Following all discussion, Councilperson Perkins made the motion to suspend the rules for Ordinance No, 96-OR-74, seconded by Council President Williams, passing unanimously. Councllperson Perkins then made the motion to pass Ordinance No. 96-OR-74 on all three readings, seconded by Council President Williams, passing unanimously. Clerk and Treasurer Spencer presented and explained Ordinance No. 96-OR-75, An Ordinance Of Additional Appropriation (General Fund) stating this has been advertised as a public hearing. Councllperson Perkins, referring to the need for the additional $100,000 stated he has not received a copy of the accident report or the report of an internal investigation so that he may be able to answer to his constituents. Police Chief Pavey said no internal investigation was done and the only reports would come from Louisville and Jefferson County. Attorney Sedwlck again explained the situation. Councllperson Perkins feels there is a need to have an internal investigation every time there is damage to any vehicle or person so there is no cloud of any wrong doing. Councilperson Perkins made the motion to suspend the rules for Ordinance No. 96-OR-75, seconded by Councilperson Conlin, passing unanimously. Councilperson Perkins then made the motion to pass Ordinance No. 96-OR-75, seconded by Councilperson Conlin. Councilperson Perkins does want to made the PAGE 3 OCTOBER 21, 1996 public aware the City was in Jeopardy of losing between three and five million dollars, and the City has reached a settlement of three hundred thousand dollars. Mayor Galligan explained this is the obligation of the City as the insurance company, covering the City at the time, defaulted. The total settlement is three hundred thousand dollars, two hundred thousand is being paid this year with payments of twenty five thousand a year for the next four years. Ordinance 96-OR-75 then passed on the following roll call vote: Williams, Ayes: Councilpersons Perkins, and Conlln. Nays: None. Clerk and Treasurer Spencer Ellis, Frantz, Wilson, presented and explained Ordinance No. 96-OR-77, An Ordinance Transferring Certain Funds Within Same Department (City Court). Following all discussion, Councltperson Ellis made the motion to suspend the rules for Ordinance No. 96-OR-77, seconded by Councllperson Wilson, passing unanimously. Councilperson Ellis then made the motion to pass Ordinance No. 96-OR-77 on all three readings, seconded by Councilperson Wilson, passing on the following roll call vote: Ayes: Councilpersons Perkins, Ellis, Frantz, Wilson, Williams, and Conlin. Attorney Sedwick presented and explained Ordinance No. An Ordinance Annexing Contiguous Territory By Voluntary Councilperson Perkins made the motion to suspend the rules 96-OR-78, seconded by Council President Williams, Councllperson Perkins then made the motion to pass Ordinance No. 96-OR-78 on all three readings, seconded by Council President Williams, passing unanimously. Councilperson Conlin introduced Ordinance 96-OR-79, An Ordinance Requiring A Sprinkler System In Converted Residential Units. Councilperson Conlln was asked by former Councilperson Steve Stemler to work on this. This does have special meaning to her as a friend of hers lost a son in a fire. Fire Chief Mike Smith, Deputy Fire Marshall Stan Kaski, Major Clark Miles and others have worked hard on this and the main concern is for safety. Councllperson Perkins said this is a big step and he feels it is years past due. Many buildings can be saved with the passage of this Ordinance. Councilperson Conlin made the motion to suspend the rules for Ordinance seconded by Council Councilperson Conlin 96-OR-79 on all three passing unanimously. President Williams, then made the motion readings, seconded by passing to pass Counclleperson Perkins, No. 96-OR-79, unanimously. Ordinance No. Councllperson Conlin introduced Ordinance No. 96-OR-80, An Ordinance Establishing The Jeffersonvllle City Engineer Emergency Repair And Improvement Non-Reverting Fund. The establishment of this PAGE 5 OCTOBER 21, 1996 fund is requested due to receipt of funds from the sale of an easement. Following all discussion, Councllperson Conlin made the motion to suspend the rules for Ordinance No. 96-OR-80, seconded by Council President Williams, passing unanimously. Councllperson Conlin then made the motion to pass Ordinance No. 96-OR-80 on all three readings, seconded by Council President Williams, passing on the following roll call vote: Ayes: Councllpersons Perkins, Ellis, Frantz, Wilson, Williams, and Conlln. Nays: None. Assistant Director of Redevelopment Jennifer Mead reviewed a previously distributed report regarding the fiscal plan for annexation area 7. It is the Council's responsibility to weigh the advantages and disadvantages. If there is a commlttment to move forward, an Ordinance will be drafted, the Council would then pass the Ordinance on two readings which would be followed by a 60 day remonstrance period before the third reading. Following all discussion the Council agreed to look at this during a workshop that the Department Heads will be invited to attend. Mayor Galligan will provide an aerial photograph looked at. apparatus November for the workshop. Fire Chief Smith is concerned that accessible. The Council will hold 14, 1996 at 5:00 P.M. Councilperson Frantz and Mayor Galligan did attend a Park Board meeting on this. They do have a piece of property in mind. The Park Board is excited about this and has urged them to move forward with it. They do have a committee. Councilperson Perkins thanked Attorney Sedwick for a letter he received regarding the Rose Hill School issue. There does seem to be a question if the area used. He would also like would have to comply with is zoned for the building as it is being to know if converted areas of a building the new sprinkler ordinance. Councilperson Perkins would like to be notified of any variance requests in his district. Mayor Galligan gave a report of two recent "drug busts" by the group that was put together consisting of Indiana State Police, the Jeff City Police and the New Albany Task Force. There was a hot pursuit in which the Fire Dpartment assisted the Police. He would like to commend those involved. An officer was shaken when a gun was pulled on him and he wants to thank Chaplain Conrad Moore for his assistance. He does an excellent Job and does not get paid. Mayor Galllgan promises to make a dent in these drugs. He feels the investment is paying off and he commends the Police Chief and all involved. PAGE 7 OCTOBER 21, 1996 Mayor Galligan reported the drainage ditch behind Winn Dlxis has been cleaned. Many compliments have been received. A survey is being done on storm water drainage and a hearing will be held next month. Councllperson Wilson has received complimentary calls on the ditch cleaning. Mayor Galligan reported on the paving being done. He commends Engineer Miller, Commissioner Trembly as well they are doing. Planning Director Urban, and Street as all department heads for the good work Councilperson Frantz noted some Jeffersonvllle High School students have been coming to the meetings and she does not feel they are informed enough. She feels there is a need to invite students to participate and maybe come to a workshop. They have a lot of good ideas and there is a need to hear their concerns in the community. Councilperson Perkins agrees this is a good idea. Councilperson Conlin also thinks it is a good idea and feels a need to open doors and suggests maybe a shadow program. Mayor Galligan reviewed some of the questions he was asked by a group of students that recently visited his office. Children like being in touch with people they look up to and there is a need to do more of this.
