HomeMy WebLinkAboutFebruary 2, 2002COUNCIL PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, INDIANA February 2, 2009 The Common Council of the City of Jeffersonville, Indiana met in regular session in Room 101, City Hall, 500 Quartermaster Court, Jeffersonville, Indiana, at 7:30 P.M. on Monday February 2, 2009. Council President Connie Sellers, with Clerk Treasurer Peggy Wilder at the desk, called the meeting to order. Also present were City Attorney Darren Wilder, Deputy Clerk Treasurer Barbara Hollis, Deputy Clerk Treasurer Tiffany Timberlake, and Administrative Assistant Laura Boone. President Sellers welcomed all in attendance, asking all those present to stand as Father Thomas Clegg gave the invocation. President Sellers then asked all those present to join him in the pledge of allegiance to the flag. The roll was called and those present were; Councilpersons Mike Smith, Ed Zastawny, Keith Fetz, Connie Sellers, Barbara Wilson, Nathan Samuel, and Ron Grooms. Absent: None. Following discussion, Councilperson Grooms made the motion to approve the agenda with the addition of agenda item # 1 OA -Appointment to Fire Department Merit Board, and agenda item # 16A -Weather Event Report, second by Councilperson Samuel, passing on a vote of 7-0. President Sellers presented the minutes for consideration. Councilperson Wilson made the motion to approve the minutes of January 26, 2009 (6:30 P.M.) as presented, second by Councilperson Zastawny, passing on a vote of 7-0. Clerk Treasurer Wilder presented the claim list for consideration by the Council. Councilperson Zastawny made the motion to approve the claims as presented, second by Councilperson Grooms, passing on a vote of 7-0. PUBLIC COMMENT: There was no public comment. COUNCIL COMMENT: There was no Council comment. DEPARTMENT HEAD REPORTS: February 2, 2009 2 There were no Department Head reports. AGENDA ITEMS: Councilperson Smith introduced Father Thomas E. Clegg, Pastor of the Catholic Community of Jeffersonville, St. Augustine and Sacred Heart Parishes, reading a biography of Father Tom. Councilperson Smith made the motion to appoint Father Thomas E. Clegg to the Fire Department Merit Board, second by Councilperson Wilson, passing on a vote of 7-0. Councilperson Zastawny thanked Father Tom for his willingness to serve. Father Tom told the Council he was reluctant to take the assignment here in Jeffersonville, not wanting to leave the Indianapolis area. He now feels very much at home in Jeffersonville. President Sellers explained a signed copy of Ordinance 2004-OR-73 couldn't be located, asking the Council to ratify Ordinance 2004-OR-73, An Ordinance Regulating The Disposition Of Abandoned Vehicles. Councilperson Grooms made the motion to ratify Ordinance No. 2004-OR-73, second by Councilperson Zastawny, passing on a vote of 7-0. President Sellers explained the need for passage of Ordinance No. 2009-OR-5, An Ordinance Amending Ordinance No. 2004-OR-73, An Ordinance Regulating The Disposition Of Abandoned Vehicles. President Sellers read the changes explaining these match the State Code. President Sellers then made the motion to pass Ordinance No. 2009-OR-5 on the first reading, second by Councilperson Wilson, passing on a vote of 7- 0. Building Commissioner Russ Seagraves has recommended the changes. City Attorney Darren Wilder explained updates reflected in Ordinance No. 2009- OR-6, An Ordinance Establishing Service Charges For False Alarms Reported To Jeffersonville Police And/Or Fire Departments. Councilperson Samuel asked about consideration for construction projects. Councilperson Smith explained procedures to follow that could be included in an amendment. Councilperson Samuel feels it is a little aggressive. President Sellers said the Police and Fire have been dealing with repeat offenders for years and know who they are. Councilperson Samuels feels three false alarms a years should be allowed, as one is a little harsh. Councilperson Smith made the motion to pass Ordinance No. 2009-OR-6 on the first reading, second by Councilperson Zastawny, passing on a vote of 7-0. February 2, 2009 3 Councilperson Zastawny presented Resolution No. 2009-R-1, A Resolution Affirming The City Of Jeffersonville Shall Be Obligated To Adhere To All Zoning Laws, Use Laws And Other Restrictions That Are Promulgated By The Jeff City Council, saying this is a chance to lead by example. Councilperson Zastawny made the motion to pass Resolution No. 2009-OR-1, second by Councilperson Grooms. Councilperson Samuel said he would assume the City would adhere. Planning and Zoning Director Jim Urban explained government buildings, schools, churches, and community buildings are exempt. Councilperson Zastawny feels the City should be the same as businesses. The motion to pass Resolution No. 2009-R-1 passed on a vote of 7-0. Councilperson Grooms read Indiana Code 36-4-7-3 C, discussing the meaning. City Attorney Wilder said Section C is not clear to him. Councilperson Grooms asked Attorney Wilder to research the section. This is something to think about. There is a lot of confusion regarding the hiring freeze, annexation and the budget. Councilperson Grooms would like all to look at Resolution No. 2008-R-35 for revising. Councilperson Samuel has been working with Councilperson Grooms and Smith regarding the Salary Ordinance. He explained the changes in Ordinance No. 2009-OR-7, An Ordinance Amending 2009-OR-2, Which Amends 2008-OR-79, An Ordinance Fixing Basic Salaries Of Appointed Officers And Employees Of The City Of Jeffersonville, Indiana For The Year 2009. Following discussion, Councilperson Samuel made the motion to pass Ordinance No. 2009-OR-7 on the first and second readings, second by Councilperson Grooms, passing on a vote of 7-0. Planning and Zoning Director Jim Urban, on behalf of Mayor Galligan, gave special thanks to the Street Department, Sanitation Department, Drainage Crew, Construction Crew, Parks Department, Police, Fire, and Electrical Inspector Harold Satterly for the services provided during the ice and snow storm. The Emergency Management Response Team system worked well. All put in many hours. A special thanks goes to Street Commissioner David Hosea. CLERK TREASURER COMMENTS: There were no Clerk Treasurer Comments. February 2, 2009 4 COMMITTEE REPORTS, COUNCIL AND MAYOR COMMENTS: Councilperson Samuel thanked Deputy Clerk Tiffany Timberlake for the projector displays. He appreciates Attorney Wilder answering his questions. Councilperson Samuel expressed appreciation to the Street Department especially Kenny Mahoney who he rode in a snowplow, salt truck with for 5 hours. He was impressed with the professionalism. He has a real appreciation for what they do. A great job was done. Councilperson Grooms reminded all about the Parks Authority meeting, Monday, February 9, 2009. The Finance Committee has declared if a position is in the budget and the salary Ordinance a vacant position can be filled. He thanks Jeff High Student Mat and the Police Officers in attendance. Councilperson Wilson thanks all for their work during the storm. She reminds all of the Depot Open House scheduled for February 5, and the Beer and Chili fundraiser scheduled for February 12. Councilperson Fetz is happy to have been presented only 10 pieces of paper for this meeting. This is the last time paper packets will be made. It is suggested Deputy Clerk Timberlake give a tutorial regarding the use of electronic packets and word. Councilperson Smith said following the balancing of the budget, he will look into installation of sidewalks in front of the new firehouses. President Sellers reminded all to return the flash drives.
