HomeMy WebLinkAbout1995-R-22RESOLUTION NO. 95-R-~2~ A RESOLUTION ADOPTING A WRITTEN FISCAL PLAN ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXED AREA (Annexation Area 6) WHEREAS, the City of Jeffersonville desires to annex an area contiguous and adjacent to the corporate limits of the City of Jeffersonville, more particularly described in Ordinance 95-OR-,~__~; and WHEREAS, state law requires adoption of a fiscal plan and a definite policy for the provision of service is to annexed areas; and WHEREAS, such plan has been developed and presented to the Common Council, entitled "Fiscal Plan for Annexation Area 6"; NOW, THEREFORE, BE IT RESOLVED BY THE COMMON COUNCIL OF THE CITY OF JEFFERSONVILLE, CLARK COUNTY, INDIANA, THAT: 1. The Common Council of the City of Jeffersonville, Clark County, Indiana, hereby approves and adopts the "Fiscal Plan for Annexation Area 6", which Plan is attached hereto and made a part hereof, and hereby approves and adopts the specific policies for implementation of the Plan as set out therein; ' d 2. Any monies necessary for the provision of services as described an itemized in the attached Plan shall be budgeted and appropriated from the applicable fund, pursuant to state law and the City's budget procedure; 3. It is anticipated that this annexation will not result in the elimination of jobs for employees of other governmental entities, but in the event it does, the City of Jeffersonville shall assist such employees in obtaining new employment. However, nothing herein shall require the City to hire any such employees. It does not recommend for or against annexation, but provides an objective analysis of the financial and other impacts of annexing Area 6. The incorporation of Annexation Area 6 into the City of Jeffersonville will require the provision of services in a manner equivalent in standard and scope to services now provided in comparable parts of the City. This report analyzes the impact that Area 6's annexation will have on various city services and outlines a plan for providing pertinent services. To this end, the study serves as the City's written fiscal plan and annexation policy requirements to be included in any resolution of the Common Council related to the annexation of Area 6. Such a plan and policy are necessary to meet State statutory requirements. LOCATION Annexation Area 6 is located adjacent to the northeast part of Jeffersonville and extends east to the western boundary line of Grant 23. Map 1, which follows this page, shows the boundaries of this 229+ acre area. Area 6 is located within the eastern portion of Grant 22 of Jeffersonville Township. It should be noted that the City's ordinance pertaining to the annexation of Area 6 should contain a legal description of the area. METHOD OF ANNEXATION The City of Jeffersonville may, by ordinance, annex territory that is contiguous to its corPorate limits, PrOvided the annexation meets one of the following conditions: At least 1/8 of the aggregate external boundaries of the territory sought to be annexed must coincide with the existing boundaries of the City of Jeffersonville; and that either: Sixty percent (60%) of the territory is subdivided; The resident population density of the territory sought to be annexed is equal to at least three (3) persons per acre; or The territory is zoned for commercial business or industrial use. At least 1/4 of the aggregate extemal boundaries of the territory sought to be annexed coincides with the boundaries of the City of Jeffersonville; and; A. The territory sought to be annexed is needed and can be used by the City of Jeffersonvilie for its development in the reasonable near future. The proposed annexation of Area 6 will meet condition 2 which relates to the statutory requirements of 1 C36-4-3-13(b). Therefore, the City of Jeffersonville retains the authority to annex the proposed area pursuant to the provisions that it has a 1/8 contiguity boundary and that it is needed and can be used in the future development of the City. Portion of Boundary Bordering City Limits Portion of Boundary Not Bordering City Limits 6,350' (39.6%) 9,689' (60.4%) TOTAL BOUNDARY - 16,039' Annexation Need The City of Jeffersonville needs to annex Area 6 to provide for a more manageable corporate limits and to assure the orderly growth of the Area in a manner that will meet the development needs of the City. Annexation Area 6 is located between the current city limits and a major interstate interchange providing access to the eastern part of Jeffersonvilie. Its annexation will connect the City to a major gateway or entrance to the City. The City of Jeffersonville needs to annex and use Area 6 for its development in the reasonably near future for reasons stated as follows: 2 the existing pattern of urban development along the Highway 62 Corridor indicates such development will increase in Area 6; the Jeffersonville Comprehensive Plan identifies Area 6 as one of several areas having "the highest potential for development"; Area 6 offers the potential for mixed use developments with a full range of quality retail, office, multi-family and business park uses; the recently opened 1-265 interchange will greatly enhance development potentials in the area; Highway 62 which connects Jeffersonville with 1-265, runs through the middle of Area 6. the need for urban services is evident from the need to assist the County in responding to police calls; it is physically, socially and economically, but not legally, a part of the City; over 39 percent (39.6%) of the Area now borders the City; there is a need to assure that sufficient good land is available for development; and future development should be planned in an orderly manner that is consistent with adjacent City developments and can be coordinated with the need for urban services. In summary, the annexation of Area 6 involves the needed process of "extending the City limits to the limits of the City". COMPARABLE AREA The comparable area selected for Annexation Area 6 is the Highway 62 Corridor from Holmans Lane east onto the present City limits. Area 6 is a continuation of this comparable area east on Highway 62. Both areas are similar in that development is primarily along Highway 62, is sparse away from the Highway and both areas are located in the prime access corridor from 1-265 to the eastern part of Jeffersonville. 3 TOPOGRAPHY Topography within Annexation Area 6 ranges from 490 to 560 feet above sea level. In the comparable area, topography ranges from 490 to 520 feet above sea level. Slopes are gentle in both areas. EXISTING LAND USE Single-family residential consisting of 14 single-family houses and 3 mobile homes is the predominant use of land in Annexation Area 6. This use is mostly located on large parcels along State Highway 62 that extend in depth from 200 to 2,000 feet. Although these parcels are occupied by housing, some 70 to 80 percent of their land area is vacant. This situation along with the existing vacant Parcels means that some 75 percent of Area 6 is undeveloped. Also 87 percent of the Area's 31 separate parcels are in only seven different ownership. These factors along with the Area's prime location creates a favorable potential for growth. Several commercial uses exist along State Highway 62. They are: a heat and duct cleaning operation; a small shopping center consisting of three offices and two retail stores; and a furniture store. Also a church is located in the area. Map 2, which is incorporated herein and attached as Exhibit A, Shows the exiSting use of land. Following is a statistical analysis of approximate land area by use: Type o__fUse Acres Single-Family House 121.6 Mobile Home 2.5 Church 2.7 Commercial 5.4 Street Right-of-Way 8.6 Vacant 87.9 TOTAL: 228.7 4 POPULATION Area 6 has an estimated population of 41 persons based on the average household size found in the fringe area of Jeffersonville. ZONING The City of Jeffersonville has, under State enabling legislation, adopted extraterritorial zoning jurisdiction beyond its corporate limits; therefore, zoning within Annexation Area 6 is now being administered by the City. Exhibit B, Map 3 shows the Existing Zoning in Annexation Area 6. The following existing zoning districts are applied to the land in Area 6: Zonin,q Plan R2 B2 B3 I1 Single, Two & Multi Residences Service District General BuSiness Light Industrial Because of the City's extraterritorial zoning jurisdiction, the administration of zoning will only involve the transfer of zoning district classifications from the Fringe Area Zoning Map to the City of Jeffersonville Zoning Map. This will be done immediately following the effective date of annexation. STREETS State Highway 62, the Jeffersonville Area's most heavily traveled street, runs through the Center of Annexation Area 6. This four lane facility with median provides direct access from the 1-265 interchange to the eastern part of Jeffersonville and is the only street located in Area 6. It is in poor condition, but will be repaved when the Indiana Department of Transportation (IDOT) turns Highway 62 over to the City. This repaying will be accomplished with special funding provided as part of the City's agreement to accept maintenance responsibility from IDOT. The Highway 62 repaving is financially independent of the proposed annexation and will not effect the financial plan for Annexation Area 6. 5 The City of Jeffersonville's street maintenance staff consists of a Street Commissioner and fourteen full time employees. This staff is now responsible for maintaining some 145 miles of improved streets. The incorporation of Annexation Area 6 will add about .6 miles along Highway 62 to the City's maintenance responsibilities. This would be a 0.4 percent ~ncrease in the City's street maintenance responsibilities. Routine annual maintenance operations are all that is needed for State Highway 62. The Annexation of Area 6 will eventually increase the City's annual cost of street maintenance By an estimated $1,073. This figure was derived by dividing the City's current street miles into the expense of street maintenance. This results in a maintenance cost of $1,789 per mile of street. The application of this figure to the .6 miles of streets in Area 6 results in the estimated annual maintenance cost of $1 073. Although the City will assume the responsibility for street maintenance in the first year after annexation, it is not anticipated that any increased maintenance funds will be needed until the second year. Street Plan COST ESTIMATE: $1,073 -Annual Budget for Street Maintenance ....................................... $1 073 METHOD OF FINANCING: Source of funds for the above costs will be the Local Roads and Street Fund, the Motor Vehicle Fun(~ and the General Fund. City Budget. PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Street maintenance will be assumed by the City of Jeffersonville within twelve (12) months after the effective date of annexation. The City's street maintenance budget will be increased by $1,073 annually starting in the second year after annexation to meet anticipated needs. The capital improvements outlined above for streets will be accomplished within three years of the effective date of annexation. 6 SIDEWALKS No sidewalks exist in Annexation Area 6. This is similar to conditions in the comparable area. Sidewalk Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Because sidewalks are provided for the Annexation Area in the same manner as in comparable parts of Jeffersonville, no new sidewalk construction is planned in Area 6. STREET LIGHTS There are no existing street lights in Annexation Area 6 or in the comparable area of the city. Street lights are installed under the City's policy of responding to a request which is submitted to the Board of Public Works for appreval or denial. If approved, street lights are installed by Public Service Indiana at a charge to the City of $7.53 per month for 150w sodium vapor lights using standard wooden poles and $6.55 for 1 O0w sodium vapor lights. Street Li,qht Plan COST ESTIMATE: $ 0 METHOD OF FINANCING: General Fund PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: The street light policy now in effect throughout the City of Jeffersonville will ~3e available to Annexation Area 6 immediately upon annexation. This policy will be comparable to the policy applicable to all parts of Jeffersonville. For financial planning purposes, it is assumed that the same number of street lights will be requested and approved for Area 6 as now exist in the corn parable area. GARBAGE COLLECTION Garbage collection ~s now provided to the residents and other uses in Annexation Area 6 by two private companies. Once per week residential pick-up is offered by Rumke of 7 Indiana, Inc. for $11.00 per month, and by BFt Waste Systems for $12.00 per month. Each offers varying rates based on container size for commercial customers. The City of Jeffersonville now provides one garbage pick-up per week for residences at no charge, Service is not provided for commercial or institutional uses. To avoid any additional ~3ersonnel or equipment costs and landfill expenses, the City plans to contract sanitation services 'n Annexation Area 6 to a private company. An estimated cost, based on current City sanitatio~ service contracts, to serve the Area's 17 existing residential pick-ups would be approximately $902 per year. Garba,qe Collection Plan COST ESTIMATE: $902 annually METHOD OF FINANCING: Sanitation Fund and/or other funds of the City. PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: The City of Jeffersonville will let bids on a contract to provide garbage collection to Area 6 at the City's present level of service. Bidding documents will be prepared and a bid awarded to provide service no later than the third month of the first year after annexation. WATER Annexation will nave no effect on water services as it is provided in Area 6 by private companies, the ndiana-Amedcan Water Company, Inc. and the Watson Rural Water Company. Water Service Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Continued provision of services by private companies. 8 FIRE HYDRANTS Annexation Area 6 now has 2 fire hydrants which are on the Watson Rural Water Company system. An additional 4 hydrants ara needed to serve Area 6 with hydrant availability comparable to the minimum standards of the Jeffersonville Fire Department, Map 4 whiCh is incorporated herein and attached as Exhibit C, shows the location of existing fire hydrants. Fire Hydrant Plan COST ESTIMATE: $1,293 annually --Annual Rental of Existing Fire Hydrants (2 @ $215.40 each) ............................. $431 --Annual Rental of New Fire Hydrants (4 @ $215.40 each) .................................... $862 METHOD OF FINANCING: General Fund,City Budget PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Rental on the existing fire hydrants will be assumed by the City the sixth month of the first year after annexation. The City will have four new fire hydrants installed no later than the sixth month of the first year after annexation. This will provide every structure in the Area with adequate accessibility to a fire hydrant. SANITARY SEWER The City of Jeffersonville's sanitary sewer service does not presently serve Annexation Area 6. In addition to the specific sewer need of Araa 6, the proposed Inner City Road Project includes directly ralated sewer improvements. These improvements involve the construction of an interceptor from Allison Lane to the 1-265 interchange consisting of the installation of approximately 8,000 feet of gravity sewer, 3,500 feet of force main, a new pump station and 25 manholes at an estimated cost of $1,068,480. This cost will be included as part of the proposed Tax Increment Finance (TIF) Project for the Inner City Road Project. Area 6's residences, businesses and church can ~3e sewered from the proposed interceptor. This would provide sewer service in a manner consistent with the 9 provisions of such service in the comparable area of Jeffersonville. This would generate an estimatee $12,225 in tap fees. However, it should be realized that these tap fees will not be collected until after the sewer is constructed and that a significant percentage of the fees may be paid on an installment basis. Sanitary Sewer Plan COST ESTIMATE: $0 METHOD OF FINANCING: General Func~ and other City funds PLAN FOR ORGANIZATION AND EXTENSION OF SERVICE: As part of the Annexation Area 6 ;)lan, the City will design and construct adequate sanitary sewer lines to serve the developed, but unsewered parts of the Area. Engineering design will be completed in the first quarter of year three and all construction will be completed prior to the end of year three. This will be done in connection with the TIF Project and will not involve a direct cost to the annexation of Area 6. STORM DRAINAGE Storm drainage facilities in the form of either ditches and culverts is available throughout Area 6. No significant drainage problems have been reported to the County within Area 6. Routine maintenance of drainage facilities will be provided by the City's street and sanitary sewer maintenance personnel at no additional budget expense. Storm Draina.qe Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICE: The City of Jeffersonville's personnel engaged in street and sanitary sewer maintenance will provide routine storm drainage maintenance by the twelth month of the first year after annexation. This service will be comparable to the storm drainage n!aintenance provided throughout the comparable area. The expense for this service is included in the cost figure for street maintenance. 10 FLOOD PLAIN Based on Federal Emergency Management Agency (FEMA) maps, no part of Annexation Area 6 is within a flood plain. Flood Plain Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Application of the City of Jeffersonville's floo(~ plain regulations in Area 6. FIRE PROTECTION Fire protection is presently provided to Annexation Area 6 by the McCulioh Volunteer Fire Department from its station on Allison Lane. In Area 6 the McCulloh system has a Class 7 rating. Jeffersonville Township now pays the Volunteer Fire Department for protection through a .1899 tax rate for properties in the unincorporated parts of the Township, Property owners in Area 6 would cease to pay this tax one year after annexation. Annexation will transfer the responsibility for fire protection to the City of Jeffersonville Fire Department which has a Class 5 rating. A major advantage of the Jeffersonville Fire Department is 24-hour response with sufficient people on duty at all times. The Jeffersonville Fire Department now has 49 fire fighter personnel and six trucks which serve the City from three stations, The distribution of fire fighting personnel and equipment is as follows: Central (Wall Street) East (Crestview) North (Fabricon) 4 Trucks 1 Truck 1 Truck 21 Firefighters 12 Firefighters 12 Fireflghters 11 Fire Protection Plan COST ESTIMATE: $0 METHOD OF FINANCING: PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: The City of Jeffersonville will provide fire protection to Area 6 six months after the effective date of annexation. This Will improve the Area's fire prOtecti0n service from a Class 7 to Class 5 rating, service to Area 6 will not reqUire any additional personnel or equipment. The City is currently studying two potential annexation areas in addition to Area 6. These three areas, when combined, will not change the financing, personnel or equipment needs outlined in this study. However, annexations beyond the three areas currently under study could require additional budget or the relocation of the Fire Department's East (Crestview) Station. POLICE PROTECTION Police protection is now provided to Annexation Area 6 by the Clark County Sheriff's Department. The Sheriff's Department has 31 officers to serve the entire County. The annexation of Area 6 will transfer the responsibility for police protection to the Jeffersonville Police Department. This Department will able to respond much quicker to the Area's police calls. In fact, the Jeffersonville Police Department makes about 33 runs per year to unincorporated areas because the Sheriff's Department personnel is stretcheC over too much land area. The annexation of Area 6 will help reduce the County's police work load. Existing personnel of the Jeffersonville Police Department consists of the Chief, Assistant Chief, 35 officers and 8 civilians. The City is now divided into three areas for patrol purposes and identification. Response time for the Police Department to all parts of the City averages 2.5 minutes. The patrol area delineations are as follows: East West North All streets east of Main Street All streets west of Main Street Everything north of E. 10th Street and Spring Street 12 Police runs along HighwaY 62 immediately to the Southwest of Annexation Area 6 average 80 runs per year. It is estimated that Area 6 will average approximately the same number of runs annually. The Police Department now actively patrols along the Highway 62 Corridor from Allison Lane to the boundary of Area 6. These patrols could drive the additional .6 miles of public street in Area 6 in approximately 2 to 3 minutes. This amount of time will not place any significant burden on existing police patrols. Police Protection Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Police patrols now traveling Highway 62 from Allison Lane to the boundary of Annexation Area 6 will be instructed to provide police protection to Annexation Area 6 starting the first day after the effective date of annexation. This plan to assume police protection responsibility can be implemented at no additional expense to the City as it will not require the hiring of any new personnel, will not require the purchase of any new equipment and will increase current patrol time by no more than three minutes. The City is now studying two annexation areas in addition to Area 6. These three areas when combined will not change the financing, personnel or equipment needs plan outlined in the study of each individual area. It should be stressed, however, that annexations beyond the three areas currently under study could result in the need for additional budget. RECREATION No public recreational facilities are located in Annexation Area 6. However, Vissing Park, located less than one mile from all parts of Area 6, offers facilities that would be available for residents of the prOpOsed annexation areal These facilities inClUde two (2) picnic Shelters, barbecue pavilion, thirty-two (32) picnic tables, restrooms, walking paths, biking trail, unlighted Softball field, badminton court, paved and lighted volleyball court, two (2) junior swing sets, three (3) merry-go-rounds, two (2) Slides, three (3) grills, five (5) sandboxes, one (1) horseshoe pit, and parking for seventy-four (74) cars. Some 154 acres of neighborhOod, communitY and city Parks are located thrOughOut the City and Will be available for the use of Area 6's residents. No increase in recreation personnel or facilities will be needed because of the Annexation of Area 6. 13 Recreation Plan COST ESTIMATE: $0 METHOD OF FINANICNG: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION SERVICES: The present recreational facilities of the City of Jeffersonville will be available to the residents of Area 6 immediately upon annexation. This will be comparable to the facilities available to the residents of comparable areas ~n the City. CITY ENGINEERING, PLANNING &ZONING, INSPECTION &-BUILDING CODE ENFORCEMENT AFl of the services of the City's engineenng, planning anc~ zoning, inspection and code enforcement personnel that are currently provided to residents of the City and the comparable areas will be made available to Annexation Area 6. No additional personnel will be needed to provide these services. City Enqineerin,q, Planninq & Zoninq, Inspection & Buildinq Code Enforcement Plan COST ESTIMATE: $0 METE OD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: The City will provide the above listed services with existing personnel. ADMINISTRATIVE SERVICES City administration and operations include departments that are not directly involved i~ the provision of capital and noncapital services. Some examples of this are the mayor's office, clerk's office, personnel, legal, etc. The request for these services will be provided to the same standard and scope as they are now previdee to the City and to the comparable area. These services can be provided within the bounds of existing resources. 14 F- Administrative Services Plan COST ESTIMATE: $0 METHOD OF FINANCING: Inapplicable PLAN FOR ORGANIZATION AND EXTENSION OF SERVICES: Immediately upon annexation, all of the City's administrative services will be provided to Annexation Area 6's residents and businesses in the same manner and scope they are now provided to comparable areas of the City. These services will be extended without hardship to the City's administrative offices and at no increased cost. OTHER CITY FUNCTIONS This plan attempts to outline services that may be impacted by the inclusion of Annexation Area 6 within the City of Jeffersonville's corporate boundaries. Any services not specifically addressed in this report have not been omitted for lack of consideration. Rather~ their absence indicates that provision of these services to the Annexation Area and/or its residents and businesses will be provided in the same manner that such services are provided to comparable areas without the expenditure of additional funds. The intent of this plan is that any services currently available to the comparable areas of the Annexation Area and/or their residents and property owners, that are not previously discussed in this plan, will be made available in the same manner to the Annexation Area and/or its residents and property owners immediately upon annexation. However, the City will not be required to hire any of these employees. In the event of unforeseen elimination of jobs, the City will take the application of any such employee and maintain a special file of these applications. Each application will be forwarded to major employers in the area, and to any City department having a job opportunity for which the individual is qualified.
