HomeMy WebLinkAbout06-19-1995COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE~ INDIANA JUNE 19, 1995 The Common Council of the City of Jeffersonville met in regular session in the Multi-Purpose Meeting Room in the City-County Building~ Jeffersonville~ Indiana, at 9:30 P.M. on the 19th day of June 1995. The meeting was called Jr., with Deputy Clerk Barbara welcomed all in attendance, Councilperson Steven Stemler those present to join him in to order by Mayor Raymond J. Parker Hollis, at the desk. Mayor Parker asking all those present to stand as gave the invocation. He then asked all the pledge of allegiance to the flag. Mayor Parker presented the minutes of the 1995, for consideration by the Council. motion to approve the minutes as meetings of June Councilperson Potter made presented, seconded by Councilperson Wolpert and carried unanimously. Clerk Hollis presented the claim list for consideration by the Council. Following all discussion, Councilperson Stemler made the motion to approve the claims as presented~ seconded by Council President Wilder and carried unanimously. Mayor Parker introduced Mr. Joe LaRocca and Ms. Barbara Williams of the Jeffersonville Y.M.C.A. Ms. Williams explained the Jeffersonville Y.M.C.A. is in its 25th year and has been in the present building for 20 years. She gave a personal history of her family's involvement in the Y. The Y is the largest provider of child care in Southern Indiana serving the needs of families and children She does assure the Council the Y is in good fiscal shape. Mr. LaRocca stated the Y is youth directed serving close to 500 kids a day during the summer. The Y is embarking on an expansion program which he explained. The Clark County Commissioners have donated $5~000 to the building fund and have challenged others to meet this amount. Attorney Gillenwater will incorporate a rate schedule and bring this back to the next Council meeting. Ordinance No. 95-0R-19, An Ordinance Deeming Offensive Odors A Nuisance~ which has passed on one reading, was introduced for discussion. Attorney Gillenwater explained the $2,500 fine could be imposed each day and this would be done through City Court. Councilperson Frantz wants to make sure someone documents complaints. City Services Director Les Kavanaugh presented four model Ordinances from Michigan and Florida found in Indiana. There enforceable. PAGE 3 JUNE 19, 1995 Councilperson Wilson made the motion to pass Resolution No. 95-R-12~ seconded by Councilperson Stemler~ passing unanimously. Council President Wilder initiated discussion regarding the R-Mile Fringe concept with regard to Louisville Barrel. Attorney Gillenwater explained there is a vague law that allows the Council to pass zoning regulations within a 2 mile radius of the City. These regulations would apply within the City as well as in the 2 mile area. These regulations would apply to new development only and may be challenged as the law is so vague. Council President Wilder said she is personally willing to take this chance as she represents a district that will be affected by Louisville Barrel if the same problems arise as Louisville has had. Attorney Gillenwater recommends the Plan Commission present an Ordinance to the Council for passage. Another option is to reconsider the whole 2mile fringe concept. Mr. Sommerville said Louisville imposed a $2~500 a day fine on Louisville Barrel and they closed because of this. Mr. Sommerville said odor is only a part of the problem, water pollution is also a problem. Councilperson Stemler feels there is a need to understand the 2-mile fringe concept as incorporated in the Mater Plan. He also feels a need to watch the cost of an interlocal agreement. Attorney Gillenwater said the long-term sollution is to change the State law and suggests looking into next year for legislation. Council President Wilder agrees the 2 mile fringe situation has been frustrating. It would be good if it could be enforced. Attorney Gillenwater explained Louisville Barrel may develop the property within the present zoning ordinance. Councilperson Wilder reports Louisville Barrel has incorporated in Indiana, however they have not received any permits. Mr. Sommerville received a call from the State Air Pollution Inspector who has been directed to look into the Louisville Barrel situation. Wastewater Treatment Plant Manager Kendall Coleman explained the procedure to receive a tap in permit. This is a lengthy procedure. Councilperson Stemler reported the second Target Industry Analysis have been completed. He reviewed what was included in the report and will forward copies to each Councilperson. Councilperson Stemler has been working with Counciiperson Wolpert on an Insurance audit. There is now a need for a cost estimate. He asks for agreement to have a firm look into the general records to be able to give an estimate. This will not involve any employee personal information. Councilperson Potter said the Hospital does intend to landscape some of this area. Councilperson Frantz inquired if anyone in the City is aware of receiving 2 million dollars from the Lottery. There was no answer to this. Council President Wilder said the budget calendar has been recieved and distributed. She suggests limiting the Council meetings in July to July 31 only. The first budget work session scheduled for July 10 will dedicate the first one half hour to the passage of claims and any other necessary business. 1995. The mosquotes are so bad you cannot go outside. Ms. Bratcher explained 15 years is enough and it is lucky no child has been hurt. She requests fines be levied. Some residents have lost 15 feet of property and some have threatened gasing it. They just can't take another summer of this. Councilperson Wilson has talked with Commissioner Trembly and Engineer Miller and she will pursue the PAGE 6 JUNE 19, 1995 situation. Engineer Miller has looked at the area and has contacted Mr. Thorpe and was assurred he will get rid of the tires and clean the ditch~ however nothing has been done. Councilperson Wilson will stay on this as it is long overdue. Attorney Gillenwater will get Commissioners Gavin's file and call and give an ultimatum or it will be taken to court. Engineer Miller said it will take an excavator and a dump truck.
