HomeMy WebLinkAbout12-02-1996coUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA DECEMBER 2, 1996 The Common Council of the City of Jeffersonville met in regular session in the Multi-Purpose Meeting Room in the City-County Building, jeffersonville~ Indiana, at 7:21 P.M. on the 2nd day of December 1996. The meeting was called to order by Mayor Thomas R. Galligan, with Deputy Clerk Barbara Hollis at the desk. Mayor Galligan welcomed all in attendance, asking all those present to stand as Councilperson Ron Ellis led all in the Lord's Prayer. He then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were Councilpersons John Perkins, Ron Ellis, Donna M. Frantz, Peggy Knight Wilder, Barbara Wilson, and Andrew Williams III. Absent: Councllperson Vlcky Conlin. Mayor Galligan presented the minutes of the meeting of November 18, 1996 for consideration by the Council. Councilperson perkins made the motion to approve the minutes as presented, seconded by Councilperson Wilson and carried unanimously. Deputy Hollis presented the claim list for consideration by the Council. Following all discussion, Councilperson Perkins made the motion to approve the claims as listed, seconded by Council President Ordinance Williams, passing unanimously. Deputy Hollis presented and explained Ordinance No. ~ Certain Portions Of Section 1 of 96-OR-95, An Ordinance Amending No. 95-OR-25 (Animal Shelter) Following all discussion, PAGE 2 DECEMBER 2, 1996 Councitperson Frantz made the motion to table Ordinance No. seconded by Councllperson Wilder, passing unanimously. Deputy Hollis presented and explained 96-OR-96, An Ordinance Transferring Certain Funds 96-OR-95, Ordinance No. Within Same Department Ordinance (Animal Shelter). As this Ordinance is a companion to 96-OR-95, Councllperson Wilder made the motion to table Ordinance No. 96-OR-96, unanimously. Deputy Hollis seconded by Councilperson Frantz, passing presented and explained Ordinance No. 96-OR-97, An Ordinance Transferring Certain Funds Within Same Department (Motor Vehicle). Street Commissioner Trembly explained the transferred money would be used to purchase one of three equipment options. Any funds remaining in the Motor Vehicle Fund would revert to the Motor Vehicle Fund balance and would not revert to the General Fund. Councllperson Wilson made the motion to suspend the rules for Ordinance No. 96-OR-97, seconded by Councilperson Frantz, passing unanimously. Councllperson Wilson then made the motion to pass Ordinance No. 96-OR-97 on all three readings, seconded by Councilperson Frantz, passing unanimously. Deputy Mayor Phil McCauley presented and explained Resolution No. 96-R-46, A Resolution Of Interest In Making Purchase Of Land. Councllperson Perkins made the motion to pass Resolution No. 96-R-46, seconded by Council President Williams. The motion passed on a vote of 5-0-1. Councilperson Wilder abstained. PAGE 3 DECEMBER 2, 1996 Deputy Mayor Phil McCauley presented and explained Resolution No. 96-R-47, A Resolution Of Interest In Making Purchase Of Land For Animal Shelter. Deputy McCauley explained two appraisals have been obtained, one was for S80,000 and the other for $90~000. The current owner of the property has agreed to donate to the City the value between $50,000 and the appraised amount. The funds to make the purchase have been obtained from a lease on the land the present shelter is on. Councllperson Perkins made the motion to pass Resolution No. 96-R-47, seconded by Council President Williams. Councilperson Perkins, Ellis, and Williams voted aye, with Councllpersons Frantz, Wilson, and Wilder voting nay. Mayor Galligan then voted aye, therefore passing Resolution No. 96-R-47. Deputy Mayor McCauley then introduced Ordinance No. 96-OR-98, An Ordinance Designating Funds For The Jeffersonville-Clark County Animal Shelter Building And Capital Improvement Non-Reverting Fund, explaining the purpose of the Ordinance. Councilperson Frantz questions where the remainder of the funds will come from. It is the intention to raise the funds outside the tax rate. Councllperson Frantz has a problem with the claims on the list for spay/neuter as she thought it was by Ordinance to get the best price and use local vets. PAGE 4 DECEMBER 2, 1996 Councllperson Perkins leaves the meeting at 7:55 P.M. Councllperson Ellis requests Deputy McCauley put together an estimate of funds for the proposed animal shelter. Councilperson Wilson then made the motion to table Ordinance No. 96-OR-98, seconded by Councilperson Frantz, passing unanimously. Councilperson Wilder would like to know the value and the land it is on. Councllperson Frantz of the current animal shelter building road aloud Resolution No. 96-R-48, A Resolution To Reinstate One position Of Employment To Ordinance No. 96-0R-53, And Ordinance No. 96-OR-55 For 1997. Councilperson Frantz read aloud Resolution No. 96-R-48, seconded by Councltperson Wilder. Deputy McCauley felt the situation would be revisited in 90 days and would not be for the full year. Following all discussion, Resolution No. 96-R-48 passed on the following roll call vote: Ayes: Councllpersons Ellis, Frantz, Wilder, Wilson, and Williams. Nays: None. Councilperson Wilson inquired of the requirements regarding the passage of an elected officials salary ordinance. Clerk Hollis read from the IACT bulletin that published 30 days before passage and 31. Clerk Hollis did state that another interpretation. Council President officials salaries should remain the same seemed reluctant to act, it was decided to stated the ordinance must be that passage must be by December City Attorney Sedwick does have Williams feels the elected in 1997 as in 1996. As all "let it die". PAGE 5 DECEMBER 2~ 1996 Following discussion it was decided to change the second meeting in January 1997 from Tuesday, January 21, to Monday, January 27, 1997 at 7:00 P.M. Councllperson Frantz request for funding from Clark initiated discussion regarding the County Health Care Clinic. The County Commissioners have agreed to put funding in their annual budget for this clinic. Other local entities will be approached to request funding as the clinic does serve all of Clark County. Councilperson Frantz thanked Fire Chief Mike Smith for the invitation to the Council to attend the First Responder Class. This was a very good class. A lot was learned and it makes one appreciate the job they do. There is still need for new toys for the toy drive. Council President Williams announced he will be out of town on December 16 so will not be at the scheduled Council meeting. Ms. Stacy Brown, a resident of French Quarters Apartments, appealed to the Council for help with the living conditions at the complex. She produced pictures and petitions regarding the conditions. She currently has four buckets in her ground floor apartment living room to collect the water. Her kitchen light fell from the ceiling. She wants to feel safe and secure for the money she pays or she would like help to get out of her lease. The problems are patched but not fixed. Building Commissioner Gavin has dealt with problems at French Quarters over the past several years. Ms. Brown invited any who are interested to visit her apartment which is number 127 . PAGE 6 DECEMBER 2, 1996 Ms. Nellie Nolan inquired when the City will start correcting the drainage problem in her area as the weather report is calling for rain. Mayor Galligan said he will try to get at it this week before the rain. There being no Council President Williams moved to adjourn Councllperson Wllson~nd unanimously carried.
