HomeMy WebLinkAbout11-04-1996COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA NOVEMBER 4, 1996 The Common Council of the City of Jeffersonvllle met in regular session in the Multi-Purpose Meeting Room in the City-County Building, Jeffersonville, November 1996. The meeting was Indiana, at 7:00 P.M. on the 4th day of called to order by Mayor Thomas R. Galligan, with Clerk and Treasurer C. Richard Spencer Jr, at the desk. Mayor Gatligan welcomed all in attendance, asking all those present to stand as Councltperson Ron Ellis gave the invocation. He then asked all those present to Join him in the pledge of allegiance to the flag. The roll was called and those present were Councilpersons John Perkins, Ron Ellis, Donna M. Frantz, Peggy Knight Wilder, Barbara Wilson, Andrew Williams III, and Vicky Conlin. October Absent: None. Mayor Galligan presented the minutes of 21, 1996 for consideration by the Council. the meeting of Councllperson Ellis made the motion to approve the minutes as presented, seconded by Councilperson Conlin and carried unanimously. Clerk and Treasurer Spencer presented the claim list for consideration by the Council along with one additional claim. There followed discussion regarding the court space rental claim. Attorney Sedwick has reviewed the lease and states it is clear the City owes the claim in question. Councllperson Perkins requests a meeting with the County Commissioners before making the payment. Following all discussion, Councilperson Perkins made the motion to approve the PAGE 2 NOVEMBER 4, 1996 claims as listed with the exception of the court space rental claim, while adding the additional claim, seconded by Council President Williams, passing unanimously. Police Chief Mike Pavey explained his request for a transfer of funds as indicated on Ordinance No. 96-OR-76, An Ordinance Transferring Certain Funds Within Same Department (Police Department). Following all discussion, Councllperson Wilder made the motion to suspend the rules for Ordinance No. 96-OR-76, seconded by Councilperson Wilson, passing unanimously. Councilperson Wilder then made the motion to pass Ordinance No. 96-OR-76 on all three readings, seconded by Councilperson Wilson, passing unanimously. Councilperson Perkins introduced Ordinance No. 96-OR-81, An Ordinance Amending Section 156.03 Of The Jeffersonvllle Zoning Code, explaining the reasons he is asking for passage. This has received a favorable recommendation from the Plan Commission. Councllperson Perkins then made the motion to pass Ordinance No. 96-OR-81, seconded by Councllperson Ellis, and carried unanimously. Councllperson Perkins next introduced Ordinance No. 96-OR-82~ An Ordinance Regulating Distance Between Premises Used For Certain Charitable Purposes. Councllperson Perkins explained passage of this Ordinance has been requested by more of the constituents he represents than any other. A petition was presented for inclusion in the minutes. He then reviewed the sections saying there is a need to regulate proximity. This also has received a favorable recommendation from the Plan Commission. Councllperson Conlin expressed concern for the inclusion of mental health facilities, facilities for the disabled PAGE 3 NOVEMBER 4, 1996 and addiction facilities. Councllperson Perkins is not opposed to this and said there may be a need to amend the Ordinance later and he is willing to work with Councilperson Conlin. If the ordinance is amended at this time it would have to go back to the Plan Commission. Attorney Sedwick reminded the Council a variance can be Councilperson Perkins made the motion to pass Ordinance No. seconded by Councilperson Ellis, passing on the following granted. 96-OR-82, roll call vote: Ayes: Councilpersons Perkins, Ellis, Frantz, Wilson, and Williams. Nays: Councllpersons Wilder and Conlin. Resolution No. 96-R-43, A Resolution Of The Common Council Of The City Of jeffersonvllle was introduced for consideration- Mr. John Miller, speaking on behalf of the Resolution, explained the request, saying there will be no liability to the City. Mr. Miller explained the necessary steps, as this is preliminary and not final. Following all discussion, Councllperson Perkins made the motion to pass Resolution No. 96-R-43, seconded by Councllperson Conlin, passing unanimously. Ordinance No. 96-OR-83, An Ordinance Amending Certain Portions Of Section t Of Ordinance No. 95-OR-25 was presented for consideration by the Council. Park Superintendent Elliot explained the need for this request, stating this does not involve any additional employees. Councllperson Wilson made the motion to suspend PAGE 4 NOVEMBER 4, 1996 the rules for Ordinance No. 96-OR-43, seconded by Councilperson Frantz, passing unanimously. Councilperson Wilson then made the motion to pass Ordinance No. 96-OR-83 on all three readings, seconded by Councilperson Frantz, passing on the Ayes: Councllpersons Perkins, Williams, and Conlin. Nays: None. Resolution No. Additional Appropriation 96-R-44, A (Sanitation) folowing roll call vote: Ellis, Frantz, Wilder, Wilson, Resolution To Advertise For An was presented for discussion. Attorney Sedwick explained the contract for trash collection expired this year and was rebid leaving the fund short. The options and the length of the contract were discussed. This discussion will continue at the next workshop. Councilperson Perkins made the motion to pass Resolution No. 96-R-44, seconded by Councllperson Conlin and carried unanimously. Councilperson Wilson urges everyone to go vote. Councilperson Ellis received a letter indicating an increase in the cablevision rates. He suggests the contract be reviewed as he feels a responsibility to the citizens of jeffersonvllle to hold the line. Councilperson Ellis also urges all to go out and vote as tomorrow is a very important day. Councilperson Perkins agrees with Councilperson Ellis regarding the cablevision rates. Councilperson Perkins recently was in Baltimore and experienced a sound system designed for schools that would cost about Sl,500. He feels it would work well for the council PAGE 5 NOVEMBER 4, 1996 meetings. He has the information and will make copies availble to the Council. He also hopes all excerise their right to vote. There will be nice weather and he hopes for a good turnout. Council President Williams and the Council agreed to a workshop for Thursday, November 14, 1996 at 5:00 P.M. He will contact the County Commissioners about attending to discuss the court Mayor Galligan down at the 10th street cleaned from the continues and he department heads has borrowed a buldozer to knock entrance to the City. The trees rental. the hill are being ditch on Hamburg Pike. The fight against drugs commends the Police Department. He commends all as they are doing a good Job. Mayor Galligan also says "get out and vote" as we can have a governor from Southern Indiana that will be a friend. There being no further business to come before the Council, Councllperson Perkins moved to adjourn at 8:00 o'clock P.M. seconded by Councilperson Conlin and~unanimously ~carried. ATTEST:
