Construction Agreement between .~~SS ~ (..~~ ~ v • and Sun Properties, LLC
dba Sun Construction ("Sun's") for property loc ted at ~yr1-i7r-wor.~ s~ C~ {the
Sun will complete the c nstruction of improvements to the Premises asset forth in the attached Exhibit
A for a total price of O ~ ("Total Project Price"), except for change orders which are
requested by and approved in writing. Sun will submit progress payments on a monthly basis for work
completed to date. Progress payments shall be made to Sun within 15 days from receipt of same.
Total Project Price shall include all costs associated with Sun completing all work set forth in Exhibit A.
All work to be performed hereunder shall be completed in a good workmanlike manner according to
standard general construction practices and shall include a (1) year warranty by Sun. Sun's warranty
excludes damage or defect caused by abuse or modification(s) not performed under the direction of
Sun, its employees, agents or by the subcontractor(sj, improper or insufficient maintenance, improper
operation, or normal wear and tear under normal usage. All work is guaranteed to be as specified.
Any alteration or deviation from the above specifications involving extra costs will be an extra charge
over and above the Total Project Price. All extra work must have a change order signed before work is
to be completed. All change orders shall then become part of and added to the Total Project Price.
All agreements shall be contingent upon strikes, accidents, natural disasters, war or any delay beyond
our control. Execution of this contract shall be deemed "Notice to Proceed" with the work described in
this proposal will mean that you have accepted all terms and conditions stated in this proposal. Estimate
is valid for fifteen (15) days from date of quotation.
The foregoing is agreed to and accepted this day of 2009.
