City Hall Mayor's Conference Room The Common Council of the City of Jeffersonville met in Special Session on Monday, April 13, 2009 in the Mayor's Conference Room. Council President Connie Sellers called the meeting to order at 8:55 P.M., and on call of the roll those members present were: Councilpersons Mike Smith, Ed Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Ron Grooms, and Nathan Samuel. Also present were Mayor Tom Galligan, Council Attorney Larry Wilder, and Deputy Clerk Treasurer Barbara Hollis Thunder Ordinance Council Attorney Larry Wilder explained the need for passage of Ordinance No. 2009- OR-20, An Ordinance Approving Safety Guidelines For Thunder Over Louisville. Previously the Board of Public Works and Safety has issued regulations. Attorney Wilder reviewed a previous case regarding a suite and acquittal. The regulations and boundaries were reviewed. As the Ordinance contains fines Mayor Galligan has authority by statute. to declare an emergency to allow the fines to become effective immediately. At the conclusion of all discussion, Councilperson Zastawny made the motion to suspend the rules for Ordinance No. 2009-OR-20, second by Councilperson Fetz, passing on a vote of 7-0. Councilperson Zastawny then made the motion to pass Ordinance No. 2009- OR-20 on all three readings, with the change of Allison Lane to replace High Jackson as the East border, second by Councilperson Fetz, passing on a vote of 7-0. Attorney Wilder will see that the Ordinance is posted in the required areas. Signs will be in place. Declaration of Emergency The Mayor further proclaims and finds that the matter presented by the Council regarding the issues of public safety and welfare are of grave importance to the city. Moreover, the mayor further proclaims that these facts present exigent circumstances such that an emergency exists which shall serve to relieve the city from the burden of advertising said ordinance, rather the city shall be required to post said ordinance in three (3) public places in each of the five (5) districts of the city. Moreover, the mayor directs that the City Communications director shall be required to issue a public statement setting forth the content of said ordinance.
