COMMON COUNCIL OF THE CITY
OF JEFFERSONVILLE, INDIANA
May 18, 2009
The Common Council of the City of Jeffersonville, Indiana met in regular session
in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M.
on Monday May 18, 2009.
Mayor Tom Galligan, with Deputy Clerk Treasurer Barbara Hollis at the desk,
called the meeting to order. Also present were Council Attorney Larry Wilder, and
Administrative Assistant Laura Boone. Mayor Galligan welcomed all in attendance,
asking all those present to stand as Councilperson Samuel gave the invocation. Mayor
Galligan asked all those present to join him in the pledge of allegiance to the flag.
City Court Judge Ken Pierce administered the oath of office to the members of the
Fire Department Merit Board.
The roll was called and those present were; Councilpersons Mike Smith, Ed
Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Nathan Samuel, and Ron Grooms.
Absent: None.
Councilperson Samuel made the motion to approve the agenda with the deletion
of #11, second by Councilperson Zastawny, passing on a vote of 7-0.
Mayor Galligan presented the minutes for consideration. Councilperson Wilson
made the motion to approve the minutes of April 6, 2009 (7:30 P.M.) second by
Councilperson Grooms, passing on a vote of 7-0. Councilperson Wilson then made the
motion to approve the minutes of May 4, 2009 (7:30 P.M.), second by Councilperson
Samuel, passing on a vote of 7-0.
Deputy Clerk Hollis presented the claim list for consideration by the Council.
Councilperson Grooms made the motion to approve the claims as presented, second by
Councilperson Fetz, passing on a vote of 7-0. Councilperson Grooms made the motion to
preapprove the Parks claim list dated May 14, 2009, second by Councilperson Wilson,
passing on a vote of 7-0.

PUBLIC COMMENT:

Ms. Pat Barrow, a resident of 1800 Dutch Lane #75, appeared before the Council
requesting help regarding the fumes and noise from Mac Asphalt. Ms. Barrow asked
who is in charge of Zoning? Mayor Galligan replied Jim Urban. She asks why nothing
has been done. She does not want families to go through another summer with the stink
and noise from Mac Asphalt. The City has done nothing to make Mac comply. The
berm does not hold back fumes and noise. She can feel vibrations and hear noise. Mayor
Galligan will have Director Urban call. If there are violations, they will be enforced.
Council Attorney Wilder explained the City has no fumes ordinance or hours of operation
ordinance at this time. He explained the City couldn't take away the right to do business.
Councilperson Zastawny said the process did not happen as it should. Ms. Barrow has
taken this to the EPA and was told to take it to the Health Department. The order of
importance is odor, noise, and soot. Attorney Wilder said the City might be able to
implement a regulatory law as to hours of operation and noise. Councilperson Zastawny
said this should be done. Ms. Barrow explained the odor is like "walking behind a TARC
Bus". Mayor Galligan acknowledged the sound of tailgates banging is loud. He suggests
asking the plant to put up signs to not bang tailgates. Mayor Galligan will visit and see
what is being put out of the stack.
COUNCIL COMMENT:
There was no Council comment.
DEPARTMENT HEAD REPORTS:
Safety Director Dominick Mongarello reviewed his charge, highlighting the
programs he has started. (Report attached.) Director Mongarello requested the Council
consider funding more than 20 hours per week.
AGENDA ITEMS:
Council President Sellers explained the need for passage of Ordinance No. 2009-
OR-22, An Ordinance Amending City Ordinance 2004-OR-20, An Ordinance
Authorizing The City To Remove Debris, Trash, Garbage, Rubbish, Litter, Refuse, Junk
And Tires. Council President Sellers explained the purpose of the amendment is to align
with the State code. Councilperson Samuel made the motion to suspend the rules for
Ordinance No. 2009-OR-22, second by Councilperson Fetz, passing on a vote of 7-0.

Councilperson Samuel then made the motion to pass Ordinance No. 2009-OR-22 on all
three readings, second by Councilperson Wilson, passing on a vote of 7-0.
Council President Sellers explained a signed copy of Ordinance No. 2004-OR-43
is not in the files. The minutes indicate that it was passed. Following discussion,
Councilperson Zastawny made the motion to ratify Ordinance No. 2004-OR-43, second
by Councilperson Grooms, passing on a vote of 7-0.
Councilperson Zastawny explained the negotiations with the Fraternal Order of
Police are complete and a contract has been agreed upon. Councilperson Grooms
thanked Councilperson Zastawny for taking the lead on the negotiations. He thanks the
Police for their dedication. He feels both sides were generous in areas, and all will
balance out. Office Joe Hubbard, President of the FOP said the members have passed the
contract. Councilperson Zastawny thanked Officer Hubbard for his time and
professionalism. Councilperson Zastawny made the motion to pass Resolution No. 2009-
R-6, AResolution Authorizing The City Council To Tender An Offer Of Contract To
The Jeffersonville FOP second by Councilperson Wilson, passing on a vote of 7-0.
Councilperson Samuel presented and reviewed a fuel usage comparison chart.
The Police in-house policy is working. He commends the Police Department. Usage in
the Sanitation Department is up due to the service area increase. The Parks Department
provided ice storm assistance causing an increase in usage. Mayor Galligan said that a
credit type card records every vehicle's gas. It is a good system. He thanked
Councilperson Samuel for the update. Councilperson Grooms said Councilperson Smith
is working on an energy cost analysis.
CLERK TREASURER COMMENTS:
There were no Clerk Treasurer Comments.
COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS:
Councilperson Grooms noted Jeff High Student Mat has received permission to
continue taping the meetings for the summer. He thanked the Police and Department
Heads in attendance.
Councilperson Wilson invited all to attend the Concerts In The Park. City Pride
has been planting and it is looking nice.

Councilperson Smith said the City Council will be meeting with Department
Heads following. the Department Head Meeting regarding the appropriation reports.
Council President Sellers thanked Councilpersons Zastawny, Samuel, and
Grooms for the work on the FOP contract. She thanked Councilperson Samuel for the
fuel report. She reminds all to attend the Taste Of Jeffersonville, May 21, 2009.
Mayor Galligan commented on the EPA find of $165,000. This is below what it
could have been. Some may be mitigated. Atrial is coming up and the damages needed
to be known. Aggressive action was taken to keep the fines down. Mayor Galligan said
the Louisville Orchestra will perform on the Riverstage weekends in July. This is a
significant event for the community. .This is an asset to the region. The City will have
two pigs for the Pigpalooza. One will be at City Hall and the other in Warder Park. He
reminds all of "Smokin On The River". A lot of good things are happening.
Councilperson Smith said pigs are for sale for $100 to be painted and entered into
competition. This is a good event for the community. He thanks the Beautification
Committee for the plants on Spring Street. Baskets will be put up on Riverside Drive at
Hooters/Sheraton.
As there was no further business to come before the Council, the meeting was
adjourned at 8:30 P.M.
