant applying for storm water credits for one or more parcels must adhere to the following credit request application stipulations. To receive storm water credits, the process must be initiated by the applicant. The applicant must submit a completed Storm Water Credits Application if applying for the first time or a fully completed Storm Water Credits Renewal Application if applying for renewal of credit. The 3 application must be accompanied by the appropriate application fee and supporting documentation. • •' ~• ~ • The applicant must provide the following technical documentation: 1. Conceptual site plan and structural control location diagram showing the site, topographic detail, overland flow paths, all storm water facilities, and surrounding area. Existing construction plans can be used, but it must be verified that it was built according to the approved plans. 2. Maps with locations, dimensions and characteristics of existing and proposed storm drainage patterns and facilities. 3. Topographic map outlining the size of the drainage area upstream of the developed parcel 4. Maps indicating existing and proposed grading and location of all structures including building, parking, driveway, paving and other impervious areas. 5. Detailed engineering calculations that show the comparative results of pre-development runoff to post-development runoff that is routed through the storm water control structures. 6. As-built construction drawing for new construction and/or retrofitted existing construction. The required technical documentation listed must be certified by a registered professional engineer or registered land surveyor. ~ 1 ~ The applicant can apply for first time storm water credits at anytime. However, storm water credit renewal applications must be filed by June 1S' of the bi-annual renewal period. • ~ • The Jeffersonville Drainage Board will review and send a written disposition to the applicant, with a copy to the Board of Public Works, within 60 days of the receipt of the fully completed credits request package. In the event the applicant does not agree with the Board's fee determination methodology, the applicant can make an informal attempt to negotiate a fee acceptable to the City. If an acceptable fee cannot be resolved between the applicant and the City, the procedure for appealing the Board's credit determinations is set out in Section 4(b) or Ordinance 2000-OR-40. • ~ ~ • • ~ ' Note: All storm water utility charge credit calculations shall reflect apre-development land use without development and/or prior to any land disturbing activities (i.e. clearing, grading, existing development, addition of impervious surfaces, etc.). 4 Drainage Unit (DU) - A unit value, equal to the average amount of impervious area of a single family residential property with the City, established at 2,500 square feet of (measured) impervious area. It is the base billing unit for assessment of storm water charges to all users. A. Direct Discharge Credit (DDC) Proportionate DDC may be granted for that portion of the property's impervious surface area that discharges directly into Silver Creek or the Ohio River. Runoff that passes through a public or private drainage way prior to outfalling to said waterways is not considered direct discharge. Maximum Credit Amount: 5% Direct Discharge Credit = (Qualifying Impervious Area SF)/ (2,500 SF/DU) x 0.05 B. Additional Rate Reduction Credit (ARC) This type of credit is available for storm water facilities that reduce the peak flow rate of storm water runoff in the post-developed condition at least 10% below the pre-development rates. 2-year post-development rate is 10% less than the 2-year pre-development rate = 3% ARC 10-year post-development rate is 10% less than the 10-year pre-development rate = 3% ARC 100-year post-development rate is 10% less than the 100-year pre-development rate = 3% ARC Maximum Credit Amount: 9% (taken from the original drainage unit amount) C. Additional Volume Credit (AVC) This type of credit is offered to customers that provide at least 10% additional volume in their detention facilities beyond City requirements. This additional volume is beneficial to the City because it provides storage to protect downstream properties from even larger storm events and/or from neighboring upstream properties that drain through the customer's property. A credit amount of 8% can be deducted from the original DU amount when the designed storage volume is 10% greater than what is required to detain the difference between the pre- developmentand post-development 100-year storm event. D. Quality Improvement Credit Property owners of private BMPs constructed according to the approved drainage plans may be eligible for credit. Maximum Credit Amount: 8% (aggregate total for all BMPs, not each individual BMP) Quality Improvement Credit = (Qualifying Impervious Area SF)/ (2,500 SF/ESU) x 0.08 5 PASSED AND ADOPTED this 7th day of July, 2009, by the following vote of 7-0.
