HomeMy WebLinkAbout01-17-1995COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA JANUARY 17, 1995 The Common Council of the City of jeffersenville met in regular session in the Multi-Purpose Meeting Room in the City-County Building, jeffersonville, Indiana, at 9:30 P.M. on the l?th day of January 1995. The meeting was called to order by Mayor Raymond J- Packer Jr., with Clerk and Treasurer C. Richard Spencer Jr~ at the desk. Mayor Parker welcomed all in attendance, asking all those present to stand as Councilperson Steven Stemler gave the invocation. He then asked all those present to join him in the pledge of allegiance to the flag~ The roll was called and those present were Councilpersons Bill Wolpert~ Andrew Williams III, Donna M. Frantz~ Peggy Knight Wilder~ Barbara Wilson~ Steven R. Stemler, and Robert L. Potter. Absent: None. Mayor Parker presented the minutes of the meetings of December 19, 1994 and January 3, 1995, for consideration by the Council. Councilperson Potter made the motion to approve the minutes as presented, seconded by Councilperson Wolpert and carried unanimously. Mr. Bob Lanum~ Attorney for Hubers, Zurschmeide~ and Koetter, presented a proposal for changing the zoning of two parcels in the fringe area of the City of Jeffersonville. Nays: Councilperson Wilder. Clerk and Treasurer Spencer explained Ordinance No. 95-0R-8~ An Ordinance Transferring Certain Funds Within Same Department, (Cumulative Capital Development, Local Roads and Streets, Planning and Zoning). The Council was asked to add the transfer in the amount of $8~0 for Social Security in Planning and Zoning to the Ordinance previously distributed. These transfers are leftover from the budget. Councilperson Stemler made the motion to suspend the rules for Ordinance No. 95-0R-8, seconded by Councilperson Wolpert, passing unanimously. Councilperson Stemler then made the motion to pass Ordinance No. 95-0R-8 on all three readings, seconded by Councilperson Wolpert, passing on the following roll Ayes: Councilpersons Wilson, Stemler~ and Potter. Nays: None. Clerk and Treasurer 95-0R-3~ An Ordinance Amending Ordinance No. 94-0R-24 Wolpert, Williams~ call vote: Frantz~ Wilder, discussion Councilperson Potter made the motion to for Ordinance No. 95-0R-3, seconded by Councilperson Wolpert carried unanimously. Clerk and Treasurer Spencer explained ne elected officai salary ordinance has been passed since salary is the same as the 1989 ordinance. PAGE A JANUARY l?~ 1995 Councilpersons Potter, Stemler~ and Wilson have met on the Inner City Road and have scheduled another meeting for February 1995. Councilperson Stemler explained Mr. Nichols has been given a 30-day window to sign the composting contract. Councilperson Wilson has been informed by Park Superintendent Poole the large tree will be in place in Warder soon. Councilperson Frantz has been asked why so many Louisville animal clinics are being used. Amimal Director Voyles explained this is a voucher plan and the clinic is the choice of the adopting family. Councilperson Frantz has also received calls regarding the smell from the old sewer plant. She believes something has to be done. Mayor Parker explained alt complaint calls received in his office are documented and Industrial Water Recycling has been warned. Attorney Gillenwater stated it would seem the biggest tool the Council has is the tax abatement. Councilperson Frantz would like to see this taken up at the next Board of Public Works as there needs to be a remedy for this problem. Mayor Parker suggests a written warning from the Board of Public Works. Councilperson Williams would like to see the Council continue to plan for additional capital purchases. There is a need need a for a third s~reet sweeper and the Fire Department does replacement for an old fire truck. He requests a formal request for funding from Chief Dooley. Councilperson Williams would like a status report of the potential cave in at 8th and Meigs. Council President Wilder announced a Council goals workshop for Saturday, January 21, 1995 at 8:30 A.M. in the Mayor's Conference Room. She also reminded the Council they have an appointment for the Plan Commission and the Solid Waste Management District Board. Ms. Ida Callahan has definite concerns for using T.I.F. bonds for the Inner City Road as this will have to be paid for by our children. She also feels this road will only shift business to Clarksville. She would like to see Holmans Lane widended all the way and widen Hamburg Pike. This would get rid of the inner city problem. She tries to go to Jeff first as there are nice businesses in Jeff that need to be patronized. PAGE 5 JANUARY 17~ 1995 Mr. M. L. David~on expressed concerns regarding the rezoning of the Zurschmeide Property. Mr. Davidson said this ground is already residential and it is a covenant deed that it stay residential. There is concern for the drainage as there are no storm area to could not be changed Mr. Fleix Sontiago this will be a detriment to He fears a domino effect for the residential property in the go commercial. He fears there would not be a subdivision that to meet their own purposes- opposses the rezoning also. He believes the value of the property and he fears traffic and drainage problems- He does not want a commercial development in his backyard. Mr. Frank Paxton, a resident of Hoskins Drive~ opposses the zoning change. As Holmans Lane is all residential~ he suggests the development of Highway 62 or the Armstrong property. Nu-Yale ran him out of Eaetgate. He invites the Council to come to Hoskins Drive to see the tranquility- Mr. Paxton does not want this taken away. Ms. Sandra Paxton of Hoskins Drive also referenced the "Nu-Yale mess" and all the problems. She believes taking an additional 24 feet of Holmans Lane is a hazard to homes and the children. Mr. Michael Kopp opposses the owners know exactly what the plans are for change will cause the people to move out. rezoning- He feels the the property. He believes He also does not want this in his backyard- There being no further business to come before the Council, Councilperson Potter moved to adjourn at 8:45 o'clock P.M. seconded by Councilperson Wolpert and unanimously carried- ~JR. ATTES]P~ ~ ~ AFFIDAVIT I, L. R. Inman, being duly sworn on my oath, say as follows: 1. I am a resident of jeffersonville, Indiana, and a residential developer. 2. I have developed and constructed residential duplex units on Holmans Lane within the past year. 3. As a residential developer in the area surrounding the property owned by the Hubers and Koetters currently before the City Council for rezoning to B-2, I have no objection to said rezoning. 4. As a realtor and residential developer, I do not believe that the rezoning of the site to B-2 Service Business will materially affect the value of the surrounding real estate. 5. I further testify that this rezoning would not alter the essential character of the locality and would not be contrary to the public interest. 6.
