HomeMy WebLinkAboutFebruary 23, 2009 COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA February 23, 2009 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M. on Monday February 23, 2009. Mayor Tom Galligan, with Deputy Clerk Treasurer Barbara Hollis at the desk, called the meeting to order. Also present were City Attorney Darren Wilder, Council Attorney Larry Wilder, Deputy Clerk Treasurer Barbara Hollis and Administrative Assistant Laura Boone. Mayor Tom Galligan reported the two recently shot Jeffersonville Police Officers, Tom Lawhorn, and Keith Broady, have been moved from the Intensive Care Unit and are in stable but serious condition. Both will have a long recovery. He commends the valor of the officers. He commends the Jeffersonville Police Department and all those that responded. Quick response was due to take-home cars. Mayor Galligan thanked Chief Tim Deeringer and all those involved for the very professional and very well organized response. He takes his hat off to the Jeffersonville Police Department. Mayor Galligan will not give the State of the City Address tonight. It is available in print. Mayor Galligan welcomed all in attendance, asking all those present to stand as Councilperson Grooms gave the invocation. Mayor Galligan then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons Mike Smith, Ed Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Nathan Samuel, and Ron Grooms. Absent: None. At the conclusion of all discussion, Councilperson Zastawny made the motion to move agenda item # 17 to # l Oa, and agenda item # 15 to # l Ob, and approve the agenda as amended, second by Councilperson Grooms, passing on a vote of 7-0. Mayor Galligan presented the minutes for consideration. Councilperson Wilson made the motion to approve the minutes of January 26, 2009 (7:30 P.M.) as presented, second by Councilperson Grooms, passing on a vote of 7-0. Councilperson Wilson then February 23, 2009 2 made the motion to approve the minutes of February 2, 2009 (7:30 P.M.) as presented, second by Councilperson Zastawny, passing on a vote of 7-0. Deputy Clerk Hollis presented the claim list for consideration by the Council. A discussion regarding payment from Major Moves followed. Following discussion, Councilperson Zastawny made the motion to approve the claims with the posting correction of kitchen supplies in the Fire Department budget and moving the claim to Umbaugh regarding annexation to the Annexation Fund, second by Councilperson Grooms, passing on a vote of 7-0. PUBLIC COMMENT: Mr. Keith Levell, 416 Watt Street, presented a number of pictures he took in one hour showing 35 parking violations. He gave numbers giving the potential revenue in excess of $500,000. He feels this an untapped resource. Mayor Galligan said he would speak with the Police Department tomorrow. Councilperson Fetz noted the City of Louisville hired a firm for parking violations. COUNCIL COMMENT: There was no Council comment. DEPARTMENT HEAD REPORTS: There were no Department Head reports. AGENDA ITEMS: Planning and Zoning Director Jim Urban presented and explained Ordinance No. 2009-OR-9, An Ordinance Amending Ordinance 2009-OR-7, Which Amends 2009-OR- 2, Which Amends 2008-OR-79, An Ordinance Fixing Basic Salaries Of Appointed Officers And Employees Of The City Of Jeffersonville, Indiana For The Year 2009. Director Urban noted the Sanitary Sewer Board has approved the changes. Councilperson Grooms asked for the dollar amount of the changes. Director Urban could not answer the question. Councilperson Grooms then made the motion to pass Ordinance No. 2009-OR-9 on the first reading, second by Councilperson Smith, passing on a vote of 6-1. Councilperson Smith voted against passage. Director Urban next presented and explained Ordinance No. 2009-OR-10, An Ordinance Establishing Fire Hydrant Specifications For Developers And Others. February 23, 2009 3 Following all discussion, Councilperson Samuel made the motion to pass Ordinance No. 2009-OR-10 on the first reading, second by Councilperson Fetz, passing on a vote of 7-0. Mayor Galligan introduced Mr. Ron Glass as his appointment to the Fire Department Merit Board. Mr. Glass gave a short biography of his life, also noting his board experiences. Council President Sellers read a statement from the Council concerning the recent injuries to Officers Keith Broady and Daniel Lawhorn. (Statement attached) Council President Sellers explained the changes to Ordinance No. 2009-OR-5, An Ordinance Amending Ordinance 2004-OR-73 - Regulating The Disposition Of Abandoned Vehicles. This Ordinance is straight from Indiana code. At the conclusion of all discussion, Councilperson Wilson made the motion to pass Ordinance No. 2009-OR-5 on the third and final reading, second by Councilperson Fetz, passing on a vote of 7-0. City Attorney Wilder explained Ordinance No. 2009-OR-6, An Ordinance Establishing Service Charges For False Alarms Reported To Jeffersonville Police And/Or Fire Departments has been revised in two separate Ordinances. Councilperson Grooms made the motion to rescind Ordinance No. 2009-OR-6, second by Councilperson Sellers, passing on a vote of 7-0. City Attorney Wilder introduced Ordinance No. 2009-OR-11, An Ordinance Establishing Service Charges For False Alarms Reported To Jeffersonville Police Department. Attorney Wilder reviewed the Ordinance explaining the fines. Councilperson Samuel made the motion to pass Ordinance No. 2009-OR-I l on the first reading, second by Councilperson Sellers, passing on a vote of 7-0. City Attorney Wilder next presented and reviewed Ordinance No. 2009-OR-12, An Ordinance Establishing Service Charges For False Alarms Reported To Jeffersonville Fire Department. Councilperson Samuel suggested using the same fine schedule as the Police schedule. At the conclusion of all discussion, Councilperson Samuel made the motion to pass Ordinance No. 2009-OR-12 on the first reading with the changes as discussed, second by Councilperson Zastawny, passing on a vote of 7-0. City Attorney Wilder explained Ordinance No. 2009-OR-13, An Ordinance Amending Ordinance 2008-OR-57, An Ordinance Establishing Departmental Petty Cash And/Or Cash Change Funds. The Sewer Plant has been added. Councilperson Fetz made February 23, 2009 4 the motion to pass Ordinance No. 2009-OR-13 on the first reading, second by Councilperson Zastawny, passing on a vote of 7-0. CLERK TREASURER COMMENTS: There were no Clerk Treasurer Comments. COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS: Councilperson Samuel noted the Councilperson from the First District is using his laptop. Councilperson Samuel is impressed. Councilperson Grooms requested Rick Lovan to report on the Blood Drive in honor of the two officers that have been shot. Mr. Lovan reported the turnout was so tremendous the hours were extended and people had to leave due to the long wait. Councilperson Grooms announced the F.O.P. is sponsoring a Fish Fry, Friday, February 27, 2009 at the Episcopal Church at Market and Walnut from 11:00 A.M. to 1:00 P.M. and 5:00 P.M. to 7:00 P.M. All proceeds are to go to the injured officers. Councilperson Grooms says thank you to Mat, the Police Officers and to Council President Sellers for giving the statement. Councilperson Wilson made the motion to approve the Parks claims as presented, second by Councilperson Samuel, passing on a vote of 7-0. Councilperson Wilson noted all the support that has been received, requesting all keep the Officers in their prayers. Councilperson Wilson reported the Main Street Chili fundraiser was heavily attended, as was the sausage supper at St. Luke's Church. She thanks all for attending. Councilperson Smith noted the Finance Committee will be reviewing the purchase order system and will bring a recommendation to the full Council. Councilperson Zastawny gave a reminder that the Merit Boards need to meet by March 15. Police negotiations are ongoing. Councilperson Zastawny noted work needs to be done regarding redistricting. He invites all to an Optimist Club fundraiser this Friday night. Councilperson Fetz echoes the comments regarding the incident. This has been a test of communications, responses, etc. He asks all, if given a ticket, to think about the other duties of Police. He noted the communities that helped, saying it is a tight knit support group. Council President Sellers thanked all for coming. February 23, 2009 5 Mayor Galligan noted the need for trash cans to get put in place. This reason for enforcement is to avoid injuries, keep the City clean, and to keep dogs and rodents from getting into the trash. He asks all to get the required cans. They are available at cost. It is cheaper on taxes to use the required cans. Those that do not comply will be cited and taken to Court. All need to abide. Mayor Galligan reviewed his visits to the hospital to visit the wounded Officers. He was amazed with the attendance of the families of other victims. Counselors were available. All involved need to talk to somebody. Counseling will be scheduled for the Police Department. He commends the whole Police Department. He commends University Hospital. He takes his hat off to the Louisville Police Department. This was a team effort from everybody in the metro area. Giving blood is a small thing to do.
