HomeMy WebLinkAboutAugust 17, 2009A COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA August 17, 2009 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M. on Monday August 17, 2009. Mayor Tom Galligan, with Clerk Treasurer Peggy Wilder at the desk, called the meeting to order. Also present were City Attorney Darren Wilder, Deputy Clerk Barbara Hollis, and Administrative Assistant Laura Boone. Mayor Galligan welcomed all in attendance, asking all those present to stand as Reverend Conrad Moorer gave the invocation. Mayor Galligan then asked all those present to join him in the pledge of allegiance to the flag. Mayor Galligan noted Councilperson Ron Grooms is in another meeting and will arrive late. The roll was called and those present were; Councilpersons Mike Smith, Ed Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, and Nathan Samuel. Absent: Councilperson Ron Grooms Councilperson Samuel made the motion to approve the agenda, second by Councilperson Fetz, passing on a vote of 6-0. Mayor Galligan presented the minutes for consideration. Councilperson Wilson made the motion to approve the minutes of June 15, 2009 (7:30 P.M.) second by Councilperson Samuel, passing on a vote of 6-0. Councilperson Wilson made the motion to approve the minutes of July 6, 2009 (7:30 P.M.), second by Councilperson Zastawny, passing on a vote of 6-0. Councilperson Wilson next made the motion to approve the minutes of August 3, 2009 (6:00 P.M.) as presented, second by Councilperson Samuel, passing on a vote of 6-0. Councilperson Wilson made the motion to approve the minutes of August 3, 2009 (7:30 P.M.) as presented, second by Councilperson Fetz, passing on a vote of 6-0. Deputy Clerk Hollis presented three claim lists for consideration by the Council. Councilperson Samuel made the motion to preapprove the Park claims in the amount of $39,17.20, as presented, second by Councilperson Zastawny, passing on a vote of 6-0. A August 17, 2009 2 Councilperson Fetz made the motion to approve the regular claim list, second by Councilperson Smith, passing on a vote of 5-l. Councilperson Zastawny voted in opposition as the list contained a claim for Quarry Road in the Major Moves Fund. Deputy Hollis explained the Riverstage claim list. Councilperson Samuel questioned the claim to Roger Hardy for the website work. Following discussion, Councilperson Fetz made the motion to approve the claims, with the table of the claim to Roger Hardy, second by Councilperson Zastawny, passing on a vote of 6-0. PUBLIC COMMENT: Brent Mode, Boy Scout from Troopl, presented before, during, and after pictures of Espy Family Cemetery at Vissing Park. Scout Mode made this an Eagle Scout project. He expressed thanks to Troop 1 Scouts, his family and friends. He also thanked the Parks Department and the Parks Authority. Parks Authority Vice President Samuel presented the Thomas Jefferson Award to Scout Mode. The Council expressed appreciation. COUNCIL COMMENT: There was no Council comment. DEPARTMENT HEAD REPORTS: There were no Department Head reports. AGENDA ITEMS: Jack Vissing, Attorney, explained the need for passage of Ordinance No. 2009- OR-30, An Ordinance Changing The Zoning Map Of 828 & 830 Watt Street From R:3 Old City Residential To IS: Institutional. Mayor Galligan requested public comment. No comments were heard. Councilperson Fetz noted no objections were received at the Plan Commission Meeting. Councilperson Fetz made the motion to pass Ordinance No. 2009- OR-30, second by Councilperson Wilson, passing on a vote of 6-0. Councilperson Fetz presented Resolution No. 2009-R-9, A Resolution Replacing 2008-R-39 Requiring The City Of Jeffersonville, Indiana To Undertake Steps To Operate Executive And Legislative Government In An "Earth Friendly, Responsible" Manner And Fashion. He had asked for and received changes from Councilperson Samuel. Councilperson Fetz made the motion to pass Resolution No. 2009-R-9, second by Councilperson Samuel, passing on a vote of 6-0. August 17, 2009 3 City Attorney Darren Wilder presented Ordinance No. 2009-OR-31, An Ordinance Amending Ordinance 2009-OR-51, An Ordinance Regarding Refuse/Garbage Collection, explaining the need for future changes. Following discussion, Councilperson Zastawny made the motion to pass Ordinance No. 2009-OR-31 on the first reading, second by Councilperson Samuel, passing on a vote of 6-0. Deputy Hollis explained the options for payment of the Riverstage claims. Following discussion, Councilperson Samuel made the motion to suspend the rules for Ordinance No. 2009-OR-32, An Ordinance Transferring Certain Funds Within Same Department (Cumulative Capital Development Fund), .second by Councilperson Fetz, passing on a vote of 6-0. Councilperson Samuel then made the motion to pass Ordinance No. 2009-OR-32 on all three readings, second by Councilperson Fetz, passing on a vote of 6-0. Resolution No. 2009-R-13, A Resolution Welcoming The USS LST Ship Memorial And Her Crew To The Port Of Jeffersonville, Indiana was introduced. Communication Director Larry Thomas explained the LST schedule, and planned activities. Councilperson Zastawny made the motion to pass Resolution No. 209-R-13, second by Councilperson Samuel, passing on a vote of 6-0. Mayor Galligan noted, "This will be a class event". Council President Sellers explained the need for passage of Ordinance No. 2009- OR-33, An Ordinance Amending Ordinance 2009-OR-13, Which Amends 2008-OR-57, An Ordinance Establishing Departmental Petty Cash And/Or Cash Change Funds. Councilperson Zastawny made the motion to suspend the rules for Ordinance No. 2009- OR-33, second by Council President Sellers, passing on a vote of 6-0. Councilperson Zastawny then made the motion to pass Ordinance No. 2009-OR-33 on all three readings, second by Council President Sellers, passing on a vote of 6-0. CLERK TREASURER COMMENTS: There were no Clerk Treasurer Comments. COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS: Councilperson Samuel thanked Councilpersons Sellers, Fetz, and Wilson for their work on the Council Attorney selection committee. Councilperson Smith made the motion to appoint Greg Clark as Council Attorney, second by Councilperson Samuel, A August 17, 2009 4 passing on a vote of 6-0. Councilperson Samuel has received the proposed 2010 Police Merit Board budget and will forward it on. Councilperson Samuel asked for a Police software demonstration. Next, Councilperson Samuel reported the Redevelopment Commissions has agreed to restructure until the end of the year as a trial. He then asked about a berm for 10`h and Meigs. Mayor Galligan noted with all the recent flooding he has not been able to get to it. Councilperson Wilson thanked Clerk Treasurer Wilder for getting the plague ready. The Concerts In The Park are drawing to an end. They have been great. Councilperson Smith voiced concern for paying claims timely, as the next scheduled meeting is not until September 14, 2009. The Council will meet August 31, 2009 at 7:30 PM. Councilperson Smith urged all to get a copy of Snapshot magazine. It is very interesting. He has found the City does have three defibrillators, one at Nachand Fieldhouse, one at the Keri Ellis Center, and one at the Aquatic Center. These have never been used or tested. He will see that they get mounted and testing scheduled. Councilperson Zastawny has discussed sidewalks with Josh Hillman of Jacobi, Toombs, and Lanz. An update will be scheduled. Mayor Galligan noted the need for curb and gutters on Kewanna. Councilperson Fetz has received interest in the Sustainable Jeffersonville Committee. The first meeting will be Monday, August 24, 2009 at 6:00 P.M. in the Council Conference room. Councilperson Fetz noted the recent passing of the mother of two City employees. Mayor Galligan noted the recent 1,000-year flood in Jeffersonville. It was interesting to see all the problems and not have the ability to do anything. It was a helpless feeling. He has never seen Jeffersonville flooded like that. There was a lot of damage. FEMA representatives were in town today. Jeffersonville experienced two more inches of rain last Monday and more flooding. There are a lot of thing to correct. Tickets will be issued to those that drive around barricades during flooding. Two people were trapped in an apartment and two firefighters were injured rescuing them. Preparations can never be made fora 1,000-year flood. There were no fatalities. Mayor Galligan welcomes the Dooleys back. August 17, 2009 5 Councilperson Grooms arrived, explaining he has been in the building, working on another project and apologizes for missing the meeting. Mayor Galligan noted that due to the efforts of Councilperson Grooms, the Solid Waste District has done well. Anew Executive Director has been named.
