The Common Council of the City of Jeffersonville met in Special Session on Monday,
August 31, 2009. Council President Connie Sellers called the meeting to order, and on
call of the roll those members present were: Councilpersons Mike Smith, Keith Fetz,
Connie Sellers, Barbara Wilson, Nathan Samuel, Ron Grooms, and Ed Zastawny. Also
present were Council Attorney Gregory Clark, City Attorney Darren Wilder and Chief
Deputy Clerk Treasurer Suzy Bass.
Councilperson Wilson made the motion approve the agenda removing the New World
Software item, second by Councilperson Grooms and passed unanimously.
Ordinance 2009-OR-31
City Attorney Darren Wilder presented Ordinance 2009-OR-31 for consideration on the
2"d & 3`d reading. After discussion, the motion was made by Councilperson Smith to
pass 09-OR-31 on the 2"d reading with the following amendments: Add language to
ensure it reads `capacity of 96 lbs or less; if more than 3 receptacles are used, there will
be a fee assessed for those in excess of 3 or more; section on notification by phone, to
include verbiage `by telephone, email, or in person'. The motion was seconded by
Councilperson Wilson to approve on the 2"d reading with the above amendments and
passed 7-0.
Contract for Legal Services
The Contract for the new Council Attorney was presented. Councilperson Grooms made
the motion to approve the contract with the following changes: 2"d paragraph change the
word "mayor" to "City Council"; under Financial Terms, 2"d paragraph insert `itemized
statement "to each Councilmember"'; under Financial Terms add verbiage #4 The
Attorney shall not be eligible for fringe benefits; under Fiduciary Duty delete #3. The
motion was seconded by Councilperson Wilson, passing on a vote of 7-0.
Councilperson Samuel made the motion to adjourn at 7:05 P.M., second by
Councilperson Smith, passing on a vote of~6-8, ~},
